SUBJECT: CDP 99-32(A) - JENSEN RESIDENCE EXPANSION - Request for approval
of a Coastal Development Permit Amendment to allow for the expansion of the
livable floor area in an existing basement of a single-family residence within the
City's Coastal Zone located at 5139 Carlsbad Boulevard within Local Facilities
Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4991
APPROVING Coastal Development Permit Amendment CDP 99-32(A) based upon the findings
and subject to the conditions contained therein.
H.INTRODUCTION
Pursuant to Section 21.201.060.A.l.b of the Carlsbad Municipal Code, improvements to an
existing single-family residential building located within 50 feet of the edge of a coastal bluff
within the City's Coastal Zone requires the processing and approval of a Coastal Development
Permit Amendment (CDP(A)). The proposal converts non-livable space within an existing
basement to livable space. The CDP(A) application was reviewed for consistency with LCP
policies and implementation. There are no unresolved issues. The staff recommended approval
with conditions is supported by the analysis as follows.
HI. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill, developed lot located at 5139 Carlsbad Boulevard as shown on the
attached location map. The lot area is 0.53 acres (23,086 square feet). The property is currently
being developed with a single-family residence pursuant to Coastal Development Permit CDP
99-32, approved March 15, 2000.
Proposed Residential Construction: Internal expansion of the livable floor area of the basement
totaling 851 square feet. The existing residence totals 7,053, with 1,608 square feet of basement,
3,132 square feet of first floor, and 2,313 square feet of second floor space.
Proposed Grading: No grading is proposed with this CDP(A) because no expansion of the
existing basement perimeter is needed. Therefore, a grading permit will not be required for this
project.

IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 4991.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes the livable floor area expansion of an existing single-family
residence in an area designated for single-family development. The LCP Land Use Plan
designates the subject site for low medium density development (0.0 - 4.0 dwelling units
per developable acre).
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
The subject lots, and two other oceanfront lots, were created through a minor subdivision
(CDP 98-05, processed by this applicant) and Coastal Zone access was discussed at that
time. The applicant (and property owner of the subject property) constructed a beach
access stairway on the southernmost of the lots, providing access from Carlsbad
Boulevard to the beach. All easements to secure the public use of the beach access
stairway have been secured and, therefore, the proposed residential expansion still
conforms with the public access policies of Chapter 3 of the Coastal Act.
3. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location and the absence of slopes steeper than 25% inclination and/or native
vegetation, additional submittals, standards or requirements do not apply. The proposed
basement floor area expansion is contained within the existing envelope of the residential
structure, therefore the existing bluff top setback will remain.

V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
Section 15301(e) of CEQA exemptions (Class 3) exempts additions to existing structures
provided that the addition will not result in an increase of more than 50 percent of the
floor area of the structure before the addition, or 2,500 square feet, whichever is less.
A Notice of Exemption will be filed by the Planning Director upon project approval.
