Recommended Action
1.Receive a presentation regarding the Safer Streets Together Plan.
2.Provide feedback to staff regarding various options in the Safer Streets Together Plan
for staff to present to City Council.
Background
The City of Carlsbad proclaimed a local emergency for traffic safety on Aug. 23, 2022. The City
Council approved a resolution ratifying the proclamation on Aug. 30, 2022, and appropriated $2
million from unspent funds from the fiscal year 2021-2022 General Fund budget to support the
city’s immediate response actions.
In addition to the immediate actions, city staff developed a menu of short, mid- and long-term
solutions for the City Council’s consideration, focused on public education, infrastructure and
enforcement. On Sept. 27, 2022, staff presented these options to the City Council as part of a
Safer Streets Together Plan (Exhibit 1). The City Council voted to move forward with the
measures provided in Option A and refer the remaining options to the Traffic & Mobility
Commission and Planning Commission for their input.
Discussion
This presentation will provide an overview of the options provided in the Safer Streets Plan and
provide the opportunity for the public and Commissioners to ask questions and provide
feedback. This feedback will be summarized and transmitted to the City Council at a future
meeting.
Existing efforts
At its Sept. 27, 2022, meeting, the City Council directed staff to continue existing traffic safety
efforts and proceed with several new initiatives, including:
•A public education campaign that includes partnerships with schools, businesses,
mobility organizations and others
•Digital message boards and speed feedback signs deployed to high collision areas

•Adding high-visibility bike lane paint to high conflict areas
•Reconfiguring arterial roads
•Citywide speed limit review
•Upgrade pedestrian signals at 30 locations
•Expedite traffic calming on Tamarack Avenue, Skyline Road to Adams Street
•Expand repaving and restriping
•School e-bike certification/registration program
•Legislative advocacy for e-bike licensing
•Enhanced enforcement
Vision Zero strategies
The City Council also directed staff to return with a resolution of support for Vision Zero, a
strategy to eliminate traffic fatalities and severe injuries, while increasing safe, healthy and
equitable mobility for all. Vision Zero recognizes that the goal of zero roadway fatalities and
severe injuries among all road users is bold and daunting, yet setting that goal publicly is
important to making real change. To date, 54 cities and counties across the nation have
adopted Vision Zero, including Encinitas, La Mesa and San Diego in the local region.
Although the City of Carlsbad is already following many of the policies recommended in the
Vision Zero strategy, making a formal resolution would elevate the importance of these policies
and provide a framework for the actions already underway and any additional actions the City
Council chooses to add from the Safer Streets Plan.
Feedback requested
The City Council requested feedback from this commission on Options B and C presented in the
Safer Streets Plan. For the commission’s consideration, staff have developed questions that
may help guide and facilitate the commission’s discussion:

Executive Summary
A significant increase in collisions involving bikes and e-bikes, including two tragic fatalities
during an eight-day period in August, caused the City of Carlsbad to proclaim a traffic safety
emergency on Aug. 23, 2022. At its meeting on Aug. 30, 2022, the City Council ratified the
emergency proclamation and approved spending up to $2 million for immediate education,
engineering and enforcement measures (Resolution 2022-214).
At the same time, city staff set out to develop a comprehensive menu of additional actions for
the City Council’s consideration (Exhibit 1). One potential action is to commit the City of
Carlsbad to the Vision Zero approach to traffic safety, a national program promoting a
comprehensive approach to eliminating serious traffic related injuries and deaths.
Staff will present all options to the City Council along with estimated costs and timeframes and
seek direction on next steps.
Discussion
Background
Public safety is the most important job a city has, and the City of Carlsbad has always prided
itself on being one of the safest cities in the region. Traffic safety in particular is always top of
mind for the city and its residents.

During the first two years of the COVID-19 pandemic, far fewer people were on city roads,
although the use of e-bikes increased significantly. As schools and businesses resumed normal
operations, complaints about bike and e-bike safety increased, along with concerns about
vehicle speeding and other unsafe driver behaviors.
Concerns about traffic safety are not unique to Carlsbad. On Aug. 19, 2022, the National
Highway Traffic Safety Administration put out its estimates for the first quarter of 2022:
• U.S. roadway deaths rose 10.5% in 2021 and an additional 7% during the first three
months in 2022, the highest number for the first quarter in two decades.
• According to the Highway Traffic Safety Administration, the increase in deaths is due to
speeding, impaired or distracted driving and other reckless behavior.
Previous traffic safety actions
The City Council has already put policies in place to reflect a nationwide shift in planning roads
from a focus on cars to one that considers all modes of travel. These policies are included in the
General Plan Mobility Element, adopted by the City Council in 2015. Since that time, the city
has completed dozens of projects, such as expanding bike lanes, installing speed bumps in
neighborhoods and widening sidewalks.
More recently, the city has taken additional specific actions to address traffic safety and
mobility:
• In January 2021, the City Council adopted a Sustainable Mobility Plan, a comprehensive
approach to make Carlsbad streets more inviting to walkers and bikers.
o In June 2022, the City Council voted to accelerate several projects within the
plan as part of the fiscal year 2022-23 budget.
• In March 2022, the City Council made Carlsbad the first city in the region to pass traffic
safety laws specific to e-bikes. Carlsbad’s e-bike rules include a diversion program for
riders, who may complete a training course to avoid a citation on their first offense.
• In 2021, the city developed an initial e-bike education program, including workshops,
sharing information with schools and on social media, and a series of public service
announcement videos.
• In 2021, the Police Department increased enforcement through education, targeting
specific areas of concern.
Proclamation of local emergency
Despite these efforts, collisions involving bikes and e-bikes have still increased over 200% since
2019. Knowing students throughout Carlsbad were headed back to school in August, the city
determined there was an urgent need for additional traffic safety actions. The California
Emergency Services Act allows cities to declare a local state of emergency when needed to
protect public safety in extreme circumstances.
The state of emergency proclaimed by the City Manager and ratified by the City Council will
continue until Oct. 30, 2022. For it to continue beyond that date, the City Council must review
the proclamation at least every 60 days.

Immediate actions
Proclaiming a local emergency allowed the city to take four important steps toward addressing
the threat to public safety, including:
• Activate the Emergency Operations Center, which enables a centralized emergency
response
• Immediately redeploy resources
• Streamline procurement and other processes
• Increase focus and collaboration among residents, businesses, other agencies and the
business community
The City Council’s Aug. 30, 2022, vote ratified the emergency and approved spending an
additional $2 million for immediate traffic safety efforts, including:
• $535,000 for overstaffing the Police Department’s sworn positions by four additional
full-time officers
• $100,000 for police overtime for training and enforcement
• $250,000 to buy additional speed feedback signs and electronic messaging boards
• $1,115,000 for infrastructure projects and safe driving behavior education
Completed to date
With the added resources, focus and flexibility made possible by the emergency declaration,
the city has quickly mobilized to reduce the public safety threat identified by the findings of the
proclamation.
The following actions have been completed or are already underway and fully funded, either
through departmental budgets or the special $2 million appropriation approved by the City
Council.

Safer Streets Together Plan options
In addition to the immediate actions following the emergency proclamation, staff have
developed options for additional measures the city could take to address traffic safety,
arranged by short-, mid- and long-term implementation timelines.

Some of the potential actions can be funded through existing department budgets, while others
would require a mid-year appropriation. A list of potential actions organized by funding status is
provided in Exhibit 1.

Vision Zero
One of the proposed actions in the Safer Streets Together Plan is to adopt a Vision Zero
resolution. Fifty-four cities and counties throughout the country have officially joined as “Vision
Zero Communities,” which means they have committed to the goals and strategies of the
national Vision Zero Network and are included on the Vision Zero website. Of the 54 cities, 12
are in California. In San Diego County, two cities are included on the Vision Zero website, La
Mesa and San Diego. The San Diego Association of Governments has included Vision Zero as a
strategy in its Regional Transportation Plan, and the Encinitas City Council voted to support
Vision Zero in 2021.
Vision Zero is a strategy intended to eliminate traffic fatalities and severe injuries, while
increasing safe, healthy and equitable mobility for all. Vision Zero recognizes that the goal of
zero roadway fatalities and severe injuries among all road users is bold and daunting, yet
setting that goal publicly is important to making real change.
The Vision Zero process is rooted in data-driven decision making that provides transparency to
the community and allows city stakeholders to gather, analyze, use and share reliable data to
understand traffic safety issues and to prioritize resources based on evidence of the greatest
needs and impacts.
Although the City of Carlsbad is already following many of the policies recommended in the
Vision Zero strategy, making a formal resolution to adopt the zero fatalities goal would elevate
the importance of these policies and provide a framework for the actions already underway. If
the City Council decides to adopt Vision Zero, the next step would be to develop a Vision Zero
action plan. The Safer Streets Together Plan could be adapted to serve as a Vision Zero action
plan, should that be the desire of the City Council.

A balanced approach
The City of Carlsbad recognizes that successful traffic safety programs must include education,
engineering and enforcement. Likewise, all road users must share in the responsibility to
engage in safe behaviors.
The importance of thoughtful design
In addition to taking a balanced approach to solutions, focusing on education, engineering and
enforcement, the proposed actions reflect what staff believe to be an appropriate balance
between the speed at which infrastructure projects are completed (“quick build”) and the
potential risks of skipping steps in the design, community engagement and regulatory process.
The emergency proclamation allows the city to speed up certain processes. For example, the
city can procure supplies more quickly and enter into contracts with fewer steps in the approval
process.
When it comes to designing physical improvements and infrastructure changes, issues such as
vehicle speeds, bicycle and pedestrian demands, travel mode direction, and mode separation
needs are important factors that must be considered carefully.
For example, building protected bike lanes requires a thoughtful and thorough design process.
Special consideration must be given for intersections and driveways that may be affected due
to the additional width and visibility impacts created by protected bikeways.
Vertical measures such as soft posts may be appropriate in lower volume and lower speed
roadways, but arterial roadways with high traffic volumes and high speeds warrant much more
substantial physical protection from vehicles.
Even some short-term measures, such as placing cones in the roadway or other temporary
barriers, often have unintended consequences that reduce traffic safety for some users.
The schedules proposed in the Safer Streets Plan allow sufficient time to complete thoughtful
designs, in collaboration with the community, that will achieve each project’s goals while
minimizing or eliminating unintended consequences.

Design immunity
Thoughtful design may also provide the city with immunity from civil lawsuits. This immunity,
known as design immunity, is one of many strategies the city uses to manage its liability risks
and protect taxpayer funds.
Potential actions
To assist in evaluating potential actions in the Safer Streets Plan, the chart below provides
education, engineering and enforcement options that the city could implement and for
different levels of investment. The City Council may also choose to combine actions differently.

Fiscal Analysis
Staff’s recommended action requires no additional funding at this time. Staff have included
information about funding each of the options in the Safer Streets Together Plan in the
attached Exhibit 1.
Many initiatives in the Safer Streets Plan are already funded and able to move forward. Others
have funding sources identified in the Capital Improvement Program but require City Council to
appropriate funding in this fiscal year. Some options do not have funding identified. In those
cases, the City Council may choose to appropriate funding from one of the city’s fund balances,
seek grant funding or appropriate money from the General Fund reserve.
Next Steps
Based on City Council direction, staff will return to the City Council at a future meeting with
resolutions authorizing additional actions and funding.
Environmental Evaluation
The allocation of funding for anticipated actions intended to mitigate the emergency, which
includes infrastructure and safety improvements, and education and enforcement efforts
focusing on safe driving behavior are a Class 1 categorical exemption under California
Environmental Quality Act Guidelines Section 15301 - Existing Facilities. Specifically, Section
15301(c) exempts existing highways and streets, sidewalks, gutters, bicycle and pedestrian
trails, and similar facilities (this includes road grading for the purpose of public safety), and
other alterations such as the addition of bicycle facilities, including but not limited to bicycle
parking, bicycle-share facilities and bicycle lanes, transit improvements such as bus lanes,
pedestrian crossings, street trees and other similar alterations that do not create additional
automobile lanes.

The anticipated improvements to the city’s existing mobility network under this action will
improve public safety and address the critical issues raised in the emergency declaration.
Actions are anticipated to involve negligible expansion of the current facilities and
infrastructure beyond existing and will not result in additional automobile lanes. The actions
are not expected to increase vehicular use of the roadway, will occur within the existing public
right-of-way, and will not change the overall facility use of the mobility network. No exception
to the exemption as sets forth in CEQA Guidelines Section 15300.2 applies.
For the reasons stated above, the action is categorically exempt from CEQA under CEQA
Guidelines Section 15304(e), which applies to the minor temporary use of land having negligible
or no permanent effects on the environment, and CEQA Guidelines Section 15304(h), which
covers the creation of bicycle lanes on existing rights-of-way.

This item was noticed in keeping with the Ralph M. Brown Act and it was available for public
viewing and review at least 72 hours before the scheduled meeting date.

Introduction
National traffic safety trends show a dramatic increase in traffic-related deaths, with the first quarter
of 2022 showing the highest number of deaths in two decades. Here in Carlsbad, injury collisions
involving bikes and e-bikes have increased over 200% since 2019, with roughly half of those being
e-bikes in 2022. Community members have requested more neighborhood traffic calming, more
enforcement, stricter laws and faster implementation of the city’s program to adapt local streets to
current and future uses, which include more biking and walking.
The city has recently taken several steps to address these concerns:
• Approved a new comprehensive plan to transform the city’s road network to one that
prioritizes moving people, not just cars, and prioritized implementation in the city’s annual
budget
• Completed dozens of projects to slow traffic and expand bike lanes and sidewalks
• Passed stricter rules for e-bikes and similar motorized mobility devices
• Implemented a public education program focused on safe biking, including e-bikes
• Increased enforcement related to roadway safety and traffic violations
Despite these efforts, collisions involving bikes and e-bikes in 2022 are tracking at the same
unprecedented rate as last year’s high of one collision nearly every three days. With children
throughout Carlsbad returning to school in August and given the significant increase in bike and e-bike
collisions, the City of Carlsbad declared a local emergency on Aug. 23, 2022, to immediately provide
more options, tools and resources to reverse this trend.
About this plan
This plan provides potential immediate and longer-term actions to address traffic safety in three main
areas, often referred to as the three Es of traffic safety:

Foundational elements
The City of Carlsbad has already prioritized traffic safety through its policies, projects, services and
special initiatives. Some of these foundational elements include:
General Plan Mobility Element
Approved by the City Council in 2015, the Mobility Element
guides future decisions related to how the city plans the
connectivity of the city’s transportation system by
identifying the preferred attributes of various street types
found in Carlsbad. It incorporates a “complete streets”
approach to designing city streets that balances the needs
of all users on the street including motorists, pedestrians,
bicyclists, children, persons with disabilities, seniors,
movers of commercial goods and users of public
transportation. It is complementary to other elements
within the General Plan.
Planned projects
The city’s Capital Improvement Program includes 40 planned traffic and mobility related projects to be
completed over the next 15 years. Other projects are planned as part of the city’s Sustainable Mobility
Plan implementation and the Carlsbad Residential Traffic Management Program. In all the city is
currently working on over 100 projects related to traffic and mobility improvements at a cost of about
$350 million. Funding for these projects has been appropriated from various sources including gas tax,
the TransNet transportation sales tax, and the city’s traffic impact fees. Some of the main projects are
listed below in order of the expected completion date.

Approved by the City Council in January 2021, the Sustainable Mobility Plan implements the Mobility
Element of the city’s General Plan and guides the city in expanding and improving safe, healthy and
convenient travel options for people of all ages and abilities. It combines projects and programs from
12 previous planning documents into a single strategic plan that includes:
Safe Routes to School
An approach that includes infrastructure improvements, enforcement tools, safety education
and incentives to promote walking, bicycling and carpooling to school.
Transportation Demand Management
Strategies to encourage Carlsbad workers and residents to walk, bike, ride transit and carpool
instead of driving alone. This approach helps the city achieve its sustainability and mobility
goals while mitigating congestion and increasing access and connectivity in the transportation
network.
Local Roadway Safety Plan
A framework to systematically analyze and identify areas where transportation safety can be
improved and recommend specific safety improvements for all road users.
Street Design Guidelines
Provides a set of best practices that can be incorporated by the City of Carlsbad to create
streets that will serve all users. These guidelines were developed using best practices in street
design from Carlsbad, San Diego County, the state of California and around the world. They
are intended to evolve and adapt to incorporate new treatments and techniques as they are
developed and proven successful.

Carlsbad Residential Traffic Management Program
This program provides a way for city staff to work directly with neighborhoods that have concerns
about traffic safety. Based on an initial assessment, staff can utilize one or more approaches to slow
down speeds, discourage cut-through traffic, enhance pedestrian and bike safety, and make other
changes. Solutions include traffic circles, speed cushions, extending curbs and other measures. Eleven
neighborhoods are a part of the program this fiscal year:
• Victoria Avenue from Pontiac Drive to Haverhill Street
• Highland from Carlsbad Village Drive to Buena Vista Way
• Nueva Castilla from La Costa Avenue to Levante Street
• Monroe Street from Basswood Avenue to Carlsbad Village Drive
• Circulo Sequoia from Camino Junipero to Avenida Diestro
• Celina Drive from Carlsbad Village Drive to Chestnut Avenue
• Park Drive from Tamarack Avenue to Monroe Street
• Hummingbird Road from Sanderling Court to Rock Dove Street
• Black Rail Road from Poinsettia Lane to Northern Terminus
• Plum Tree Road from Hidden Valley to Aviara Parkway
• Carrillo Way from Rancho Brasado to Rancho Caballo Annual streets maintenance projects
The city repaves dozens of streets annually, based on conditions, to ensure the 350 miles of city-
owned roads are properly maintained. During construction, the city also updates the striping to best
serve all the users of the streets.
Customized traffic control plans for large events
The city minimizes the traffic impact of large events through the coordinated deployment of traffic
control devices and special events personnel.
Regional coordination and advocacy
The city collaborates with agency partners at Caltrans, the San Diego Association of Governments and
the North County Transit District on regional projects and long-term planning studies.
Public education
The city promotes safe driving, cycling and walking through an ongoing public education program that
includes social media, videos, workshops and partnerships with mobility groups.
Engineering design standards
Establishes uniform and best practice policies and procedures for the design and construction of public
improvements, which promote safety for all infrastructure users.
E-bike ordinance
In April 2022, the City Council made Carlsbad the first city in the region with a law specific to e-bikes,
e-scooters and other similar mobility devices. The law makes it easier to enforce safe e-bike riding
behaviors and includes a provision that allows people to take a safety class in lieu of paying a fine for
their first citation.
School crossing guard program
The City of Carlsbad funds 36 school crossing guards who serve 14 schools in the city, under the
supervision of the Carlsbad Police Department.

Traffic enforcement
There is a dedicated Traffic Division within the Carlsbad Police Department to enforce the rules of the
road.

Since the emergency proclamation on Aug. 23, 2022, the city has taken more than a dozen actions.
Many are funded through a $2 million budget appropriation made by the City Council when it ratified
the emergency on Aug. 30. Others are funded through existing budget appropriations for fiscal year
2022-23. In these cases, staff have accelerated the timing of implementation or temporarily
reprioritized other work.
Safer Streets Together roll out
Developed and implemented a short-term campaign to introduce the community to the
Safer Streets Together initiative, including the following activities:
• Created Safer Streets Together website within the city’s site to provide campaign
information and resources.
• Developed traffic safety related messages and engaged with followers on all city
social media channels. • Worked with school districts serving Carlsbad and private schools to distribute traffic
safety messages to students and parents via email newsletters and school site

Enhanced enforcement
Redeployed Police Department personnel to increase traffic enforcement around schools
during beginning weeks of classes. Reassigned two detectives to work overtime each
Friday, specifically to conduct traffic enforcement. Diverted one sergeant and two officers from their normal duties to specifically supplement the Traffic Division (to deploy on e-
bikes and in a vehicle). Purchased two additional e-bikes for police officer use.
Since the emergency was proclaimed and up to Sept 21, 2022, the Police Department has

Adopt a Vision Zero resolution No cost
Vision Zero is a strategy to eliminate traffic fatalities and severe injuries, while
increasing safe, healthy and equitable mobility for all. Vision Zero recognizes that the
goal of zero roadway fatalities and severe injuries among all road users is bold and
daunting, yet setting that goal publicly is important to making real change. To date,
54 cities and counties across the nation have adopted Vision Zero, including
Encinitas, La Mesa and San Diego in the local region.
Vision Zero strategies
The following strategies are part of the Vision Zero approach:
• Building and sustaining leadership, collaboration, and accountability – especially
among a diverse group of stakeholders to include transportation professionals,
policymakers, public health officials, police, and community members
• Collecting, analyzing, and using data to understand trends and potential

of these policies and provide a framework for the actions already underway and any

Understanding Carlsbad roadways and the types of vehicles on the road is an
important component of traffic safety and adapting the city’s approach to education,
enforcement and engineering. This includes information like traffic flow, speed and
mode of transportation. The city is developing an active transportation monitoring
report to fulfill the 2019 Sustainable Mobility Plan recommendation to launch the
program. The plan is organized around three dimensions of mobility – travel
demand, mode share and safety. Reports like this are usually a snapshot in time and
provide the city with valuable data. There are new data products that may provide
similar data but on a more frequent and closer to real-time basis. Staff proposes to
explore opportunities to acquire products that could provide accurate mobility data
on a more frequent basis to inform city actions and public education.
E-citation expansion $55,000

Building on the existing use of electronic citations by the traffic division, the Police
Department can complete its digital transformation related to writing, tracking, and
reporting citations. The technology has proven to increase citation writing speed,
improve efficiency and reduce the chance for human error when issuing paper
citations and entering them into a database. The acquisition of e-cite printers will
allow the remaining patrol officers who manually write paper tickets to use software
they already have to write the citation, print it in the field, and give it to the person
receiving the ticket. Data is transmitted electronically removing the potential for
human error from keying paper citations into a database. This will improve data
quality and will help the city in analyzing citation data to support safer streets.
Juvenile traffic safety incentive program $1,000

Create a program in which police officers contact juveniles who are obeying the laws

PROCLAMATION OF BICYCLE, E-BICYCLE �ND
MOTORIZED MOBILITY DEVICE SAFETY LOCAL EMERGENCY
IN THE CITY OF CARLSBAD, CALIFORNIA
WHEREAS, the California Emergency Services Act, including California
Government Code Section 8630, and the City of Carlsbad's Emergency Services
Ordinance, including Carlsbad Municipal Code Section 6.04.l00(A)(l), empower the City
Manager, as the City of Carlsbad's Director of Emergency Services, to proclaim the
existence of a local emergency, subject to ratification by the City Council, when there
exists, or there is threatened to exist, conditions of extreme peril to safety of persons
and property within the City of Carlsbad.
WHEREAS, the Director of Emergency Services finds:
1.Conditions or threatened conditions of extreme peril to the safety of persons
and property have arisen within the City of Carlsbad caused by the increased
prevalence of e-bicycles (e-bikes), other similar electric or motorized mobility
devices, and traditional bicycles on city streets, which has led to increased
collisions resulting in injury or death.
2.In 2019 there were 30 collisions involving bicycles or e-bikes reported in
Carlsbad.
3.In 2020 there were 62 collisions involving bicycles or e-bikes reported in
Carlsbad.
4.In 2021 there were 100 collisions involving bicycles or e-bikes reported in
Carlsbad.
5.To date in 2022, 57 collisions involving bicycles or e-bikes were reported in
Carlsbad.
6.U.S. traffic fatalities began climbing in 2020 and the deadly trend is
continuing.
7.According to estimates by the National Highway Traffic Safety
Administration, U.S. roadway deaths rose 10.5% in 2021 and an additional
7% during the first three months in 2022, the highest number for the first
quarter in two decades.
8.The increase in deaths is due to speeding, impaired or distracted driving and
other reckless behavior.
9.E-bikes are faster and heavier than traditional bicycles and e-bike injuries are
more likely to be more severe and require hospitalization than traditional
bicycle injuries.
10.E-bikes and similar electric or motorized mobility devices are increasingly
used by school age children to go to and from school and for other activities
on local streets.
11.Schools in the Carlsbad Unified School District will be opening on August 24,
2022, joining the other schools in Carlsbad and additional education facilities

“Low speed vehicle” has the same meaning as in California Vehicle Code Section 385.5, as it may be amended from time to time.
“Motorized scooter” has the same meaning as in California Vehicle Code Section 407.5,
as it may be amended from time to time.
“Operator” means a person who owns, operates, and/or controls a regulated mobility device.
“Public area” means any outdoor area that is open to the members of the public for
public use, whether owned or operated by the city or a private party.
“Regulated mobility device” means a bicycle, electric bicycle, electric personal assistive mobility device, electrically motorized board, low-speed vehicle, motorized scooter, shared mobility device, and any other similar vehicle.
“Rider” means a traveler riding in or on a regulated mobility device who is not operating
it.
“Shared mobility device” has the same meaning as in California Civil Code Section 2505, as it may be amended from time to time.

“Vehicle” has the same meaning as in California Vehicle Code Section 670, as it may be amended from time to time. (Ord. CS-419 § 2, 2022)
10.56.020 Operation of regulated mobility devices.
A. Prohibition of Regulated Mobility Devices Where Posted. It is prohibited to operate or ride on a regulated mobility device in public areas where such prohibition is posted by signs or as otherwise set forth in this chapter. A list of public locations where regulated mobility devices are prohibited shall be on file in the city clerk’s office. The list may be
amended from time to time by resolution of the city council.
B. No Operating or Riding on Sidewalks and Public Facilities. No person shall operate or ride a regulated mobility device upon any sidewalk, in any public drainage facility, culvert, ditch, channel, or any other public athletic/sports court, or gymnasium in the city.
C. Duty to Operate with Due Care, Reduce Speed.
1. The operator of a regulated mobility device shall exercise all due care and shall reduce the speed of the device, obey all traffic control devices, and take all other action relating to operation of the device as necessary to safeguard the operator, passengers, and any persons or other vehicles or devices in the
immediate area. It shall also be unlawful to transport any other person upon the
bar, handle bars, floorboard or other area of regulated mobility device not designed for passenger riding or designed for a single person, or cling to or attach oneself or one’s regulated mobility device with an operator or rider on board to any moving vehicle or motorized or non-motorized wheeled device.
2. Persons operating or riding a regulated mobility device on a city trail must
dismount the regulated mobility device where the trail width is less than five feet and a pedestrian or equine is within a distance of 50 feet from the regulated mobility device. (Ord. CS-419 § 2, 2022; Ord. CS-139 § 1, 2011; Ord. NS-151 § 1; 1991; Ord. 3062 § 8)
10.56.030 Enforcement.
In lieu of a fine or administrative citation as authorized by this code, and in lieu of filing charges in any court having jurisdiction over a violation, the police chief or designee may allow a violator of this chapter to complete a police department provided safety course for regulated mobility devices. 10.56.040 Exemptions.

A. Public Agency Personnel. Notwithstanding any other provision of this chapter, or any other section of this code, city and public agency personnel may operate regulated mobility devices or other vehicles at any place in the city in the performance of their
official duties.
B. Disability. This chapter is not intended to apply to or otherwise restrict regulated mobility devices used in a safe manner by physically disabled persons as defined under the Americans with Disabilities Act (42 U.S.C. Section 12101 et seq.). (Ord. CS-419 § 2, 2022)
10.56.050 Severability.
If any portion of this chapter, or its application to particular persons or circumstances, is held to be invalid or unconstitutional by a final decision of a court of competent jurisdiction, the decision will not affect the validity of the remaining portions of this
chapter or the application of the chapter to persons or circumstances not similarly

I agree to all of option C EXCEPT the $40 Million going to busses. This goes against being
greenand puts more traffic on the road as well as fees to repair busses and acquiring more

Support Safer Streets in Carlsbad!
We need your helping convincing the City of Carlsbad to invest in bike safety!
On August 23rd, the City of Carlsbad declared a bicycle safety state of emergency
after drivers killed two bicyclists in August. Carlsbad City Staff have already used $2
Million in emergency funding to install twenty new green bike lane treatments, twelve
digital message boards, and 17 speed feedback signs. They also have increased
enforcement of traffic violations, and have begun an ambitious bike education
campaign. We are encouraged by this work, but much more remains to be done for
Carlsbad to create safe streets for everyone.
Last month, Carlsbad City Staff presented three options for expanding their bike
safety campaign to the City Council, who then sent them back to Carlsbad’s Traffic
and Mobility Commission for more feedback.
Next Thursday at 5 pm, Staff will be presenting their plans to the Traffic and
Mobility Commission, and we need your help to convince them to select the
safest option!

City staff will be presenting three options:
Option A would not increase funding for bike safety beyond the $2 Million already
allocated.
Option B would allocate an additional $2.2 Million for items such as additional safety
outreach, additional high-visibility crosswalks near schools, and increased funding for
police e-citations and police rewarding teens for safe cycling.
Option C is advertised as costing an additional $48 Million, but 44 of those millions
would go solely to a school busing program. The remaining $4 Million would go
towards funding a whole list of awesome bike infrastructure and education projects,
including expedited infrastructure projects, safe access plans for schools, speed
cushions near schools, and updating the Mobility Element of Carlsbad’s general plan.
We will be asking the Traffic and Mobility Commission to support Option C with the
exception of the school busing program. We love school buses, but right now it seems
Carlsbad isn’t ready to invest in them. That shouldn’t discount all the rest of the
programs in Option C from being pursued.
We think City staff have come up with a visionary list of safety programs, and we hope
you’ll join us in supporting them!

I agree to all of option C EXCEPT the $40 Million going to busses. This goes against being green
and puts more traffic on the road as well as fees to repair busses and acquiring more personnel.

Re: Commissioner Correspondence for 10/27/2022 special meetings—Safer Streets Together
The questions about Safer Streets Together (SST) at the end of the staff report were submitted
by our commissioners with a commitment by staff to answer them about a week in advance of
this meeting to help make the meeting more efficient. Unfortunately, staff did not provide any
answers. In a separate effort to make the meeting more efficient, I would like to introduce the
following three general recommendations for review, albeit without the ability to take staff’s
responses to the questions into account:
1. School projects. Our commission has been trying to prioritize and expedite Safe Routes to
Schools (SRTS) and related mobility projects around schools, where there is a twice-daily mix of
vehicles with significant numbers of young pedestrians and bicyclists. Accordingly, I encourage
everybody to support SST Actions 33 and 35 (Develop access plans for all schools, and Speed
cushions on streets around schools, respectively).
Speed cushions are self-enforcing speed control devices that could work better than (or as
further enhancements to) high-visibility crosswalks (SST Action 15). There is no reason these
actions—or any of the other actions under Option C, for that matter—need to be pooled with
the $44 million school busing program, which is acting as a “poison pill.”
2. Staffing level. Carlsbad’s Sustainable Mobility Plan (SMP) was developed at a significant cost
over several years by staff, consultants, and our commission. The SMP and the Local Roadway
Safety Plan (LRSP) include long lists of goals, strategies, projects, and priorities to make
Carlsbad’s streets safer for pedestrians and bicyclists. The real challenge is that these projects
will take 30 years to accomplish, and one major limitation is staff time.
Although we should be sensitive to council concerns about the long-term, ongoing costs of
permanently expanding staff, perhaps there is a way to temporarily increase staff with an
approach like the one used in the last budget cycle. Please consider making at least temporary
staff increases (consistent with SST Action 32) to help expedite high-priority safety projects and
allow other ongoing mobility projects to progress without delays.
3. Unnecessary planning revisions. Carlsbad’s current General Plan Mobility Element, SMP, and
LRSP include laundry lists of goals, strategies, prioritized projects, etc. that promote pedestrian

and bicycle mobility and safety—often with significant redundancy. SST Action 41 calls for
amending the Mobility Element, and SST Actions 5 and 26 call for a commitment to a planning
approach and set of strategies contained on the “Vision Zero Network” website.
However, the General Plan is complicated to update, and layering yet another new, and largely
redundant, plan (Vision Zero) on top of our existing Mobility Element, SMP, LRSP, and other
plans is not necessary to accomplish our goals. In addition, although everybody should agree
with the Vision Zero goal of eliminating all severe or fatal crashes, many of the core strategies
espoused on the website are not necessarily compatible with Carlsbad (see below).
Accordingly, the consulting costs and staff time required to create/revise these plans instead
could be used to expedite and build the actual projects that improve conditions. As a
substitute, I would propose adding a new Vision Zero-like goal to the existing list of goals in our
SMP, which would be very simple and free to update and avoid further redundancy. For
example:
Goal: Eliminate all preventable traffic-related fatal and severe crashes by [YEAR].
Then, the city can identify our own set of preferred strategies, rather than committing to those
on the Vision Zero website. Other SMP amendments also could be considered. Staff has not
articulated any major things that could not be accomplished with this simple, cost-free
alternative approach.
Vision Zero website commitment concerns:
Vision Zero recognizes that vehicles impacting pedestrians or cyclists at speeds over 35 mph
leads to death in a majority cases (see the example graphic below from the Vision Zero Network
website). So, the core goal of Vision Zero is to take aggressive measures to reduce vehicle
speeds to 20 (“20 is plenty”) to 35 mph on all streets with pedestrian or bicycle traffic—or, in
the absence of the speed reduction, to erect physical barriers between the vehicle lanes and
bicycle lanes/sidewalks that prevent vehicles from encroaching.
Eliminating speed violations on all streets, and reducing speeds to 20-25 mph on most non-
arterial streets are legitimate goals. However, I do not think Carlsbad should make a
commitment to reducing the speed limit to 35 mph or less on our entire street network. And
our commission has not yet endorsed widespread use of physical barrier type protected bike
lanes on the arterial network, because they may actually make intersections more dangerous,
which is where the worst collisions occur—and the cost and logistical implications are
completely unknown.

The Vision Zero website also describes a three-pronged approach to achieving the speed
reductions (see the example graphic below from the Vision Zero Network website). In addition
to redesigning the streets and posting the lower speed limits, the third core strategy is to
employ automated enforcement using speed safety cameras that read license plates and
automatically send citations to violators. If setting the lower speed limits or using speed safety
cameras is not currently allowed, the expectation is that the city will lobby the state to change
the laws to allow them.
Instead of making an empty pledge to follow the strategic approach on the Vision Zero
Network website to strive for an unachievable goal, let’s just add the virtually identical goal
to our SMP, and then focus our energy on expediting actual projects.

Vision Zero (zero injuries and zero deaths) is not accomplished by creating any physical separation
with barriers or rumble strips on the roadway. These create more dangers for cyclists. As was
demonstrated in Encinitas, causing a death where a truck could not make a legal turn from the edge
of the roadway because of barriers and, along their coast where there has been a huge increase in
injuries and ambulance calls from barricades on the roadway where there had been no injuries
before with regular (class 2) bike lanes. A similar situation exists with barriers on a chicane at a turn
on Gateway which was put in by the builders and where there’s an accident waiting to happen.
Rumble strips cause crashes. Physical separation makes cyclists invisible to motorists until they
make contact at intersections where the most danger is. You can’t physically separate at
intersections. Bicyclists are legitimate road users, they are not pedestrians. Class 2 bike lanes
should never be removed to put in a physically separated bikeway which legally is not required use
by cyclists.
We should not be hiring contractors to do studies and build what looks good (green) and feels safe
but is not in reality safer. We have a great traffic engineering department that knows what is safe.
Physically separated bikeways are optional use for cyclists. Legally they don’t have to use them on
the roadway. Any educated cyclist would know the danger of them and use the roadway instead. .
Instead, as an option, there should be ( class 1) trails completely off the roadway where there are no
or limited intersections, like along our Lagoons (with I-5 underpasses), along the railroad right of way
(real rail trail) along the 5 freeway (North Coast Trail) as was planned and along the ocean by
realigning Carlsbad Blvd to connect the whole city east/west and north/south.
On the roadways we should have wider (class 2) bike lanes by restriping with paint and by doing
lane diets where feasible (Tamarack doesn’t need 2 lanes in each direction to the east and west of
ECR, there is limited traffic on it since Cannon/College was built) and traffic calming with
roundabouts at intersections.

Subject: Support for Carlsbad Safer Streets Together Plan
Dear Commissioners,
I’m writing on behalf of the San Diego County Bicycle Coalition to voice our strong support for
Carlsbad’s Safer Streets Together Plan. Bicycle safety is an undeniable public health
emergency in Carlsbad, and the Safer Streets Together Plan treats this crisis with the urgency
that it deserves.However, the already funded bike safety programs under Option A will not
be sufficient to reduce the epidemic of traffic injuries and fatalities on Carlsbad’s streets.
Only Option C, with its comprehensive approach to bicycle safety, will put Carlsbad on
the path towards safe streets for everyone.
Since 1987, the San Diego County Bicycle Coalition has acted as the voice for bicyclists in the
San Diego Region. We actively conduct educational programs, promote awareness of bicyclists
and bicycling issues, review infrastructure improvements, and act as a liaison between bicyclists
and government officials.It is clear to us, based on the skyrocketing bicycling crash rates
that Carlsbad has seen over the four years, that a significant and sustained investment in
comprehensive bicycle safety programs will be necessary to turn this deadly trend
around.
Carlsbad City Staff have taken the exact approach to bicycle safety that we recommend to every
city in San Diego County: Vision Zero. The Vision Zero approach starts from the premise that all
traffic fatalities are preventable, and seeks to eliminate them through a safe systems approach
including traffic engineering that accounts for human error, enforcement that targets behaviors
that cause the most harm, and education for all road users. We are thrilled that Carlsbad City
Staff have included all “three E’s” in their Safer Streets Together plan, and we would like to
highlight the components about which we are particularly excited in each area of the plan.

Engineering:
Of the “three E’s,” of traffic safety, engineering has by far the largest impact on safety. Moreover,
while Carlsbad’s safer streets together plan has already funded impressive investments in
education and traffic enforcement, much more work remains to be done on safe streets
infrastructure. Each of City staff’s excellent proposals in this area would make a significant
impact on traffic safety, and we encourage City Council to provide funding for all of them. We
are especially supportive of the unfunded programs listed below:
Install Speed Cushions Near Schools:
Speed is the largest factor in determining whether someone will survive a crash, and speed
cushions are one of the best approaches possible for slowing traffic speeds on low-speed
streets. While the risk of death for a pedestrian or cyclist is only 10% when hit by a car traveling
23mph, that risk increases to 50% when a car is traveling 42 mph.Lowering speeds to less than
25 mph in school zones is thus of truly of life-or-death importance.Studies have shown that
implementing speed cushions can lower traffic speeds by an average of 9mph, without
significantly slowing emergency response times. Speed cushions must be a part of Carlsbad’s
safe streets plan.
Install High-Visibility Crosswalks Near Schools
High visibility crosswalks are an essential pedestrian safety measure that will help keep
Carlsbad students safe as they walk and bike to school.Higher visibility crosswalks can reduce
crashes by 40%, and better crosswalk lighting can decrease crashes by up to 42%. Whenever
possible, new crosswalks should be accompanied by curb extensions to shorten crossing
distances for pedestrians.
Update the Mobility Element in the General Plan
Carlsbad’s general plan currently only prioritizes complete streets improvements on certain
residential, commercial, and coastal streets, and does not account for cyclist and pedestrian
safety on most major arterials. The explosive popularity of E-bikes is allowing more people than
ever before to ride long distances with significant elevation, requiring them to use many of these
arterials where Carlsbad is currently not considering bike safety. Carlsbad must update the
general plan to ensure that all roads are planned to meet complete streets standards.
Expedite Infrastructure Projects:
Carlsbad already has a long list of excellent bike and pedestrian safety projects in the planning
stage that are currently awaiting funding for construction. With bicyclist injuries increasing over

200% since 2019, every month a project is delayed could be lethal. Expediting already planned
projects is a simple step that Carlsbad must take to protect its residents.
Evaluate Roadway Treatments:
Carlsbad’s Street Design Manual currently does not include many of the innovative streets
design treatments like Class IV bikeways that we know improve traffic safety. The Street Design
Manual should be updated to recommend the use of NACTO Urban Street Design Guidelines
whenever possible.
Update Carlsbad Residential Traffic Management Program:
Specifically, the residential traffic calming plan should be updated to recommend roundabouts
over stop signs wherever possible, as replacing a stoplight or stop-controlled intersection with a
traffic circle or roundabout can reduce fatal or serious injury-causing crashes by 80%. An
excellent model for Carlsbad would be the City of Carmel, Indiana. Carmel has very similar
characteristics to Carlsbad, being a largely car dependent, high-income suburb of Indianapolis.
However, Carmel has systematically converted 140 intersections to roundabouts since 1996,
resulting in an 80% reduction in traffic fatalities. Carmel now has only 2.2 traffic fatalities per
100,000 people per year, compared to 12 in neighboring Indianapolis.Read a full history of

Explore School Busing Program:
Of the $48 million projected cost of Option C, $44 million would go towards exploring a busing
program. We would like to highlight this, and argue that the other measures proposed under
Option C should be implemented, even if the busing program proves fiscally unfeasible.
However, we are strongly supportive of a school busing program, from both a safety and a
sustainability perspective. Each parent dropping their child off to school represents four
unnecessary car trips each day, each of which produces excess greenhouse gas emissions,
and puts children who are walking and biking to school at greater risk. School busing is one of
the most effective ways to immediately reduce motor vehicle trips, and we enthusiastically
support this program.
Begin a Quick-Build Bikeways Program
In addition to the engineering proposals already included in staff’s safe streets plan, we strongly
encourage Carlsbad to begin a quick-build bikeways program as the Cities of Encinitas and San
Diego have already done.Quick-build bikeway programs use low-cost, low-impact materials to
implement bikeways in a matter of weeks rather than months or years. These programs use
restriping, flexible posts, modular speed bumps, and other materials to construct separated

bikeways, roundabouts, curb extensions, and speed bumps. Carlsbad should begin identifying
corridors with high rates of injuries and fatalities in the City and implementing quick-build traffic
calming features and separated Class IV bikeways in these places. Installing a separated Class
IV bikeway on an urban road where none previously existed can reduce crashes by over 80%,
while roundabouts and curb extensions can have similar effects. These treatments can be
completed in a matter of days with quick build materials.
Education:
Overall, we are very impressed with the educational programming the City Staff have already
included and funded in the Safer Streets together plan. However, there are two actions that are
not yet included in the plan that we believe would benefit Carlsbad.
a. Partner with Carlsbad School Districts to Offer Universal Bicycle Education:
Educating teenagers in safe cycling techniques is the easiest way in which to rapidly
expand bicycle education, and will yield the greatest safety benefits. In the long-term,
Carlsbad schools should make bicycle education a component of their health curricula,
and design a several week long series of classes taught by independent League
Certified Cycling Instructors or by Carlsbad teachers who receive League-Certified
Instructor Training from the League of American Bicyclists. In the short term, the San
Diego County Bicycle Coalition has the resources to immediately begin planning bike
safety assemblies at every school in Carlsbad, and we are ready to partner with school
districts and the city to do this.
b. Expand Opportunities for Carlsbad City Employees and Residents to take
Bike-Friendly Driver Courses:Driver errors are far more likely to cause injury or death
than those made by bicyclists, so educating them about how to safely drive near
bicyclists should be a priority. The San Diego County Bicycle Coalition has developed a
Bicycle-Friendly Driver curriculum and series of courses that we would be happy to
share with Carlsbad in whatever capacity would work best for the city.
Enforcement:
We are pleased to see that Carlsbad’s increased enforcement during the state of emergency
has focused on unsafe actions performed by all road users, not only by bicyclists. We support
this work, and believe all currently funded enforcement programs should continue. We do not
believe that further increases in funding for traffic enforcement will be the maximally effective
use of city resources in pursuit of bicycle safety.
Conclusion:
Bike and E-bike safety is an urgent public health crisis, and we are grateful for Carlsbad’s
leadership in recognizing it as the emergency that is. We are doubly grateful to Carlsbad City

staff for developing such an exemplary list of proposed actions to address this crisis.We are in
full support of staff’s proposals, and encourage the Traffic and Mobility Commission to
recommend funding for as many of them as possible, with particular emphasis on the
proposals highlighted above.
This state of emergency is an unprecedented opportunity to transform Carlsbad into a genuinely
bike-friendly city, where everyone will feel safe biking and walking regardless of their age and
ability. It is also an opportunity for Carlsbad to show national leadership in the movement for
complete streets.
Thank you for considering our recommendations. The San Diego County Bicycle Coalition is
excited to continue partnering with the City of Carlsbad as it seeks to make its streets safer for
everyone.

Comments for Oct 27 Meeting from Commissioner Pete Penseyres
1. Selecting options often involves tradeoffs. How should the City Council weigh such
tradeoffs:
• Cost to implement (one-time costs and ongoing costs)
• Time to implement
• Geographic locations (e.g., Focus on high collision areas or aim to provide equal
attention to all four districts? or, Should neighborhood traffic calming be done on a
first come-first served basis or through some other criteria?)
• Community character (Some safety measures may affect the aesthetics of an area.
How should the City Council weigh aesthetics and safety?)
My recommendations:
One time costs are better in terms of potential on-going benefits that may even result in long term
savings, such as the E-citation purchase of electronic devices with printers to minimize duplicate
manual data input now and in the future.
Since the money is available now, the quickest “shovel ready” items that promise safety benefits
should be done first.
Neighborhood projects should focus on high collision areas and then on a first come first served basis
to be fair, while also considering the “Squeaky Wheel” areas that can’t be ignored without
considerable resources just to respond.
Aesthetics should never be a priority over safety, but it can be considered while the safety issue is
expedited.
2. What would the commission consider to be the highest priority options and why?
Vision Zero should be used to address fatal and serious injuries while accounting for human errors.
While this might result in traffic calming measures that create noise (e.g. speed cushions) or more
minor injury solo crashes by DUI drivers (e.g. Roundabouts/Traffic circles), there can be no higher
priority to address the emergency than saving lives and preventing debilitating injuries.
The primary reason a Carlsbad version of Vision Zero is vitally important is that current methods of
investigating fatal and serious collisions between motorists and pedestrians do NOT specifically look
for a root cause and THEN consider corrective actions to prevent recurrence. Police investigate all
crashes, even those that don’t involve a motor vehicle or injuries. They determine all vehicle code
sections that were violated by each party and assign a primary cause factor (PCF) to one of the parties.
After the police finish their investigation, a report is filed to the State Wide Incident Reporting System
(SWITRS). The results of the SWITRS reports are used by the Insurance Companies, attorneys, and

Courts to determine if and who should be prosecuted, as well as if and who should be compensated,
how much compensation should be awarded, and who should pay. There is no attempt to determine
the root cause or any corrective actions to prevent recurrence.
This is when a Vision Zero investigation should begin. It is vitally important to do these investigations
for only Fatal or Severe injury crashes. Step one is to determine WHY one or both of the parties made
a mistake (Vehicle Code violation) and WHAT kind of corrective actions would be most likely to
prevent a recurrence. The HOW is a root cause evaluation using analysis tools that are commonly used
in the Nuclear and Aerospace Industries. The WHO Is readily available within the Police Dept in
conjunction with Staff and perhaps one or more Traffic and Mobility Commissioners.
For example, the SWITRS report for the fatal crash on Carlsbad Blvd is complete. The police
representative to our October 3 meeting reported the cause to be speeding. SWITRS lists the PCF as
DUI. News reports indicated that a State Parks employee attempted to chase the motorcyclist so that
might also factor into any root cause analysis. Corrective actions to prevent recurrence would follow
the root cause analysis.
It is possible that corrective actions in this case would be like those proposed by the staff to address
climate change. Using life saving roundabouts on the segment of Carlsbad Blvd where this collision
occurred would allow traffic to flow smoothly at a lower maximum but likely higher average speed.
Roundabouts are known to reduce fatal crashes by 90% and serious crashes by 70% by eliminating the
possibility of high-speed T-bone crashes. They are also very effective as “unstaffed DUI checkpoints”
as crash data for the Carlsbad roundabout at State St and Carlsbad Blvd has demonstrated. The staff
proposed changes would address both the speeding and the DUI causes of this crash.
There are a reasonable number of crashes (less than a dozen or so per year) that can provide effective
corrective actions to prevent recurrence from the toolkit that is provided through legally defensible
Engineering, Education, and Enforcement actions. Engineering actions must comply with the MUTCD.
Enforcement actions must comply with the CVC. Education must also comply with CVC and the
MUTCD and should be provided by Certified Instructors by League of American Bicyclists (LAB). The
LAB provides American Specialty liability insurance coverage for Certified Instructors and for the City
or Agency where instruction is provided.
Another WHY is the national trend to higher rates of serious crashes and fatalities since the pandemic.
Carlsbad has not been isolated from this tragic trend. While Carlsbad should not attempt to create
traffic calming on major arterials and industry streets that use LOS to serve motorists, other projects
that can make motorists aware of, and respectful of, other users should be considered based on data
driven before and after studies of their effectiveness so that they can be modified or removed in areas
where they are tried using the experimental process provided in the MUTCD.
3. What options does the commission feel should not be considered and why?
1) The $44,000,000 plan to purchase electric school buses should not be considered at this time. E-
bikes and regular bikes are already replacing many motor vehicle trips for students and the trend may
continue until most parents no longer see any benefit to driving their kids to school. NCTD buses
might fill in for students who travel beyond the reach of Safe Routes to School. The School Districts
need for these buses may be overtaken by other options long before this purchase could be funded,

and the buses delivered. It is also unlikely that the high socio-economic status of Caarlsbad would
qualify for Federal or State grants that will almost certainly be awarded to School Districts whose
families are more likely to be in poverty.
2) The Legislative advocacy for E-bike licensing should not be used to attempt unenforceable
restrictions on E-bike riders. The E-bikes are too much fun! And they are encouraging Active
transportation of pre-driving age children to school, the beach, and other activities that would
normally require 4 trips (2 round trips) by motor vehicle. Adults are also using these bikes for
commuting and utilitarian trips as well as for recreation. Any legislation aimed exclusively at E-bike
riders must be carefully crafted to be educational and encouraging rather than restrictive and
punitive. The Police Enforcement and Diversion Program, along with the Police Officer Smart Cycling
instructor program, the Juvenile traffic safety incentive program, the Teen engagement program, the
Safe Routes to School options, and the Vision Zero crash analysis program should be relied on instead.
These actions will accommodate the safest integration of what can be the most effective way for the
City to meet State mandates for Greenhouse Gas Emissions, Traffic Demand Management, and
Vehicle Miles Travelled.
4. What else would the commission like the City Council to consider when evaluating Options B and C in
the Safer Streets Plan?
1. The City Staff has done an excellent job of providing a comprehensive list of proposals for the Safer
Streets Plan. The items that provide improved Safe Routes to School, the transformational Diversion
Program, Education Programs at schools to provide for safe riding and rewards should be prioritized
to encourage more people to walk and bicycle.
2. The October 6 article in the San Diego Union-Tribune using data obtained from a public records
request provided some little-known information that motorists are more likely to be at fault for
collisions that involve a bicyclist. The percentage reported is less than I have determined for the same
2019 to mid-2022 because the author reported bicyclist crashes into a legally parked car with no one
in it as if they were a car-bike crash rather than those that don’t involve any action by a motorist. The
author determined that motorists were at fault 48% of the time vs bicyclists at fault 44% of the time,
with the remainder unknown. Eliminating the unknown and leaving out the crashes where the
bicyclist crashed into a legally parked car changes the percentages to 62% motorist fault vs. 38%
cyclist fault.
I have been doing analysis of SWITRS crash data for Bicyclists since 2014 in Carlsbad and since 2004 in
Oceanside to use for the Smart Cycling Classes. Without access to the actual police reports, the
following data analysis for only car-bike crashes has produced the following chart using SWITRS PCF
and CVC Codes and in some cases Google Earth to determine most likely root causes.
Since right hooks are the “elephant in the room” for Carlsbad, the City should monitor the behavior of
motorists who make right turns from outside the dashed extension of bike lanes, especially where
skip dashed green paint has been used to highlight this area.

Are motorists going to be more or less likely to yield to bicyclists they are starting to overtake and
move into the that area behind the bicyclists or will they be more likely to stay out in the rightmost
travel lane and make illegal right turns while not noticing bicyclists who begin to pass on their right?

Support Safer Streets in Carlsbad!
We need your helping convincing the City of Carlsbad to invest in bike
safety!
On August 23rd, the City of Carlsbad declared a bicycle safety state of
emergency after drivers killed two bicyclists in August. Carlsbad City Staff
have already used $2 Million in emergency funding to install twenty new
green bike lane treatments, twelve digital message boards, and 17 speed
feedback signs. They also have increased enforcement of traffic violations,
and have begun an ambitious bike education campaign. We are encouraged
by this work, but much more remains to be done for Carlsbad to create safe
streets for everyone.
Last month, Carlsbad City Staff presented three options for expanding their
bike safety campaign to the City Council, who then sent them back to
Carlsbad’s Traffic and Mobility Commission for more feedback.
Next Thursday at 5 pm, Staff will be presenting their plans to the
Traffic and Mobility Commission, and we need your help to convincethem to select the safest option!

Option A would not increase funding for bike safety beyond the $2 Million
already allocated.
Option B would allocate an additional $2.2 Million for items such as
additional safety outreach, additional high-visibility crosswalks near schools,
and increased funding for police e-citations and police rewarding teens for
safe cycling.
Option C is advertised as costing an additional $48 Million, but 44 of those
millions would go solely to a school busing program. The remaining $4
Million would go towards funding a whole list of awesome bike infrastructure
and education projects, including expedited infrastructure projects, safe
access plans for schools, speed cushions near schools, and updating the
Mobility Element of Carlsbad’s general plan.
We will be asking the Traffic and Mobility Commission to support Option C
with the exception of the school busing program. We love school buses, but
right now it seems Carlsbad isn’t ready to invest in them. That shouldn’t
discount all the rest of the programs in Option C from being pursued.
We think City staff have come up with a visionary list of safety programs,
and we hope you’ll join us in supporting them!

I agree to all of option C EXCEPT the $40 Million going to busses. This goes against being
greenand puts more traffic on the road as well as fees to repair busses and acquiring more
personnel. Use the money wisely.
