Recommended Actions
Adoption of a resolution authorizing the City Manager to accept the FY 2022 Edward Byrne
Memorial Justice Assistance Grant funds and authorize the Deputy City Manager of
Administrative Services or designee to appropriate $18,072 to the Public Safety Grants Special
Revenue Fund.
Executive Summary
The Police Department was awarded an $18,072 Edward Byrne Memorial Justice Assistance
Grant from the U.S. Department of Justice for fiscal year 2022-23. The funds will be used to
purchase police equipment, including a tethered drone and traffic enforcement equipment.
The grant requirements include notification of the City Council as well as an opportunity for
public input at a City Council meeting.
Discussion
The Edward Byrne Memorial Justice Assistance Grant provides states and local governments
funds to support a broad range of activities to prevent and control crime and to improve the
criminal justice system. The funds must be used to supplement existing funds for program
activities and cannot replace or supplant local funds.
The City of Carlsbad Police Department’s 2022 award is $18,072. The Police Department will
use the grant to purchase an automated message board with messaging suite, power supply,
and mounting kit, and a tethered drone.
The drone is classified as military equipment under state law, which, as of 2022, requires the
Police Department to have a City Council-approved policy on the use of such equipment.1 The
City Council approved the department’s Military Equipment Use Policy April 19, 2022.
1 Assembly Bill 481, which became effective Jan. 1, 2022, requires law enforcement agencies to obtain the
approval of their applicable governing body through the adoption of a military equipment use policy before it can
take certain actions relating to the funding, acquisition, or use of military equipment, as defined in the bill.

Acquiring the drone is consistent with the Police Department’s Military Equipment Use Policy
because it will replace an existing approved drone that is nearing the end of its expected useful
lifespan. The older drone, a DJI Matrice 100, which the City Council approved in the Police
Department’s Military Equipment Use Policy, is no longer commercially available, so the Matrice 30 T model is being purchased as a replacement because it is substantially similar.
The department will operate the drone in accordance with the Military Equipment Use Policy
for Unmanned Aircraft Systems and the acquisition will be documented in the in the Police
Department’s annual state-mandated report.

The total cost of listed purchases for FY 2022-23 is $18,072, which is fully reimbursable by the
Justice Assistance Grant program grant award. There are no ongoing expenses associated with
the purchases.
Next Steps
The City Manager will accept the grant funds, and the Deputy City Manager of Administrative
Services or designee will appropriate $18,072 to the Public Safety Grants Special Revenue Fund.
Environmental Evaluation
This action does not constitute a “project” within the meaning of the California Environmental
Quality Act under California Public Resources Code Section 21065 in that it has no potential to
cause either a direct physical change or a reasonably foreseeable indirect physical change in the
environment.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
comment and review at least 72 hours prior to the scheduled meeting date.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE CITY MANAGER TO ACCEPT THE FISCAL
YEAR 2022 EDWARD BYRNE MEMORIALJUSTICE ASSISTANCE GRANT FUNDS
AND AUTHORIZING THE DEPUTY CITY MANAGER OF ADMINISTRATIVE
SERVICES OR HIS/HER DESIGNEE TO APPROPRIATE $18,072 TO THE PUBLIC
SAFETY GRANTS SPECIAL REVENUE FUND
WHEREAS, the Police Department has been allocated funds through the Fiscal Year 2022
Edward Byrne Memorial Justice Assistance Grant Program to support activities to prevent and control
crime and to improve the criminal justice system; and
WHEREAS, the application for the Fiscal Year 2022 Edward Byrne Memorial Justice Assistance
Grant was heard during a regularly scheduled council meeting and the public was given an opportunity
to provide comments; and
WHEREAS, Carlsbad Police Department proposes to purchase traffic enforcement equipment
and a tethered drone;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the purchases specified are authorized in compliance with the grant and are
consistent with the Police Department's AB 481 Military Equipment Use Policy.
3.That the City Manager of the City of Carlsbad is hereby authorized to execute said award
with the US Department of Justice for receipt of the subject grant funds, as well as any
required reports and/or final statements.
4.That the Deputy City Manager of Administrative Services or his/her designee is
authorized to appropriate $18,072 to the Public Safety Grants Special Revenue Fund.
