Executive Summary
In response to a request by Commissioner George at the Dec. 1, 2022, meeting of the Arts
Commission, City of Carlsbad’s Intergovernmental Affairs Director Jason Haber will present an
overview of Proposition 28 which was approved by California voters on Nov. 8, 2022.
Proposition 28 provides additional funding for arts and music education in all K-12 public
schools (including charter schools) by annually allocating from the state General Fund an
amount equaling 1% of required state and local funding for public schools. There is a provision
that allocates greater proportion of the funds to schools serving more economically
disadvantaged students. Schools with 500 or more students must spend at least 80% of
funding to employ teachers, with the remainder spent on training, supplies, and educational
partnerships. The measure was designed to replenish resources for K-12 courses such as
dance, theatre and graphic design. Proposition 28 does not raise taxes.

On November 8, 2022, California voters passed Proposition 28, which provides additional funding
from the state’s 2023 general fund ($297 billion proposed) for arts and music education in all K–
12 public schools (including charter schools). Fiscal Impact: Increased state costs of about $1
billion annually, beginning in 2023, for arts education in public schools. The proposition passed
by a vote of 64.4% to 35.6%.
Analysis by the Secretary of State Legislative Analyst:
Beginning in 2023, Proposition 28 requires the state to provide additional funding to increase
arts programs in public schools. This may include a variety of subjects, including dance, media
arts, music, theater, and various types of visual arts (including photography, craft arts, computer
coding, and graphic design). The proposition also requires at least 80 percent of the additional
funding be used to hire staff. (School districts and charter schools with fewer than 500 students
would not have to meet this requirement.) The remaining funding could be used for training,
supplies and materials, and for arts educational partnership programs.
Proposition 28 requires the principal or program director of a school site to develop a plan for
spending the funding they receive, and to determine how to expand a site’s arts programs.
Proposition 28 requires local governing boards to certify each year that the funding their schools
received was spent on arts education, and to post on their website a report on how the funds
were spent. The report must include the type of arts education programs funded, the number of
staff employed, the number of students served, and the number of school sites providing arts
education with the funding received. This report must also be submitted to California
Department of Education and be made public on the department’s website.
