RE: DEDICATION OF 20 FEET ON YOUR REAL PROPERTY LOCATED AT
260 TAMARACK AVENUE FOR FUTURE STREET WIDENING PURPOSES
Dear Mr. Fearn:
This is a follow-up to my letter of January 19, 1988 to you
regarding this matter. As you'll recall, you were required to
dedicate 20 feet of your property for future widening of
Tamarack Avenue in connection with the building permit issued
to you on June 21, 1982 pursuant to Carlsbad Municipal Code
Section 18.40.0JO(b). The amount of land required for this
dedication was determined from the latest alignment study for
Tamarack Avenue, drawing number 223.8 on file in the
Engineering Department. That alignment study shows a required
80 feet of right-of-way abutting your property. As you know,
at the time of the issuance of your building permit, the
existing right-of-way was only 60 feet. The current capital
improvement program buildout projections indicate that Tamarack
Avenue will be widenend sometime after 1997. Numerous capital
improvement projects are contained in the city's capital
improvement program and the date for widening of Tamarack
Avenue is subject to review, modification or deletion upon the
adoption of a new budget.
The Engineering technician who sent you the note regarding the
correct amount of dedication was Mr. Jim Cento who is no longer
employed by the City. It may have been that he originally
thought that the dedication would be less than 20 feet,
however, the plans themselves indicate that the correct amount
at that time was indeed 20 feet.

Dear Mr. Ball:
As we discussed yesterday, I received your letter of
December 14, 1987 notifying me of the court appearance
on January 18, 1988.
As I explained, I had already made arrangements to have
the patio cover moved back from the required set-back,
but I have been waiting to hear back from you regarding
the issue of the 20' of my lot that I had previously
dedicated to the City.
I apologize for the delay in getting back to you, but
I have been working out-of~state for the past few weeks.
I will arrange to have the patio cover moved back and
modified, as requested. I will try and have this completed
before the January 18, 1988 court appearance, so you can
have the work checked and dismiss the complaint.
However, I am still very anxious to hear from you regarding
the 20' of my lot that I dedicated to the .City, -in view of the
circumstances we discussed at our initial meeting.

CARLSBAD MUNICIPAL CODE SECTION 18.040.010 & 21.10.140(a)(l)
Dear Mr. and Mrs. Fearn and Mr. Fearn:
This matter has been turned over to ~y office because you have failed
to comply with the above referenced sections as a result of the
construction of a patio cover which encroaches into the required side
yard. According to the information that has been forwarded to me, you
were advised of this violation and qiven a correction notice on May
26, 1987 .· Since you had not corrected the violation as previously
requested , you were issued a "notice of municipal code violation and
order to remove" on September 1, 1987 which you acknowledoed receipt
of on September 4, 1987.
The purpose of this letter is to request your voluntary co~pliance
with this notice and order prior to the necessity of further action
from this office. In order to do that, you should immediately contact
the Department of Planning and Building Services in order to obtain
the necessary and proper building permits and variance or,
altenatively, remove the offending structure. Please contact Mr .
Michael Harrington , Code En c ment Officer, at 438-1161 in order to
