The project site is located at 3060 State Street within the Village Center (VC) District of the Village and Barrio Master Plan and Local Facilities Management Zone 1. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the elimination of the five (5) in-lieu parking spaces is permissible because no parking is required per California Assembly Bill 2097 since the site is located within one-half mile of a major transit stop (Carlsbad Village transit center). The proposed 88 square foot addition is compatible with the existing building architecture and maintains the overall design, quality and function of the project. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the proposed 88 square foot addition is compatible with the existing building architecture and maintains the overall design, quality and function of the project. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development in that no additional buildings or uses are proposed beyond the scope of what was approved for the Site Development Plan, SDP 2022-0002 and Coastal Development Permit, CDP 2022-0003. Community Development Department Planning Division j 1635 Faraday Avenue Carlsbad, CA 92008-7314 j 442-339-2600 www.carlsbadca.gov CD 2023-0001 (DEV2021-0052) -3060 STATE ST. -RESTAURANT CONVERSION February 15, 2023 Pa e 2 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the 88 square foot addition is a 9.4% addition to Building A (88/933= 9.4%}. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the proposed improvements do not create any inconsistencies or new impacts relative to the environmental review process associated with the original project's approval. 8) The proposed change would not result in any health, safety or welfare impacts in that the proposed addition will comply with all city code requirements. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the addition will complement the existing architectural style of Building A. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. Notice to Applicant: Per California Assembly Bill 2097, the city is prohibited from requiring parking for projects located within one-half mile of a major transit stop. The intent of this legislation is to provide flexibility for project design, concurrent with planning studies that have shown that parking should be market driven. Developers could still voluntarily provide onsite parking, but the number of parking spaces provided will be based on builder preference and market demand, not by city-established minimum parking standards.
