ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Blackburn announced that the City
Council is serving as the Carlsbad Municipal Water District Board of Directors on Consent ,
Calendar Item Nos. 1 and 3.
INVOCATION: None.
PLEDGE OF ALLEGIANCE: Council Member Acosta led the Pledge of Allegiance.

Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to approve the
minutes as presented. Motion carried unanimously, 4/0.
PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None.
PUBLIC COMMENT:
Mike Borrello expressed his concerns regarding the latest San Diego Association of Governments
(SAN DAG) meeting and requested full representation.
Scott Engel congratulated Council Member Burkholder and Mayor Blackburn and expressed his
concern regarding safe streets.
Mary Lucid expressed her concerns regarding the Senior Center.
Tamara Dixon expressed her concern regarding the representation at the latest SANDAG meeting
and transparency.
Mayor Blackburn requested that City Manager Scott Chadwick explain why there was a different
outcome regarding the City Council's SAN DAG representative. City Manager Chadwick explained
that the City Council did not choose a representative to fill the SANDAG positions, and as such,
the previous resolution was reviewed and it stated that the former representatives were eligible

to continue in the role until new representatives are voted on once a District 2 Council Member
is appointed.
CONSENT CALENDAR:
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to approve Consent
Calendar Item Nos. 1 through 9, with changes to the resolution in Item #1. Motion carried
unanimously, 4/0.
1. ADVERTISE FOR BIDS FOR THE PHASE 2 PRESSURE REDUCING STATION REPLACEMENT
PROJECT (CIP PROJECT NO. 5020} -Adoption of Carlsbad Municipal Water District Board of
Directors Resolution No. 1693 authorizing the Secretary of the Board of Directors to advertise
for bids for the Phase 2 Pressure Reducing Station Replacement Project. (Staff contact: Dave
Padilla and Neil Irani, Public Works Department)
Assistant City Attorney Ronald Kemp announced that language in the last paragraph of the
resolution will be modified to read "On File in the Office of the Secretary of the Board."
2. AGREEMENT WITH SAN DIEGO GAS & ELECTRIC TO MOVE ABOVEGROUND UTILITY LINES ON
VALLEY STREET AND MAGNOLIA AVENUE UNDERGROUND (CIP PROJECT NO. 6019) -
Adoption of Resolution No. 2023-032 authorizing the City Manager to execute an agreement
with San Diego Gas & Electric to perform rule 20A aerial-to-underground conversion of
overhead utilities on Valley Street and Magnolia Avenue for an estimated amount of
$2,844,592. (Staff contact: Lauren Ferrell and Hossein Ajideh, Public Works Department)
3. AGREEMENT WITH THE SAN LUIS REY BAND OF MISSION INDIANS FOR THE DOWNTOWN AND
TERRAMAR WATER MAIN REPLACEMENT PROJECT (CIP PROJECT NO. 3904) -Adoption of
Carlsbad Municipal Water District Board of Directors Resolution No. 1694 to authorize a pre-
excavation agreement with the San Luis Rey Band of Mission Indians for tribal monitoring
during construction of the Downtown and Terra mar Water Main Replacement Project. (Staff

4. TRIESTE SLOPE REPAIR PROJECT-Adoption of Resolution No. 2023-033 authorizing creation
of a new Capital Improvement Program project, appropriation of $362,600 from the General
Capital Construction Fund, exemption from the Purchasing Ordinance's competitive bidding
requirements and execution of a professional services agreement with Engineering Systems,
Inc. to provide engineering, environmental and construction support services for the
proposed Trieste Slope Repair Project. (Staff contact: Scott Lyle and Hossein Ajideh, Public
Works Department)
5. FISCAL YEAR 2021 STATE HOMELAND SECURITY PROGRAM GRANT -Adoption of Resolution
No. 2023-034 accepting grant funds for fiscal year 2021 State Homeland Security Program,
authorizing the City Manager to execute standard assurances, and appropriating $83,321 to
the Public Safety Special Revenue Fund. (Staff contact: Kim Young, Fire Department)

6. APPLICATION FOR GRANT FUNDS FROM FY 2022-23 CALIFORNIA STATE BUDGET -$5 MILLION
FOR VETERANS MEMORIAL PARK -Adoption of Resolution No. 2023-035 approving
application for specified grant funds from Budget Act 2022/23 -California State Budget
Section 19.56(B)(l)(BA) $5,000,000 to the City of Carlsbad for Carlsbad Veterans Memorial
Park Improvements. (Staff contact: Jason Haber, City Manager's Department)
7. SUMMARY VACATION OF A PUBLIC UTILITIES EASEMENT AT 3342 DONNA DRIVE (PD 2021-
0019, VAC 2022-0005)-Adoption of Resolution No. 2023-036 approving a summary vacation
of a public utilities easement over a portion of Lot 3 of Map No. 4393. (Staff contact: Nichole
Fine, Community Development Department)
8. REVISIONS TO THE SUPERVISORY CONTROL AND DATA ACQUISITION TECHNICIAN
CLASSIFICATION. UTILITY LOCATOR CLASSIFICATION. AND CARLSBAD CITY EMPLOYEES'
ASSOCIATION SALARY SCHEDULE -Adoption of Resolution No. 2023-037 approving revisions
to the Supervisory Control and Data Acquisition Technician classification, approval of the
Utility Locator classification, and revision of Carlsbad City Employees' Association salary

9. REPORT ON CITY INVESTMENTS AS OF NOV. 30, 2022 -Accept and file Report on City

ORDINANCES FOR INTRODUCTION:
10. UPDATE TO CARLSBAD MUNICIPAL CODE CHAPTER 1.15.040 -CAMPAIGN CONTRIBUTION
LIMITS -Introduction of Ordinance No. CS-443 amending Carlsbad Municipal Code Section
1.15.040 -Campaign Contribution Limits, to adjust contribution limits to reflect an increase
in the California Consumer Price Index for All Urban Consumers for the San Diego region.

City Manager's Recommendation: Introduce the ordinance.

Sheila Cobian presented the report and reviewed a PowerPoint presentation (on file in the
Office of the City Clerk).
City Attorney Cindie McMahon titled the ordinances.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to introduce
Ordinance No. CS-443. Motion carried unanimously, 4/0.
11. ANNUAL ELECTED OFFICIALS COMPENSATION REVIEW -Conduct annual review of elected
officials compensation and introduce ordinances that: 1) Introduction of Ordinance No. CS-

444 adjusting City Council compensation by the amount established by the San Diego
Regional Consumer Price Index; or
2) Introduction of an ordinance permanently waiving City Council compensation adjustments
for 2023; and
3) Introduction of Ordinance No. CS-445 adjusting City Clerk and City Treasurer compensation
by the amount established by the San Diego Regional Consumer Price Index; or
4) Introduction of an ordinance declining City Clerk and City Treasurer compensation
adjustments for 2023. (Staff contact: Silvano Rodriguez and Judy von Kalinowski,

City Manager's Recommendation: Conduct review and introduce the ordinances.
City Manager Scott Chadwick presented the report.
Council Member Burkholder voiced her support for increasing the compensation of the City
Clerk and City Treasurer but will be voting against an increase for City Council.
Council Member Acosta voiced her support for increasing compensation for City Council.
In response to Mayor Pro Tern Bhat-Patel's inquiry, City Manager Chadwick explained that
waiving a compensation increase would be for 2023 only and in the future the City Council
could not go back to retroactively increase.
In response to Mayor Blackburn's inquiry, Human Resources Director Judy von Kalinowski
explained that management: s increase was 3.5% and an average from other associations
would be around 4.5%. Mayor Blackburn exp lained that he supports a compensation increase
for City Clerk and City Treasurer and a 3.5% compensation increase for City Council Members.
Mayor Pro Tern Bhat-Patel explained that a compensation increase will open up better
opportunities for future Council Members, and supports a compensation increase for the City
Clerk and City Treasurer.
City Attorney McMahon titled the ordinances.
Motion by Mayor Blackburn, seconded by Council Member Acosta, to introduce Ordinance
No. CS-444, increasing City Council Compensation by 3.5%. Motion carried, 3/1 (Burkholder
-No).
Motion by Mayor Blackburn, seconded by Mayor Pro Tern Bhat-Patel, to introduce Ordinance
No. CS-445, increasing City Clerk and City Treasurer compensation by the amount established
by the San Diego Regional Consumer Price Index. Motion carried unanimously, 4/0.

DEPARTMENTAL AND CITY MANAGER REPORTS:
12. SEMIANNUAL TRANSPORTATION REPORT -Receive the Semiannual Transportation Report.
(Staff contact: Tom Frank, Public Works)
City Manager's Recommendation: Receive the report.
Transportation Director Tom Frank presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Traffic & Mobility Commissioner Bill Fowler reviewed the Commission's work goals, and
explained that the Commission will continue to provide a high level of community access and
will continue to work closely with city staff.
In response to Mayor Blackburn's inquiry, Transportation Director Frank explained how the
signal timing coordination works during the peak hours of 7 a.m. to 9 p.m. and 3 p.m. to 5
p.m. Transportation Director Frank also explained that the timing coordination is less efficient
during non-peak hours.
City Council received the report.
13. UPDATE ON THE CITY'S EFFORTS TO IMPROVE TRAFFIC SAFETY. RATIFY CONTRACT FOR BIKE
LANE IMPROVEMENTS AND CONSIDER EXTENDING THE EMERGENCY PROCLAMATION -1)
Receive a report on actions taken to date relating to a local traffic emergency proclaimed
Aug. 23, 2022, including the city's use of data to measure results and the launch of a new
public education program; and
2) Receive a report on options available to fund additional traffic safety efforts recommended
by the Traffic & Mobility and Planning commissions; and
3) Adoption of Resolution No. 2023-038 ratifying approval of the plans and specifications,
acceptance of the bid and awarding a contract to Superior Pavement Markings, Inc. for the
Green Bike Lane Enhancement Project in the amount of $372,343; and
4) Adoption Resolution No. 2023-039 extending the Proclamation of Bicycle, E-Bicycle and
Motorized Mobility Device Safety Local Emergency in the City of Carlsbad until March 25,
2023, at 5 p.m., unless otherwise extended or terminated earlier by the City Council. (Staff

City Manager's Recommendation: Receive the reports and adopt the resolutions.
Assistant City Manager Geoff Patnoe, Chief Innovation Officer David Graham, Communication
& Engagement Director Kristina Ray and Finance Director Zach Korach presented the report
and reviewed a PowerPoint presentation (on file in the Office of the City Clerk}.
Kirsten Ludwig expressed her opposition to the 10 foot road lane widths on Cannon Road.

14. REQUEST FOR ADDITIONAL CITY FUNDING FOR THE NEW VILLAGE ARTS TENANT
IMPROVEMENT PROJECT -Consider New Village Arts request for $228,411 in additional city
funding for the New Village Arts Tenant Improvement Project, discuss options and provide
direction to staff. (Staff contact: Curtis Jackson, Community Services Department)
City Manager's Recommendation: Consider the request and provide direction to staff.
Real Estate Manager Curtis and Deputy City Manager of Community Services Gary Barberio
presented the report and reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).
Mary Lucid expressed her concern regarding the grants and money that are being used for
New Village Arts and not the Senior Center.
Council Member Burkholder voiced her concern regarding repayment of the funding and
would like to see some type of repayment plan by New Village Arts and expressed her support
of Option 1.
In response to Council Member Acosta's inquiry, Deputy City Manager Barberio explained
that the funding would come from the Council Contingency Fund or the General Fund
Reserve. City Manager Chadwick explained that it would be a new burden on the General
Fund as this request came in after the budget process had begun.
Council Member Acosta explained that she would prefer to see some type of repayment plan
by New Village Arts in the form of a no interest loan.
Council Member Bhat-Patel expressed her support of Option 1.
City Council received the report.
Motion by Mayor Blackburn, seconded by Mayor Pro Tern Bhat-Patel, directing staff to return
to the City Council at a later date, with options for a loan agreement and a resolution
allocating up to $228,411 to New Village Arts. Motion carried unanimously, 4/0.

Steven Pierce spoke regarding the shortage of pickleba/1 courts.
COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported
on activities and meetings of some committees and subcommittees of which they are members.
