ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced that the City Council is
serving as the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item
No. 5.
INVOCATION: None.
PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance.
PRESENTATIONS:
Proclamation in Recognition of Red Ribbon Week
Mayor Hall read the proclamation. CUSD Student Service Specialist Rosemary Eshelman and
CUSD Superintendent Ben Churchill presented the proclamations to the Carlsbad Unified School
District representatives.

PUBLIC COMMENT:
Mary Lucid expressed her concerns regarding Senior Center management.
Christina McGoldrick requested that crossing guards be included in the city contract for
elementary and middle schools.

1. REPORT ON CITY INVESTMENTS AS OF AUG. 31, 2022 – Accept and file Report on City

2. AMENDMENT TO AGREEMENT WITH PROSIO COMMUNICATIONS, INC. TO PROVIDE TRAFFIC

Amendment No. 1 to the professional services agreement with Prosio Communications, Inc.,

3. AMENDMENT TO AGREEMENT WITH PROS CONSULTING, INC. FOR PARKS & RECREATION
DEPARTMENT MASTER AND STRATEGIC PLANNING SERVICES – Adoption of Resolution No.
2022-247 ratifying Amendment No. 3 to extend the professional services agreement with
PROS Consulting, Inc. for Parks & Recreation Department master and strategic planning
services for a one-year term. (Staff contact: Mick Calarco, Parks & Recreation Department)
Mary Lucid expressed her concerns regarding the cost for Pros Consulting.
4. MEMORANDUM OF UNDERSTANDING WITH THE CITY OF ENCINITAS FOR REIMBURSEMENT
OF PAVEMENT REHABILITATION AND AMERICANS WITH DISABILITIES ACT-COMPLAINT CURB
RAMPS ON OLIVENHAIN ROAD – Adoption of Resolution No. 2022-248 authorizing the City
Manager to execute a Memorandum of Understanding with the City of Encinitas for
reimbursement of the costs associated with Carlsbad’s portion of pavement rehabilitation
and the installation of Americans with Disabilities Act-compliant curb ramps on Olivenhain
Road. (Staff contact: Eric Zielke and Hossein Ajideh, Public Works Department)
Council Member Acosta thanked staff for their collaboration with the City of Encinitas.
5. AWARD OF CONTRACT TO BURTECH PIPELINE INCORPORATED AND AUTHORIZATION OF
ADDITIONAL APPROPRIATION FOR THE PALOMAR AIRPORT WATERLINE REALIGNMENT
PROJECT (CIP PROJECT NO. 5055) – Adoption of Carlsbad Municipal Water District Board of
Directors Resolution No. 1685 accepting bids, awarding a contract to Burtech Pipeline
Incorporated, a California corporation, for an amount not to exceed $1,494,920 and
authorizing an additional appropriation in an amount of $23,000 from the Water
Replacement Fund for construction of the Palomar Airport Waterline Realignment project.

ORDINANCES FOR INTRODUCTION:
6. INTRODUCE AN ORDINANCE ADOPTING THE 2022 CALIFORNIA FIRE CODE, ALONG WITH
LOCAL AMENDMENTS, AND SET A PUBLIC HEARING FOR NOV. 8, 2022 – 1) Introduction of
Ordinance No. CS-436 repealing existing Chapter 17.04 of the Carlsbad Municipal Code, and
adopting a new chapter 17.04, Fire Prevention Code based on the 2022 California Fire Code;
and
2) Schedule a public hearing for Nov. 8, 2022, to consider adoption of the ordinance. (Staff

City Manager’s Recommendation: Introduce the ordinance and schedule a public hearing.
Fire Marshal Randy Metz reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).
City Attorney Cindie McMahon titled the ordinance.
Fire Marshal Metz explained that that the state will adopt the California Fire Code with all
statewide amendments on Jan. 1, 2023. He added that amendments will include adding

language to the ordinance on page 17 of the staff report to read: “and no earlier than the
effective date of the 2022 California Building Standards Code, which is January 1, 2023.” Fire
Marshal Metz added that once the California Fire Code is adopted, it will be known as the
Carlsbad Fire Code. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to introduce
Ordinance No. CS-436 include adding language to the ordinance on page 17 of the staff report
to read: “and no earlier than the effective date of the 2022 California Building Standards
Code, which is January 1, 2023.” and set the Public Hearing for Nov. 8, 2022. Motion carried
unanimously, 5/0.
7. INTRODUCE AN ORDINANCE ADOPTING THE 2022 CALIFORNIA BUILDING STANDARDS CODE
AND RELATED CALIFORNIA CODES FOR CONSTRUCTION, ALONG WITH LOCAL AMENDMENTS,
AND SET A PUBLIC HEARING FOR NOV. 8, 2022 (MCA 2022-0005) – 1) Introduction of
Ordinance No. CS-437 repealing and replacing Carlsbad Municipal Code Chapters 18.04
(Building Code), 18.06 (Uniform Housing Code), 18.08 (Mechanical Code, to be retitled
Historical Building Code), 18.12 (Electrical Code), 18.16 (Plumbing Code), 18.18 (Solar Energy
Code), 18.19 (Dangerous Building Code), 18.20 (Residential Code), 18.21 (Green Building
Standards Code), and 18.30 (Energy Conservation Regulations), and adding Chapters 18.03
(General Provisions), 18.09 (Existing Building Code), and 18.10 (Mechanical Code), based on
the 2022 California Building Standards Code as amended; and
2) Schedule a public hearing for Nov. 8, 2022, to consider adoption of the ordinance. (Staff

City Manager’s Recommendation: Introduce the ordinance and schedule a public hearing.
Assistant Director of Community Development Manager Mike Strong and Building Official
Jason Pasiut reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
City Attorney Cindie McMahon titled the ordinance.
Community Development Department Strong explained that the amendments to the
California Building Standards Code amendments include noise standards near airports and
freeways, screening of roof mounted equipment and rooftop hazards, roof rainfall drainage
systems, fire classification for PV systems and reach codes, as well as other amendments
which are mostly administrative in nature.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to introduce
Ordinance No. CS-437 to include language on page 55 of the staff report that reads: “and no
earlier than the effective date of the 2022 California Building Standards Code, which is
January 1, 2023,” and set the Public Hearing for Nov. 8, 2022. Motion carried unanimously,
5/0.
8. UPDATE TO THE CITY’S HISTORIC PRESERVATION ORDINANCE, INCLUDING THE
ESTABLISHMENT OF A LOCAL MILLS ACT PROGRAM – 1) Introduction of Ordinance No. CS-
438 amending Carlsbad Municipal Code Title 2, Chapter 2.42 Historic Preservation
Commission and Title 22 Historic Preservation; and

2) Consider a recommendation from the Historic Preservation Commission to direct staff to
work with the Historic Preservation Commission in developing additional historic
preservation incentives for the City Council’s consideration. (Staff contact: Mike Strong,

City Manager’s Recommendation: Introduce the ordinance and direct staff as appropriate.
Assistant Director of Community Development Mike Strong and Delcamp Preservation
Planning representative Teri Delcamp reviewed a PowerPoint presentation (on file in the
Office of the City Clerk).
As part of the presentation, Assistant Director of Community Development Strong explained
that the Historic Preservation Commission recommended to strike language in the ordinance
on Exhibit 1 page 13 Section 22.06.040 of the staff report that reads: “The commission, or
City Council may also initiate such proceedings by motion.”
Assistant Director of Community Development Strong also explained that the Historic
Preservation Commission recommended to strike Section 22.10.010 – State Historical
Building Code and Section 22.10-030 – State Historical Building Code in their entirety.
Renee Wailes spoke in support of the item with the amendments made by staff.
Bob Wailes spoke in support of the item with the amendments made by staff. Wayne Brechtel spoke in support of the item with the amendments made by staff.
In response to Council Member Norby’s inquiry, Assistant Director of Community
Development Strong explained that applications would be limited to properties listed on the
local historic registry.
Council Member Norby expressed his concerns regarding the limitations of the program
suggesting staff return in three years to assess how many property owners had participated
in the program.
Mayor Hall called a recess at 5:59 p.m.
Mayor Hall reconvened the meeting at 6:04 p.m.
City Manager Scott Chadwick explained, for the record, that Chapter 22.10.020(b) states that
individual properties that are not a qualified historical property at the time of the application
for a Mills Act contract may submit an application for the property to be listed in the register
simultaneously with the application for a Mills Act contract. He further explained that the
application will be processed concurrently.

9. ORDINANCE NO. CS-435 – COMPENSATION FOR THE CITY CLERK AND CITY TREASURER –
Adoption of Ordinance No. CS-435 amending Carlsbad Municipal Code Chapter 2.04, Section
2.04.020 – Compensation – City Clerk and City Treasurer. (Staff contact: Faviola Medina, City
Clerk’s Department)
City Manager’s Recommendation: Adopt Ordinance No. CS-435.
City Attorney Cindie McMahon titled the ordinance.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
Ordinance No. CS-435. Motion carried unanimously, 5/0.
PUBLIC HEARING:
10. PERMANENT LOCAL HOUSING ALLOCATION PROGRAM FUNDING PLAN AND AUTHORIZATION
OF APPLICATION FOR FUNDS – Adoption of Resolution No. 2022-249 adopting the funding
plan for Permanent Local Housing Allocation Program funds and authorizing the submittal of
a funding application for the 2019, 2020, 2021 allocation years in the amount of $1,162,504.

City Manager’s Recommendation: Take public input, close the public hearing, and adopt the
resolution.

reviewed a PowerPoint presentation (on file in the Office of the City Clerk).

Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2022-249. Motion carried unanimously, 5/0.
DEPARTMENTAL AND CITY MANAGER REPORTS:
11. EXTENDING THE PROCLAMATION OF A LOCAL EMERGENCY REGARDING BICYCLE, E-BICYCLE
AND MOTORIZED MOBILITY DEVICE SAFETY – 1) Receive a report on recent actions relating
to the local emergency declared on Aug. 23, 2022; and

2) Adoption of Resolution No. 2022-250 extending the Proclamation of Bicycle, E-Bicycle and
Motorized Mobility Device Safety Local Emergency in the City of Carlsbad until Dec. 17, 2022,
at 5 p.m., unless otherwise extended or terminated earlier by the City Council. (Staff contact:
Geoff Patnoe, City Manager’s Department)
City Manager’s Recommendation: Receive a report and adopt the resolution.
Assistant City Manager Geoff Patnoe and Chief Innovation Officer David Graham reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).
Matt Moldovan expressed his concerns regarding biking safety to and from the Village for his
family.
In response to Council Member Norby’s inquiry, Transportation Director Tom Frank explained
that all projects already approved by the City Council are still being worked on and that this
project will not delay those in any way.
In response to Council Member Bhat-Patel’s inquiry, Assistant Police Chief Christie
Calderwood explained that the Police Department is discussing with the school districts about
partnering with them to create a certification program for children who wish to ride their
bikes to school.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2022-250. Motion carried unanimously, 5/0.
Council received the report.
12. AGREEMENT WITH PSOMAS, INC. FOR IMPLEMENTATION SERVICES AND AGREEMENT WITH
CARTEGRAPH SYSTEMS, LLC FOR SOFTWARE LICENSING AND MAINTENANCE OF THE
CARTEGRAPH OPERATIONS MANAGEMENT SOFTWARE – 1) Adoption of Resolution No. 2022-
251 authorizing the City Manager to execute a professional services agreement with Psomas,
Inc. for implementation services for Cartegraph’s Operation Management Software for an
enterprise asset management system in an amount not to exceed $584,475; and
2) Adoption of Resolution No. 2022-252 authorizing the City Manager to execute a purchase
agreement with Cartegraph Systems, LLC for services and subscriptions for its operations
management software in an amount not to exceed $582,032.71. (Staff contact: Greg
MacLellan and Doug Kappel, Administrative Services Department)
City Manager’s Recommendation: Adopt the resolutions.

Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution Nos. 2022-251 and 2022-252. Motion carried unanimously, 5/0.
