A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
ACCEPTING BIDS, AWARDING A CONTRACT TO BURTECH PIPELINE
INCORPORATED, A CALIFORNIA CORPORATION, FOR AN AMOUNT NOT TO
EXCEED $1,494,920 AND AUTHORIZING AN ADDITIONAL APPROPRIATION IN
AN AMOUNT OF $23,000 FROM THE WATER REPLACEMENT FUND FOR
CONSTRUCTION OF THE PALOMAR AIRPORT WATERLINE REALIGNMENT
PROJECT
WHEREAS, the Carlsbad Municipal Water District, or CMWD, Board of Directors of the City of
Carlsbad, California has determined that it is necessary, desirable and in the public interest to realign
and replace the water distribution pipelines it owns at the County of San Diego McClellan-Palomar
Airport for the Palomar Airport Waterline Realignment, Capital Improvement Program, or CIP, Project
No. 5055, or Project; and
WHEREAS, on June 21, 2022, the CMWD Board adopted Resolution No. 1678, approving plans,
specifications and contract documents and authorizing advertisement for bids for construction of the
Project; and
WHEREAS, on Sept. 7, 2022, staff received four bids for construction of the Project; and
WHEREAS, Burtech Pipeline Incorporated, a California corporation, submitted the lowest
responsive and responsible bid, in an amount of $1,494,920; and
WHEREAS, the total project cost is estimated at $2,168,160; and
WHEREAS, funds in the amount of $2,145,240 are available in the CIP Project No. 5055, for
project costs in the current fiscal year; and
WHEREAS, an additional appropriation in the amount of $23,000 will be appropriated from the
Water Replacement Fund; and
WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C){5) and 3.28.090(B) authorize the
Executive Manager or designee to approve change orders in an amount equal to the contingency set
at the time of contract award, which is $224,240 for the Project; and
WHEREAS, the City Planner has determined that the Project is categorically exempt from the
California Environmental Quality Act, or CEQA, pursuant to CEQA Guidelines Section 15302(c), as a
replacement or reconstruction of existing utility and/or facilities, and that no exception to the
exemption as set forth in CEQA Guidelines section 15300.2 applies.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of Directors
of the City of Carlsbad, California, as follows:
l.That the above recitations are true and correct.
2.That the bid of $1,494,920 submitted by Burtech Pipeline Incorporated is accepted and
the CMWD Board President is hereby authorized and directed to execute a contract for
the Palomar Airport Waterline Realignment, CIP Project No. 5055.
3.That the Deputy City Manager, Administrative Services, is authorized to appropriate
additional Water Replacement Funds in the amount of $23,000 for construction of the
Palomar Airport Waterline Realignment, CIP Project No. 5055.
4.That the Executive Manager or designee is hereby authorized to approve construction
change orders up to $224,240.
5.That the award of this contract is contingent upon Burtech Pipeline Incorporated
executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 days of adoption of this Resolution. The
Executive Manager may grant reasonable extensions of time to execute the contract
and assemble the required bonds and insurance policies.
PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of Directors of the
Carlsbad Municipal Water District on the 18th day of October, 2022, by the following vote, to wit:
