Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta to approve the
minutes as presented. The motion passed unanimously, 4/0.
PRESENTATIONS:
Proclamation in Recognition of Black History Month
Mayor Pro Tern Bhat-Patel read the proclamation. Real Estate Manager Curtis Jackson accepted
the proclamation and said a few words.
Proclamation in Recognition of The Great Kindness Challenge
Mayor Blackburn read the proclamation. Carlsbad Unified School District Superintendent Ben
Churchill and Co -founder and Executive Director of Kids for Peace Jill McManigal accepted the
proclamation and said a few words. Students from Carlsbad schools received certificates for
participating in the Kindness Challenge.
PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION : City Attorney Cindie McMahon
announced there was no reportable action.
PUBLIC COMMENT:
Army Navy Academy President Peggy Combs introduced herself to the City Council.
Kathy Parker expressed her support for electrification in the city.
Socorro Anderson expressed her concerns with safety in the Barrio neighborhood.
Pierre Cochet-Weinardt discussed differences between SANDAG voting systems.
Jennifer Jacobs urged the City Council to request state funding in response to the ban on flavored
tobacco for minors.

1. FISCAL YEAR 2021-22 HOUSING TRUST FUND ANNUAL REPORT-Adoption of Resolution No.
2023-040 approving the fisca l year 2021-22 Housing Trust Fund Annual Report. (Staff contact:

2. ACQUISITION AND RESALE OF 577 LAGUNA DRIVE, AS PART OF THE AFFORDABLE HOUSING
RESALE PROGRAM -Adoption of Resolution No. 2023-041 approving the purchase and resale
of 577 Laguna Drive as part of the Affordable Housing Resale Program, authorizing the Deputy
City Manager, Administrative Services, to appropriate up to $225,000 from the Community
Development Block Grant Special Revenue Fund for related costs, and authorizing the City
Manager to execute all required documents to complete the transaction. (Staff contact: Allen

3. REVISE CITY COUNCIL POLICY NO. 2 -TRAVEL POLICY-Adoption of Resolution No. 2023-042

4. ANNUAL INVESTMENT POLICY UPDATE -Adoption of Resolution No. 2023-043 approving the

5. AWARD OF CONTRACT TO DICK MILLER, INC. AND WAIVING MINOR IRREGULARITIES IN DICK
MILLER, INC.'S BID FOR THE 2021 SIDEWALK CONSTRUCTION PROJECT, CIP PROJECT NO.
6002-21 -Adoption of Resolution No. 2023-044 accepting bids, awarding a contract to Dick
Miller, Inc. and waiving minor irregularities in Dick Miller, lnc.'s bid for the 2021 Sidewalk
Construction Project, in an amount not to exceed $448,879. (Staff contact: Kevin Moghadasi

Section 2.18 -Carlsbad Arts Commission to be consistent with Chapter 1.20 -Meetings and

ORDINANCES FOR ADOPTION:
7. ORDINANCE NO. CS-443 -UPDATE TO CARLSBAD MUNICIPAL CODE CHAPTER 1.15.040 -
CAMPAIGN CONTRIBUTION LIMITS -Adoption of Ordinance No. CS-443 amending Carlsbad
Municipal Code Section 1.15.040 -Campaign Contribution Limits, to adjust contribution
limits to reflect an increase in the California Consumer Price Index for All Urban Consumers
for the San Diego region. (Staff contact: Faviola Medina, City Clerk's Department)

8. ORDINANCE NOS. CS-444 AND CS-445 -ANNUAL ELECTED OFFICIALS COMPENSATION
REVIEW -1) Adoption of Ordinance No. CS-444, adjusting City Council compensation by 3.5%;
and
2) Adoption of Ordinance No. CS-445 adjusting City Clerk and City Treasurer Compensation
by the amount established by the San Diego Regional Consumer Price Index. (Staff contact:

9. HOUSING COMMISSION 2022 WORK PLAN ANNUAL REPORT AND JANUARY 2023-JUNE 2024
HOUSING COMMISSION WORK PLAN -Adoption of Resolution 2023-045 accepting the
Housing Commission 2022 Work Plan Annual Report and approving the January 2023 -June
2024 Housing Commission Work Plan. (Staff contact: Todd Henderson, Housing & Homeless
Services Department)
City Manager's Recommendation: Adopt the resolution.

Housing & Homeless Services Director Mandy Mills, Senior Program Manager Christian
Gutierrez and Housing Commissioner John Nguyen-Cleary presented the report and
reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to an inquiry from Mayor Pro Tern Bhat-Patel, Housing & Homeless Services
Director Mills explained that if the City Council approves the plan as presented, the name
would change from the Work Plan to the Action Plan .
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-045. Motion carried unanimously, 4/0.
10. CARLSBAD HOMELESSNESS ACTION PLAN -Adoption of Resolution 2023-046 approving the
Carlsbad Homelessness Action Plan. (Staff contact: Mandy Mills and Chris Shilling, Housing &
Homeless Services Department)
City Manager's Recommendation: Adopt the resolution.
Housing & Homeless Services Director Mills, Senior Program Manager Chris Shilling and
Police Lieutenant Eric Kovanda presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Community Resource Center representative Rebecca Nussbaum expressed her support for the
Carlsbad Homelessness Action Plan.
Socorro Anderson expressed her support for the Carlsbad Homelessness Action Plan.
Tamara Keh/ere expressed her support for the Carlsbad Homelessness Action Plan.
Teri Jacobs expressed her support and recommendations with the Carlsbad Homelessness
Action Plan.
Interfaith Community Services representative Greg Angela expressed his support for the
Carlsbad Homelessness Action Plan.
John Nguyen-Cleary expressed his support for the Carlsbad Homelessness Action Plan
In response to an inquiry from Mayor Pro Tern Bhat-Patel, Housing & Homeless Services
Director Mills explained that supplemental funds not included in the base budget require
additional authorization from the City Council.

Director Mills explained that the metrics shown in the report were included for additional
explanation and further explained what metrics would be used to measure the Action Plan.

In response to an inquiry from Mayor Pro Tern Bhat-Patel, City Manager Scott Chadwick
explained that many of items included in the plan are coming as recommendations from the
Regionals Task Force on Homelessness as industry best practices.
In response to an inquiry from Mayor Pro Tern Bhat-Patel, Housing & Homeless Services
Director Mills explained that the city's Homeless Outreach Team, along with social workers
and city staff, work to provide solutions on a case-by-case basis.
In response to an inquiry from Mayor Pro Tern Bhat-Patel, Housing & Homeless Services
Director Mills explained that there are also programs in place that works towards preventing
sheltered individuals from becoming homeless such as the Rapid Rehousing Program,
housing navigation and emergency rental assistance. Senior Program Manager Shilling added
that in addition to the monthly case conferencing with local service providers, they also focus
on regional trainings where they are currently focusing on diversion so they can effectively
get individuals moving in the right direction.
In response to an inquiry from Council Member Acosta, Housing & Homeless Services
Director Mills explained that city staff monitors and applies for any state or county funding
that the city is eligible for.
In response to an inquiry from Council Member Acosta, Police Lieutenant Kovanda explained
that additional information regarding the Care Court Program will be coming out of the
district attorney's office.
In response to an inquiry from Council Member Acosta, Housing & Homeless Services
Director Mills explained that biannual reports, rather than quarterly reports, seems to be a
more accurate timeline to display meaningful data, results and changes occurring from their
Action Plan. She added that the next anticipated update to the City Council will be in the April
2023 timeframe.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-046. Motion carried unanimously, 4/0.
11. GRANT FROM SAN DIEGO COUNTY FOR LA POSADA DE GUADALUPE HOMELESS SHELTER
EXPANSION 1) Adoption of Resolution No. 2023-047 authorizing the City Manager to execute
a grant agreement and related documents on behalf of the city to receive $2,000,000 from
the County of San Diego's Capital Emergency Housing Solutions Grant Program; and
2) Adoption of Resolution No. 2023-048 authorizing the City Manager to execute a grant
agreement with Catholic Charities Diocese of San Diego for $2,000,000 from the Capital
Emergency Housing Solutions Grant Program for the expansion of La Posada de Guadalupe

Council Member Burkholder disclosed that she went to La Posada Catholic Charities for a tour
of the facility.

12. CLEAN ENERGY ALLIANCE UPDATE -Receive an informational report from Clean Energy
Alliance Executive Director Barbara Boswell on the Clean Energy Alliance's operations and
performance. (Staff contact: Jason Haber, City Manager's Department)
City Manager's Recommendation: Receive the report.
Intergovernmental Affairs Director Jason Haber and Clean Energy Alliance Executive Director
Barbara Boswell presented the report and reviewed a PowerPoint presentation (on file in the
Office of the City Clerk).
Council received the report.
13. INTERNAL AUDIT PROGRAM UPDATE -Receive a report on the status of recommendations
from previously completed internal audits and an update regarding internal audit
engagements identified in the city's fiscal year 2022-23 Internal Audit Plan. (Staff contact:
Robert Threatt and Laura Rocha, Administrative Services Department)
City Manager's Recommendation: Receive the report.
Internal Audit Manager Robert Threatt presented the report and reviewed a PowerPoint

14. REESTABLISHING THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT UNDER THE
PROPERTY AND BUSINESS IMPROVEMENT DISTRICT LAW OF 1994 -Adoption of Resolution

No. 2023-049 declaring its intention to establish the Carlsbad Tourism Business Improvement
District and fixing the time and place of a public meeting and a public hearing thereon and
giving notice thereof. (Staff contact: David Graham and Matt Sanford, Administrative Services

City Manager's Recommendation: Adopt the resolution.
Chief Innovation Office David Graham, Economic Development Manager Matt Sanford and
Civitas Senior Project Manager Gina Reed presented the report and reviewed a PowerPoint

Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-049. Motion carried unanimously, 4/0.

15. ADVERTISE FOR BIDS FOR THE 2022 EAST-WEST CORRIDORS EMERGENCY RESURFACING AND
RESTRIPING PROJECT, AND APPROVAL OFA ROADWAY RECONFIGURATION AND ASSOCIATED
LEVEL OF SERVICE FOR WESTBOUND CARLSBAD VILLAGE DRIVE FROM COLLEGE BOULEVARD
TO EL CAMINO REAL, CIP PROJECT NO. 6001 -Adoption of Resolution No. 2023-050 approving
t he plans, specifications and contract documents and authorizing the City Clerk to advertise
for bids for the 2022 East-West Corridors Emergency Resurfacing and Restriping Project, and
approving a roadway reconfiguration resulting in a level of service D for one segment,
westbound Carlsbad Village Drive from Co llege Boulevard to El Camino Real. (Staff contact:
Eric Zielke and Hossein Ajideh, Public Works Department)
City Manager's Recommendation: Adopt the resolution.
Transportation Director Tom Frank presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
In response to an inquiry from Council Member Acosta, Transportation Director Frank
explained that the lanes on La Costa Avenue will be reduced from 11-feet wide to 10-feet
wide to allow for an 8-feet wide bike lane.
In response to an inquiry from Mayor Blackburn, Transportation Director Frank explained that
lane reconfiguration in this report means a lane reduction with a dual center turn lane. He

added that this allows for safety improvements such as reducing head on collisions, provides
better site distance for the side streets and provides a refuge for drivers turning left out of
the side streets to access the dual left hand turn lane.
In response to an inquiry from Mayor Blackburn, Transportation Director Frank explained that
if the lane configuration is not productive in traffic issues, it can be reconfigured in the future.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-050. Motion carried unanimously, 4/0.
COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported
on activities and meetings of some committees and subcommittees of which they are members.
ANNOUNCEMENTS: This section of the Agenda is designated for announcements to advise the
community regarding events that Members of the City Council have been invited to, and may
participate in.
