4. FISCAL YEAR 2023-24 FUNDING PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT
PROGRAM AND A SUBSTANTIAL AMENDMENT TO FISCAL YEAR 2022-23 ACTION PLAN -1)
Adoption of Resolution No. 2023-004 approving the Fiscal Year 2023-24 Funding Plan and
authorizing the distribution of the Fiscal Year 2023-24 Notice of Funding Availability for the
Community Development Block Grant Program; and
2) Adoption of Resolution No. 2023-005 approving the Fiscal Year 2022-23 Amended Annual
Action Plan, and authorizing the submittal to the U.S. Department of Housing and Urban
Development to appropriate an additional $253,018 to the Community Development Block

In response to an inquiry from Council Member Acosta, Program Manager Piano-Jones
explained that the majority of the adjustment figures came from the sale of low-income units.
In response to an inquiry from Council Member Acosta, Housing & Homeless Services Director
Mills explained that Catholic Charities currently has a request for proposals open and are
seeking architecture and engineering firms to draw up the La Posada expansion.

THE BEACH PRESERVATION COMMISSION -1) Adoption of Resolution No. 2023-006
accepting the fiscal year 2021-22 Parks & Recreation Commission Work Plan report of
accomplishments and approving the fiscal year 2022-23 Parks & Recreation Commission
Work Plan; and
2) Adoption of Resolution No. 2023-007 accepting the fiscal year 2021-22 Senior Commission

Recreation Services Manager Mick Calarco, Recreation Area Manager Margaret Hamer and
Park Planner Michael Tully reviewed a PowerPoint presentation (on file in the Office of the
City Clerk).
Parks & Recreation Commission Chair Michael Luna, spoke in favor of the Parks & Recreation
Commission Work Plan.
Senior Commission Chair Kathy Rangus spoke in favor of the Senior Commission Work Plan.
Beach Preservation Commission Chair Kathleen Steindlberger spoke in favor of the Beach
Preservation Commission Work Plan.
In response to an inquiry from Council Member Bhat-Patel, Parks & Recreation Director Kyle
Lancaster explained that the focus of the work plan will be on the Parks & Recreation
Department Master Plan Update and further explained that the Veterans Park Project falls
under the same plan.
In response to an inquiry from Council Member Bhat-Patel, Recreation Area Manager Hamer
explained that the intergenerational programs are included in the age friendly action plan
portion of the Senior Commission Work Plan.
In response to an inquiry from Council Member Bhat-Patel, Park Planner Tully explained that
projects that are happening across the county are shared with commission members,
especially those that are associated with the Shoreline Preservation Working Group with San
Diego Association of Governments.
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to adopt
Resolution No. 2023-006, Resolution No. 2023-007 and Resolution No. 2023-008. Motion
carried, 4/0.
6. 2023 LEGISLATIVE PLATFORM AND LEGISLATIVE PROGRAM UPDATE -1) Adoption of
Resolution No. 2023-009 approving the City of Carlsbad 2023 Legislative Platform; and
2) Direct staff to advocate for two city-sponsored state legislative proposals and for federal,
state, and county funding for specified city projects; and
3) Receive reports on state and federal legislative and budget activity and recent and ongoing
advocacy efforts and provide feedback to staff. (Staff contact: Jason Haber, City Manager's
Department)
City Manager's Recommendation: Receive the report, adopt the resolution and provide

Intergovernmental Affairs Director Jason Haber reviewed a PowerPoint presentation (on file
in the Office of the City Clerk).
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to adopt
Resolution No. 2023-009, to include the following language amendments to Section 6: Public
Safety, Law Enforcement letter (e) Support legislation that strengthens penalties for violent
crimes committed by juveniles and (i) Support legislation that strengthens penalties for
participating in any coordinated effort to disrupt the use of public roads and publicly
accessible parking lots (e.g. as part of a street takeover, sideshow, or racing exhibition).
Motion carried, 4/0; and
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to advocate for
two city-sponsored legislative proposals and for federal, state and county funding for
specified city projects. Motion carried 4/0; and
Council received the report.
7. ECONOMIC DEVELOPMENT STRATEGIC PLAN -1) Receive the report; and
2) Adoption of Resolution No. 2023-010 adopting the Economic Development Strategic Plan;
and
3) Direct staff to evaluate, revise and update the draft strategic actions associated with the
plan and make any necessary budgetary recommendations during the annual budget process
beginning with fiscal year 2023-34. (Staff contact: David Graham and Matt Sanford,

City Manager's Recommendation: Receive the report, adopt the resolution and provide
direction to staff, if necessary.

President of Visit Carlsbad Kim Sidoriak spoke in support of the Strategic Plan.
Executive Director of the Carlsbad Village Association Christine Davis spoke in support of the
Strategic Plan.
President of the Carlsbad Chamber of Commerce Bret Schanzenbach spoke in support of the
Strategic Plan.
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to adopt
Resolution No. 2023-010. Motion carried, 4/0.
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to direct staff
to evaluate, revise and update the draft strategic actions associated with the plan and make

8. DECLARING THE EXISTENCE OF A CITY COUNCIL MEMBER DISTRICT 2 VACANCY AND
CONSIDERING OPTIONS TO FILL THE VACANCY -1) Adoption of Resolution No. 2023-011
declaring the existence of a City Council Member District 2 vacancy; and
2) Consider options to fill the vacancy and depending on the option selected by the City
Council, by motion take one of the following actions:
(A)• Adoption of a resolution calling for a special election on Tuesday, Nov. 7, 2023, for the
election of a City Council Member -District 2 for a term ending November 2024 as
required by the provisions of the laws of the State of California relating to charter
cities; and
• Adoption of a resolution requesting consolidation services from the San Diego
Registrar of Voters for the Nov. 7, 2023, specia l election; and
• Adoption of a resolution adopting regulations for candidates for elective office
pertaining to Candidates' Statements submitted to the voters at the special election
to be held in the City of Carlsbad on Tuesday, Nov. 7, 2023; or
(B) Direct staff to prepare a notice of vacancy and use the application and appointment
process most recently used to fill the District 1 vacancy; or
(C) Direct staff to prepare a notice of vacancy and return to the City Council on Jan. 24,
2023, with a proposed application and appointment process for City Council approval

Jan Neff-Sinclair spoke regarding the process of selecting Council Member for District 2.
Hope Nelson requested that Council appoint a City Council Member to District 2.
Christina McGoldrick recommended that Council select option B or C.
Kerry Siekmann requested that Council appoint a City Council Member to District 2.
TJ Childs requested that Council appoint a City Council Member to District 2.

In response to an inquiry from Mayor Blackburn, City Attorney Cindie McMahon explained
that the City of Carlsbad cannot conduct a ballot by mail only election due to the larger size
of the City. She further explained that if someone running from a safe seat is on the ballot,
there cannot be a backup candidate on the ballot in case the incumbent wins and added that
the Carlsbad Municipal Code does not allow an appointed Council Member to run for one
year after their appointment is over.
In response to an inquiry from Council Member Burkholder, City Attorney Cind ie McMahon
explained that the process for drafting an ordinance can take between 30 to 60 days and will
take effect 30 after adoption.
In response to an inquiry from Council Member Acosta, City Clerk's Services Manager Faviola
Medina provided an overview of the previously used District 1 Vacancy interview and
appointment process.
In response to an inquiry from Council Member Acosta, City Clerk's Services Manager Medina
explained that in the most recent appointment process there was consensus for Council
Members to not speak with the applicants in order to ensure that the process was fair.
Motion by Council Member Tern Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-011. Motion carried, 4/0.
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to approve
Option B, directing staff to prepare a notice of vacancy and use the application and
appointment process most recently used to fill the District 1 vacancy with the following
modifications:
• Special meeting on Feb. 15th for oral presentations
• Allow four-minute oral presentations plus one District 2 question
• After soliciting topics and comments from District 2, the top three recommendations
will be considered to begin the voting process
• No contact after applications have been received
• Clarifying questions will be allowed and will use the application as presented by staff

9. REORGANIZATION OF THE CITY COUNCIL, ELECTION OF MAYOR PRO TEMPORE, REGIONAL
COMMITTEE ASSIGNMENTS AND SUBCOMMITTEE ASSIGNMENTS-1) Adoption of Resolution
No. 2023-012 appointing one member of the City Council to serve as Mayor Pro Tempore for
a term ending in December 2023, or until a replacement is appointed; and
2) Adoption of a resolution appointing members of the City Council to the San Diego
Association of Governments Board of Directors; and
3) Adoption of Resolution No. 2023-013 appointing members of the City Council to the North
County Transit District Board of Directors; and
4) Adoption of Resolution No. 2023-014 confirming the mayoral appointment of a member

of the City Council to the San Diego County Water Authority Board of Directors; and
5) Adoption of Resolution No. 2023-015 appointing members of the City Council to the Clean

of the City Council to the various regional committee assignments; and
7) Adoption of Resolution No. 2023-017 confirming the mayoral appointments of members

2023-012 appointing Mayor Pro Tern Bhat -Patel as Mayor Pro Tempore. Motion carried, 4/0.
Mayor Pro Tern Bhat-Patel and Council Member Acosta expressed their support to not make
City appointments to SAN DAG until there is a full City Council.
Motion by Mayor Bl ackburn, seconded by Council Member Burkholder, appointing Mayor
Blackburn as Primary Member to the SAN DAG Board of Directors. Motion failed, 2/2 (Bhat-
Patel, Acosta -No).
