CALL TO ORDER: 5:02 p.m.
ROLL CALL: Commissioners Kamenjarin, Lafferty, Luna, Meenes, Stine, and Sabellico.
Commissioner Merz arrived at 5:05 p.m.
PLEDGE OF ALLEGIANCE: Commissioner Luna led the Pledge of Allegiance.
APPROVAL OF MINUTES: None.
PUBLIC COMMENT: None.
CONSENT CALENDAR: None.
PUBLIC HEARINGS:
1. CDP 2022-0014 (DEV15043) – OCEAN VIEW POINT – Request for approval and adoption of a
resolution approving a Coastal Development Permit to allow the development of 13 single-
family residences and associated site improvements. The 13 new residential structures include
two, single-story homes, and 11 two-story homes ranging in size from 2,942 square feet to
4,937 square feet on lots ranging in size from 10,356 square feet to 19,660 square feet. The
project is located at the southern terminus of Twain Avenue within the Mello II Segment of
the Local Coastal Program and within Local Facilities Management Zone 8. The project site is
not located within the appealable area of the California Coastal Commission. The potential
environmental effects of the project were adequately analyzed by the previously Mitigated
Negative Declaration approved by the City Council (Resolution 2019-144) required for the
previous entitlements for the project, and no additional environmental review is required.

Chair Stine opened the duly noticed public hearing at 5:32 p.m.
City Planner Eric Lardy introduced Associate Planner Kyle Van Leeuwen who provided the
PowerPoint presentation (on file in the Office of the City Clerk).
As part of the presentation, Associate Planner Van Leeuwen made a recommendation to:
1) Adopt a resolution (Exhibit 1); and
2) Adopt a resolution approving Coastal Development Permit CDP 2022-0014.
Commissioners provided their disclosures as follows:
• Commissioner Luna and Sabellico had no disclosures.

• Commissioners Kamenjarin, Meenes, Merz, and Stine disclosed visiting the site.
• Commissioner Lafferty disclosed she looked up the site on Google Maps and visited
the site.
In response to Commissioner Meenes’ inquiry if the concerns of the property owners located
adjacent to this project were addressed, Associate Planner Van Leeuwen responded it was a
private agreement between the developer and the property owners only single-story homes
would be developed in the two homes closest to neighboring property.
In response to Commissioner Lafferty’s inquiry about the discrepancies where 18 lots were
created but only 13 lots are being developed, how this impacts the inclusionary housing and
what the fee will be for inclusionary housing, Associate Planner Van Leeuwen responded that
18 lots were created but not all were for developing single story homes. He explained
examples such as one lot is designated as a private drive, 16 acres are zoned for open space,
and another lot is designated for drainage. He further explained that the inclusionary housing
is based on the number of units not on the number of lots. He added that the inclusionary
housing fee is purchased from the inclusionary housing units from the city’s credit bank and
fee will be determined at the time the map is recorded.
City Planner Eric Lardy explained this project was reviewed against the existing general plan
and zoning ordinance and do not consider this as a loss of units. He further explained that in
the future, if owners submit a SB9 application for a minuscule project, such as the
construction of a duplex, they will be required to pay additional fees for affordable housing
and it will be counted towards our housing production.
Senior Assistant City Attorney Kemp explained that this project was approved by the City
Council in 2020 and it was before the Planning Commission in 2019. He added that the
inclusionary housing issue was addressed at that time. He further explained that the City
Council adopted Policy 57 and it addressed alternatives to units on the site. He added that
the city has created a bank of affordable housing units that exist. He further explained that if
there are credits available to purchase units as a substitute to meet the requirements of a
previous approval, the Community Development Director has been delegated the authority
to approve it.
Applicant, Cameron St. Clair, Rincon Homes, responded that they intend to build as many
Accessory Dwelling Units on projects as they can, but the housing market is falling and wanted
to keep the Accessory Dwelling Units as an option. He added that if the market is on an
upswing again, they will consider building those units and add to the housing stock.
Hearing no one wishing to speak, Chair Stine closed duly noticed public hearing at 5:34 p.m.
Motion by Commissioner Meenes, seconded by Commissioner Lafferty, to adopt Resolution
No. 7470. Motion carried unanimously, 7/0.
2. SDP 2018-0007/HDP 2018-0004/HMP 2018-0004/MS 2018-0007 (DEV2018-0099) – VALLEY
VIEW - Request for 1) adoption of a Mitigated Negative Declaration and Mitigation Monitoring
and Reporting Program; and 2) approval of a Site Development Plan, Hillside Development

Permit, Habitat Management Plan Permit and Minor Subdivision for the development of a
11,404-square-foot, 31-foot-tall office building on a vacant 6.34-acre lot (APN 209-040-43) on
the east side of Palmer Way, southeast of the intersection of Palmer Way and Cougar Drive.
The site is within Local Facilities Management Zone 5. The potential environmental effects of
the project were analyzed as part of the Mitigated Negative Declaration (MND) and Mitigation
Monitoring and Reporting Program (MMRP) prepared for the project pursuant to CEQA
Guidelines Section 15070. Mitigation measures proposed as part of the MMRP reduce all
environmental effects to a level of less than significant.

City Planner Eric Lardy introduced the item and stated that based on letters received from an
adjacent property owner, the applicant requested a continuance. Mr. Lardy also stated that
there was a letter received on Tuesday, Jan. 17, 2023 that was distributed to the Planning
Commission.
Chair Stine opened the duly noticed public hearing at 5:35 p.m.
Victor Diaz expressed his concern of the environmental impact this project would have and
the asked the city to require contractors that will hire locally and would result in air pollutant
reduction.
Chair Stine closed duly noticed public hearing at 5:38 p.m.
Motion by Commissioner Sabellico, seconded by Commissioner Merz, to continue this item
to a date to be determined by the City Planner. Motion carried unanimously, 7/0.
3. ELECTION OF OFFICERS – The Planning Commission will elect a Chairperson and a Vice
Chairperson for 2023.
STAFF RECOMMENDATION: Appoint a Chair and Vice Chair
CITY PLANNER: Eric Lardy
Motion by Commissioner Meenes, seconded by Commissioner Sabellico, to appoint
Commissioner Merz to serve as Chair for 2023. Motion carried unanimously, 7/0.
Motion by Commissioner Luna, seconded by Commissioner Meenes, to appoint
Commissioner Sabellico to serve as Vice Chair for 2023. Motion carried unanimously, 7/0.
DEPARTMENTAL REPORTS: None.
PLANNING COMMISSION MEMBER REPORTS:
Commissioner Lafferty reported that the Historic Preservation met on Jan. 9, 2023, and there was
no quorum, and the next meeting will be held on March 13, 2023. Commissioner Lafferty added
that Assistant Community Development Director Mike Strong is now staff liaison for the Historic

PLANNING COMMISSION MEMBER REPORTS:
Commissioner Lafferty reported that the Historic Preservation met on Jan. 9, 2023, and there.was
no quorum, and the next meeting will be held on March 13, 2023. Commissioner Lafferty added
that Assistant Community Development Director Mike Strong is now staff liaison for the Historic
Preservation Committee under purview of the Community Development Department with the
Library's assistance.
Commissioner Lafferty reported the Design Review Board Committee's next meeting will be held
in April or May 2023 and that the Objective Design Standards draft will be complete at that time.
Chair Stine gave an update of the Growth Management Committee meeting and added that the
next meeting will be held on Jan. 26, 2023.
CITY PLANNER REPORTS:
City Planner Eric Lardy reported that the Housing Element EIR draft is on schedule to be released
by the middle of this year and completed in 2024.
He announced that North County Transit District has the selection of two developers for the
redevelopment of the Carlsbad Village and the Poinsettia Transit Stations on the Jan. 19, 2023
meeting agenda.
He asked the commissioners if they are interested in attending the League of California Cities
event to let him know within the next week for budget purposes.
CITY ATTORNEY REPORTS:
Senior Assistant City Attorney Ron Kemp congratulated Commissioners Stine, Merz, and Lafferty
for being reappointed to the Planning Commission and added that he looks forward to working
with the new Chair Merz and Vice Chair Sabellico in the coming year.
