I greatly appreciate the city code and understand it's there to protect our quality of life and safety. I am seeking a reasonable accommodation based on Title 21 Chapter 21.87 regarding residents with disabilities. Eden has severe disabilities, both mental and physical which make her an elopement risk and threaten her safety. Eastern boundary (track side): 6'1'' from ground to top rail (built into the setback) South side: The wall is solid to 33" in height, permeable for the top 34" for emergency personnel, (Total height -S'S" from base to top rail) This again is built into the setback. I am asking that the fence be allowed to exceed the maximum height into the 20-foot setback to accommodate her special needs, and reduce the risk of her elopement. We believe that this will serve to protect Eden as she plays and performs her therapy exercises on the prescribed equipment. She will remain safely within the confines of the yard and not be allowed to escape at will due to the accommodation of the fence to be higher than 42" in the setback on the East, West, and South side. The top 35" will be see through for the purposes of the emergency services who may be called to the residence due to any unforeseen emergencies. 4. Eden's elopement issues are highlighted in the second paragraph of her Doctor's form attached. Her elopement issues and related risk of danger has been an issue of concern for her pediatrician for some time now. For this reason she has been sometimes assigned a care worker from the regional center. Eden has cerebral palsy, and spina Bifida among other neurological conditions. Her anxiety is developmental and related to her cognitive processing ability. We are scared for our daughter's safety due to her developmental/social disorder (she has panic attacks due to neurological functioning). Again, we are not stacking up reasons to keep the fence for our convenience. We erected it for the two reasons stated earlier in our correspondence; her safety, and security from criminal activity along the tracks. It was a huge cost, but her safety and wellbeing were paramount. The regional center stressed that with Eden's condition, we would need to take steps to make sure we were not being negligent as parents. We adopted her as a special-needs infant out of an ICU, and have had constant meetings with social workers and therapists over the years. With this fence, she is able to play in her yard on a specially built playground that suits her therapeutic needs. She is in weekly occupational and physical therapy. We built the fence to protect her while she is using her outdoor playground equipment, so that she can experience as normal a life as possible. I am seeking a reasonable accommodation for non-compliance to the code CMC Section 21.46.130 (wall/fence height). The justification for this reasonable accommodation request is based on Title 21 Chapter 21.87 regarding residents with disabilities. Eden has severe disabilities, both mental and physical which make her an elopement risk and threaten her safety. Eastern boundary (track side). I greatly appreciate the city code and understand it's there to protect our quality of life and safety. It is precisely for a safety issue that I seek the reasonable accommodation for a handicapped child. She has handicapped status, and is considered by her Doctor a flight risk. She is a member of the regional center and receives therapy there. She has a diagnosis of anxiety, and is unable to protect herself or make reasonable choices for her own safety. Eden requires constant supervision and the train tracks are a great risk if the gate is at 42". We would request the following: • The allowance of a 6 foot maximum fence on the East, South, and West side of the property to exceed the maximum height into the 20-foot setback to accommodate her special needs, and reduce the risk of her elopement. • On the South side, the wall is solid to 33" in height, permeable for the top 34" for emergency personnel, (Total height -5'5" from base to top rail) This again is in the setback. • The allowance of a maximum support column of91 inches. The columns supporting the fence and rolling gate are respectively from East to West: 79, 86, 91, 79, 79, 79 inches. 2. RESPONSE: The project site can be described as a 50's era single story modern home located in an established single family coastal neighborhood. The property fronts Chinquapin Ave. while the eastern portion of the property parallels the railroad right of way. Other on-site structures include a 2 -car garage with attached workshop and laundry room. The property is fully fenced and offers gated access along Chinquapin Ave where a concrete driveway with existing curb cut and aprons allow motor vehicles to access the site. The lot is surrounded on the west and north sides by developed properties. The topography of the developed site is generally flat with little to no significant grades or slopes. The property is fully landscaped with mature trees, lawns, shrubs and planter beds. No significant animal life has been observed and is unlikely due to the surrounding residential and public development. No significant cultural or historic aspects are observed and were likely addressed when the subdivision was graded and improved. RESPONSE: The properties surrounding the project site can be described as primarily a single family subdivision, fully developed with public and private improvements. A multifamily residen- tial development is located directly to the north of the subject property and is accessed off of Chinquapin Ave directly west of the project. The existing single family residential dwelling units are one (1) and two (2) story and a mix of 40's, S0's era homes and custom homes. Roof lines are pitched with primarily composition tile roofing. Building material consist of stucco, wood or composite siding both horizontal and vertical type. Yards are established with mature lawns, plantings and trees and associated concrete hardscape. The multi-family development consists of 3 two story buildings all similar in appearance with stucco clad exterior walls and pitched composition shingle roofs. The topography in the neighborhood is a combination of level and sloping grades. Chinquapin Ave slopes from the west at Garfield St down toward the Railroad right of way where Chinqua- pin Ave dead-ends. No significant animal life can be observed and is unlikely due to the sur- rounding developed residential neighborhood. No significant cultural or historic aspects are ob- served and were likely addressed when the subdivision was graded and improved.
