SUBJECT: CDP 99-23 - CANNON ROAD WIDENING AND SIDEWALK - Request for

That the Planning Commission ADOPT Planning Commission Resolution No. 4592
APPROVING Coastal Development Permit CDP 99-23 based upon the findings and subject to
the conditions contained therein.
II.BACKGROUND
This matter was before the Commission at its previous meeting and was continued in order to
provide Exhibits for the Commission's review.

SUBJECT: CDP 99-23 - CANNON ROAD WIDENING AND SIDEWALK - Request for

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4592
APPROVING Coastal Development Permit CDP 99-23 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
This proposed improvement to Cannon Road is a City Capital Improvements Project which is
located within the Coastal Zone (Mello II Local Coastal Program Segment). Pursuant to Section
21.04.107 of the Carlsbad Municipal Code, and Section 30610 of the Public Resources Code, the
addition to or enlargement or expansion of a public road facility within the City's Coastal Zone
requires the processing and approval of a Coastal Development Permit (CDP). The CDP
application was reviewed for consistency with LCP policies and implementation. There are no
unresolved issues. The staff recommended approval with conditions is supported by the analysis
as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
This project entails the widening of Cannon Road along its south side from Carlsbad Boulevard
to El Arbol Drive. The specific Cannon Road improvements include the construction of an
additional eastbound travel lane, curb, gutter, sidewalk and bike lane along this south side section
of Cannon Road. In order to accommodate these street improvements, the City will also
construct sand colored, split-faced concrete block retaining walls along four existing developed
residential properties that front along Cannon Road in this area. These full width improvements
to Cannon Road will result in twq travel lanes, a bike lane and sidewalk in both directions.

IV. ANALYSIS
Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies
The project is located in the Mello II Local Coastal Program Segment of the LCP which contains
land use policies for the development and conservation of coastal and water areas within the
segment boundaries.
The Carlsbad General Plan and the Mello II Local Coastal Program Land Use Plan designate
Cannon Road as a major arterial. The construction of the proposed improvements to Cannon
Road is consistent with this land use designation.
The road improvements will not obstruct views or otherwise damage the visual beauty of the
coastal zone in that there are no significant visual resources associated with the proposed area of
disturbance. There are neither agricultural activities nor any sensitive coastal resources (coastal
sage scrub or chaparral habitat) located on the project site. The project site is also geologically
stable. The construction of the proposed Cannon Road improvements (i.e.; an additional
eastbound travel lane, sidewalk and bike lane) will enhance public coastal access opportunities.
2. Coastal Resource Protection Overlay Zone
The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its
location and the absence of natural slopes steeper than 25% inclination and/or native vegetation,
additional submittals, standards or requirements do not apply. The project does not require a
grading permit. Construction of the project will adhere to the City's Master Drainage and Storm
Water Quality Management Plan as well as the City's Grading Ordinance to avoid increased
runoff and soil erosion.
V. ENVIRONMENTAL REVIEW
This project qualifies as being within the scope of the City's Master Environmental Impact
Report for the General Plan (MEIR 93-01) in accordance with Section 21083.3 of the California
Environmental Quality Act; therefore, the Planning Director issued a Notice of Prior Compliance
on June 14, 1999. With regard to air quality and circulation impacts, the City's MEIR found the
cumulative impacts of the implementation of projects consistent with the General Plan are
significant and adverse due to regional factors, therefore, the City Council adopted a statement of
overriding considerations. The project is consistent with the General Plan and as to those effects,
no additional environmental document is required.
