Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Pro Tern Blackburn announced that the City Council is serving as the City Council and the Carlsbad Municipal Water District Board of Directors on Public Hearing Item No. 11. INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Bhat-Patel led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Oct. 11, 2022 Minutes of the Special Meeting held Oct. 18, 2022 Minutes of the Special Meeting held Nov. 8, 2022 Minutes of the Regular Meeting held Nov. 8, 2022 Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve the minutes as presented. PRESENTATIONS: Donation from Friends of the Carlsbad Library Library & Cultural Arts Director Suzanne Smithson accepted a special donation of $5,000 from Friends of the Library Board Member Taffy Cannon. Board Member Cannon said a few words. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: No reportable action. PUBLIC COMMENT: Mike Borrello expressed his concerns over the political divide in the country. RENEWAL OF PALO ALTO/WILDFIRE FIREWALL MAINTENANCE AND LICENSING WITH CDW•G LCC -Adoption of Resolution No. 2022-266 authorizing the City Manager to execute documents necessary to procure Palo Alto/Wildfire Firewall Maintenance and Licensing services through Dec. 30, 2023 from CDW•G LCC in an amount not to exceed $139,863. SETTLEMENT OF WORKERS' COMPENSATION CLAIMS OF GLENN MILLER -Adoption of Resolution No. 2022-267 authorizing settlement of the Workers' Compensation claims of Glenn Miller. SETTLEMENT OF WORKERS' COMPENSATION CLAIM OF JEREMY MATLOCK -Adoption of Resolution No. 2022-268 authorizing settlement of the workers' compensation claim of Jeremy Matlock. (Staff contact: Sarah Reiswig and Judy van Kalinowski, Administrative Services Department) 4. REVISIONS TO THE CITY OF CARLSBAD PART-TIME SALARY SCHEDULE. MANAGEMENT SALARY SCHEDULE AND MANAGEMENT COMPENSATION AND BENEFITS PLAN. AND AUTHORIZATION OF PAY INCREASES FOR PART-TIME EMPLOYEES AND MANAGEMENT EMPLOYEES -Adoption of Resolution No. 2022-269 approving revisions to the City of Carlsbad Part-Time Salary Schedule, Management Salary Schedule and Management Compensation and Benefits Plan effective Jan . 1, 2023, and authorizing pay increases for part-time and management employees effective Jan. 1, 2023. {Staff contact: Silvano Rodriguez and Judy van Kalinowski, Administrative Services Department) 5. AGREEMENTS WITH EC AMERICA INC. AND PROCORE TECHNOLOGIES INC. FOR THE IMPLEMENTATION. LICENSING, AND SUBSCRIPTION OF THE PROCORE PROJECT MANAGEMENT PRO SOFTWARE -1) Adoption of Resolution No. 2022-270 authorizing the City Manager to execute a supplemental terms and conditions agreement with EC America, Inc. for implementation, licensing and subscription services for Procore Project Management Pro Software in an amount not to exceed $119,687.95 for the initial term and authorizing the City Manager to execute extensions and amendments over $100,000 annually, if appropriate, for a total estimated agreement amount of $566,080 plus a $10,000 contingency for unexpected implementation costs; and 2) Adoption of Resolution No. 2022-271 authorizing the City Manager to execute a subscription and service agreement with Procore Technologies, Inc. for the use of Procore Project Management Pro Software with no cost associated with the agreement for the initial term and authorizing the City Manager to execute extensions and amendments, if appropriate. APPROPRIATION OF ADDITIONAL FUNDS AND AUTHORIZING THE CITY MANAGER TO APPROVE CHANGE ORDERS TO THE ACE ELECTRIC, INC. CONTRACT FOR THE TEMPORARY FIRE STATION 7 PROJECT, CIP PROJECT NO. 4091 -Adoption of Resolution No. 2022-272 authorizing an additional appropriation of funds, in the amount of $200,000, and authorizing the City Manager to approve change orders to the contract with Ace Electric, Inc. for the Temporary Fire Station 7 Project. APPROPRIATION OF ADDITIONAL FUNDS FOR PURCHASE OF 34 POLICE VEHICLES -Adoption of Resolution No. 2022-273 approving the appropriation of additional funds, in the amount Dec.6,2022 Carlsbad City Council Regular Meeting Page 3 of $313,675, for the purchase of 34 police vehicles. EMPLOYMENT AGREEMENT WITH CITY MANAGER SCOTT CHADWICK -Adoption of Resolution No. 2022-274 approving the amended and restated City Manager Employment Agreement with Scott Chadwick, with a one-time fiscal impact of $14,565 and an annual fiscal impact of $465. (Staff contact: Judy Von Kalinowski, Administrative Services Department) ORDINANCES FOR INTRODUCTION: 9. ESTABLISHMENT OF A COMMUNITY-POLICE ENGAGEMENT COMMISSION AND CLARIFYING AMENDMENTS TO CARLSBAD MUNICIPAL CODE CHAPTER 2.15 -BOARDS AND COMMISSIONS-1) Introduction of Ordinance No. CS-441 amending Chapter 2.15 and adding Chapter 2.30 Community-Police Engagement Commission to Title 2 of the Carlsbad Municipal Code;and 2) Adoption of Resolution No. 2022-275 setting the initial terms of the members of the Community-Police Engagement Commission; and 3) Introduction of Ordinance No. CS-442 amending Sections 2.15.030 and 2.15.070 of the Carlsbad Municipal Code. Assistant City Attorney Allegra Frost and Police Chief Mickey Williams presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Carlsbad Equality Coalition representative Beryl Lewis spoke in support of the Community- Police Engagement Commission. Yusef Miller spoke in support of the Community-Police Engagement Commission. Carlsbad Equality Coalition Member Alison Vredenburgh spoke in support of the Community- Police Engagement Commission. Carlsbad Equality Coalition President Aly Vredenburgh spoke in support of the Community- Police Engagement Commission. Carlsbad Equality Coalition Board Member Augustin Dao spoke in support of the Community- Police Engagement Commission. City Attorney Cindie McMahon titled the ordinances. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to introduce Ordinance No. CS-441 and CS-442, and adopt Resolution No. 2022-275. Motion carried, 4/0/1 (Hall -Absent). CS-440 -REDUCING THE SPEED LIMITS ALONG PORTIONS OF CADENCIA STREET AND GATEWAY ROAD-Adoption of Ordinance No. CS-440 amending Title 10, Chapter 10.44, Sections 10.44.200 and 10.44.830 of the Carlsbad Municipal Code by reducing the speed limit along portions of Cadencia Street and Gateway Road. (Staff contact: Faviola Medina, City Clerk Services Department) City Manager's Recommendation: Adopt Ordinance No. CS-440. PUBLIC HEARING: 11. ADOPTION OF HYDRAULIC MODELING FEES -1) Adoption of a Resolution No. 2022-276 establishing fees for wastewater collection system hydraulic modeling services; and 2) Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1690 establishing fees for water and recycled water system hydraulic modeling services. (Staff contact: Dave Padilla and Shoshana Aguilar, Public Works Department) City Manager's Recommendation: Take public input, close the public hearing, and adopt the resolutions. Utilities Director Vicki Quiram and Senior Management Analyst Shoshana Aguilar presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Pro Tem Blackburn opened the duly noticed public hearing at 5:43 p.m. Hearing no one wishing to speak, Mayor Pro Tem closed the duly noticed public hearing at 5:43 p.m. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-276 and Carlsbad Municipal Water District Board of Directors Resolution No. 1690. Motion carried, 4/0/1 (Hall -Absent). DEPARTMENTAL AND CITY MANAGER REPORTS: 12. UPDATE ON THE CITY'S EFFORTS TO IMPROVE TRAFFIC SAFETY, REVIEWING COMMISSION FEEDBACK AND EXTENDING THE EMERGENCY PROCLAMATION -1) Receive a report on actions taken to date relating to a local emergency proclaimed Aug. 23, 2022; and 2) Receive feedback provided by the Planning and Traffic & Mobility commissions on the Safter Streets Together Plan options; and 3) Adoption of Reso lution No. 2022-277 extending the Proclamation of Bicycle, E-Bicycle and Motorized Mobility Device Safety Local Emergency in the City of Carlsbad until Feb. 3, 2023, at 5 p.m., unless otherwise extended or terminated earlier by the City Council. Assistant City Manager Geoff Patnoe and Transportation Director Tom Frank presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk}. Traffic & Mobility Commissioner Josh Coelho gave an update on the key projects that the Commission has been working on. Christina McGoldrick spoke regarding the increase of minors using e-bikes. Mayor Pro Tern expressed that the City Manager's office idea of the traffic safety emergency proclamation was genius. City Council received the report. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-277. Motion carried, 4/0/1 (Hall -Absent}. 13. UPDATE ON REDUCING HOMELESSNESS IN CARLSBAD AND CONTINUING THE LIMITED-TERM STAY MOTEL VOUCHER PROGRAM -1) Receive an update on the city's goal to reduce its unsheltered homeless population, covering the period from July 1-Sept. 30, 2022; and 2} Adoption of Resolution No. 2022-278 authorizing the continuation of the limited-term stay motel voucher program and appropriating $60,000 from the General Fund to fund the program over the remainder of FY 2022-23. (Staff contact: Mandy Mills and Chris Shilling, Housing & Homeless Services Department) City Manager's Recommendation: Receive the update and adopt the resolution. Housing & Homeless Services Director Mandy Mills, Senior Program Manager Chris Shilling and Police Lieutenant Eric Kovanda presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk}. Council Member Norby left the dais at 6:21 p.m. Council Member Norby returned to the dais at 6:22 p.m. Mike Borrello spoke regarding his concerns with homelessness. Terry Burns spoke regarding his concern with the Carlsbad Village Inn being a voucher hotel and the activities happening during his stay. In response to Council Member Bhat-Patel's inquiry, Housing & Homeless Services Mills gave an overview of the voucher program. Council Member Norby left the dais at 6:45 p.m. In response to Council Member Acosta's inquiry, Lieutenant Kovanda explained that if there is suspected illegal activity, people can email policehot@carlsbadca.gov. Dec.6,2022 Carlsbad City Council Regular Meeting Page 6 Council Member Norby returned to the dais at 6:46 p.m. Mayor Pro Tern Blackburn expressed that more attention and resources should be provided to assist homeless individuals that want the help, and stricter enforcement for those who are using drugs and drinking on the streets and in the parks. Council received the update. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-278. Motion carried, 4/0/1 (Hall -Absent).
