CS-444 and CS-445 – Annual Elected Officials Compensation Review District: All Recommended Action Adopt two ordinances: 1.Adopt Ordinance No. CS-444 adjusting City Council compensation by 3.5% 2.Adopt Ordinance No. CS-445 adjusting City Clerk and City Treasurer compensation by the percentage increase in the 2022 San Diego Regional Consumer Price Index Executive Summary The City Council is being asked to adopt Ordinance Nos. CS-444 and CS-445 to adjust City Council members’ compensation by 3.5% and to make the same determination for the compensation of the City Clerk and Treasurer by the percentage increase in the San Diego Regional Consumer Price Index for 2022, as required each year by the Carlsbad Municipal Code. Explanation & Analysis Ordinance Nos. CS-444 and CS-445 were introduced and first read at the City Council meeting held on January 24, 2023. On a motion by Mayor Blackburn, seconded by Council Member Acosta, the City Council voted 3-1 (Burkholder – No), to introduce Ordinance No. CS-444. On a motion by Mayor Blackburn, seconded by Mayor Pro-Tem Bhat-Patel, the City Council voted 4- 0, to introduce Ordinance No. CS-445. The second reading allows the City Council to adopt the ordinances, which will become effective 30 days after their adoption. Fiscal Analysis The full fiscal impact for the increase in City Council compensation, considering benefits in addition to compensation, is approximately $5,100. The full fiscal impact for the increase in City Clerk and City Treasurer compensation, considering benefits in addition to compensation, is approximately $2,000. There is sufficient funding in the remaining General Fund budget for fiscal year 2022-23 to absorb the proposed increase. Feb. 7, 2023 Item #8 Page 1 of 6 Next Steps The City Clerk Services Manager will have the ordinance, or a summary of the ordinance, published in a newspaper of general circulation within 15 days following adoption of the ordinance. Environmental Evaluation This action does not require environmental review because it does not constitute a project within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. CS-444 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADJUSTING CITY COUNCIL COMPENSATION BY 3.5% WHEREAS, on November 3, 2020, the voters of the City of Carlsbad, California, approved Measure G, adopting Title 2, Chapter 2.04, Section 2.04.0lO(A) of the Carlsbad Municipal Code, which prohibits City Council compensation adjustments from exceeding the amount established by the San Diego Regional Consumer Price Index, requires the City Council to either make or waive a compensation adjustment in January of each year, and prohibits the City Council from enacting retroactive increases for years in which the City Council waived a compensation adjustment; and WHEREAS, the increase in the November San Diego Regional Consumer Price Index for 2022 was 6. 7%; and 3.5%. WHEREAS, the City Council desires to adjust the compensation of City Council members by NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows: 1.The monthly compensation of City Council members is increased from $2,187.61 to $2,264.18. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. CS-445 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADJUSTING CITY CLERK AND CITY TREASURER COMPENSATION BY THE AMOUNT ESTABLISHED BY THE SAN DIEGO REGIONAL CONSUMER PRICE INDEX WHEREAS, on October 18, 2022, the City Council of the City of Carlsbad, California, adopted Ordinance No. CS-435, which prohibits City Clerk and City Treasurer compensation adjustments from exceeding the amount established by the San Diego Regional Consumer Price Index, requires the City Council to determine whether to approve City Clerk and City Treasurer compensation adjustments in January of each year, and prohibits the enactment of retroactive increases for years in which the City Council did not approve compensation adjustments; and WHEREAS, the increase in the November San Diego Regional Consumer Price Index for 2022 was 6. 7%; and WHEREAS, the City Council desires to adjust the compensation of the City Clerk and City Treasurer by the percentage increase in the November San Diego Regional Consumer Price Index for 2022. NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows: 1.The monthly compensation of the City Clerk and City Treasurer is increased from $1,070 to $1,141.69. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
