ANNOUNCEMENT OF CONCURRENT MEETINGS: None. INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Acosta led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in Recognition of National Engineers Week. Council Member Acosta read the proclamation. Transportation Director Tom Frank accepted the proclamation and said a few words. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. PUBLIC COMMENT: Jan Neff Sinclair thanked the City for their service. T.J. Childs spoke regarding additional dwelling units and street lighting in her neighborhood. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 4. Motion carried, 4/0. 1. REPORT ON CITY INVESTMENTS AS OF DEC. 31, 2022 – Accept and file Report on City Investments as of Dec. 31, 2022. (Staff contact: Craig Lindholm and Laura Rocha, Administrative Services Department) 2. SETTLEMENT OF WORKERS' COMPENSATION CLAIM OF RICHARD BERONDA – Adoption of Resolution No. 2023-051 authorizing settlement of the Workers’ Compensation claim of Richard Beronda for $90,262. (Staff contact: Sarah Reiswig and Judy von Kalinowski, Administrative Services Department) 3. AMENDMENT NO. 3 TO AN AGREEMENT WITH GRIFFIN STRUCTURES, INC. AND APPROPRIATION OF ADDITIONAL FUNDS FOR THE POLICE AND FIRE HEADQUARTERS IMPROVEMENTS PROJECT (CIP PROJECT NO. 4715) – Adoption of Resolution No. 2023-052 Feb. 14, 2023, 5 p.m. CITY COUNCIL Minutes Feb. 14, 2023 Carlsbad City Council Regular Meeting Page 2 authorizing an amendment to an agreement with Griffin Structures, Inc., in an amount not to exceed $541,000, and appropriation of additional project funds, in an amount not to exceed $529,292 for the Police and Fire Headquarters Improvements Project. AGREEMENT WITH SUBRECIPIENTS OF THE U.S. TITLE XVI GRANT AWARD FOR THE NORTH SAN DIEGO WATER REUSE COALITION REGIONAL RECYCLED WATER PROGRAM – Adoption of Carlsbad Municipal Water District Board of Directors No. 1695 approving a subrecipient agreement for a U.S. Title XVI Water Reclamation and Reuse Fiscal Year 2021 grant award for the North San Diego Water Reuse Coalition Regional Recycled Water Program. (Staff contact: Shoshana Aguilar, Public Works Department) ORDINANCES FOR INTRODUCTION: None ORDINANCES FOR ADOPTION: 5. ORDINANCE NO. CS-446 - AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 2.18, CARLSBAD ARTS COMMISSION - Adoption of Ordinance No. CS-446 amending Carlsbad Municipal Code Section 2.18 – Carlsbad Arts Commission to be consistent with Chapter 1.20 – Meetings and Chapter 2.15 – Boards and Commissions. (Staff contact: Faviola Medina, City Clerk’s Department) City Manager’s Recommendation: Adopt Ordinance No. CS-446. City Attorney McMahon titled Ordinance No. CS-446. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Ordinance No. CS-446. Motion carried, 4/0. PUBLIC HEARING: 6. ESTABLISHING HISTORIC PRESERVATION PERMIT APPLICATION FEES – Adoption of Resolution No. 2023-053 adopting new fees for the recovery of city costs related to the processing of applications for inclusion into the Carlsbad Historic Resource Registry and participation in the city’s Mills Act Program. (Staff contact: Mike Strong, Community Services Department) City Manager’s Recommendation: Take public input, close the public hearing, and adopt the resolution. Assistant Community Development Director Mike Strong reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Blackburn opened the duly noticed public hearing at 5:16 p.m. Feb. 14, 2023 Carlsbad City Council Regular Meeting Page 3 Hearing no one wishing to speak, Mayor Blackburn closed the duly noticed public hearing at 5:16 p.m. City Council discussion ensued. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-053. Motion carried, 4/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 7. ECONOMIC AND FINANCIAL UPDATE FOR THE SECOND QUARTER OF FISCAL YEAR 2022-23 – 1) Receive a report on the economic and financial update for the second quarter of fiscal year 2022-23 and provide direction as appropriate; and 2) Receive a report on the results of fiscal year 2022-23 mid-year budget review; and 3) Adoption of Resolution No. 2023-054 approving the appropriation of $330,000 for early replacement of one ambulance for the Fire Department. (Staff contact: Zach Korach and Matt Sanford, Administrative Services Department) City Manager’s Recommendation: Receive the reports, provide direction as appropriate and adopt the resolution. Finance Director Zach Korach & Economic Development Manager Matt Sanford reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The City Council received the reports. In response to an inquiry from Council Member Acosta, Finance Director Korach explained that a policy or administrative order is being drafted to establish reserves and their use, including the repayment of the Municipal Golf Course loans and any excess reserve will be set aside for capital needs at the Golf Course. In response to an inquiry from Mayor Blackburn, Finance Director Korach explained the following: sales tax assessed by the state are 7.75% and Carlsbad receives 1% of that; Transient Occupancy Tax (TOT) is 10% and Carlsbad received the entire 10%; property taxes are 1% and Carlsbad receives 13% of that. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-054. Motion carried, 4/0. 8. AMENDMENT NO. 3 TO AN AGREEMENT WITH LPA, INC. FOR THE MONROE STREET POOL RENOVATION/REPLACEMENT PROJECT (CIP PROJECT NO. 4724, CONCEPT 3) – Adoption of Resolution No. 2023-055 authorizing the execution of Amendment No. 3 to the agreement with LPA, Inc. to develop design and construction plans and specifications for the Monroe Street Pool Renovation/Replacement Project. (Staff contact: Steven Stewart, Public Works and Kyle Lancaster Community Services Department) Feb. 14, 2023 Carlsbad City Council Regular Meeting Page 4 City Manager’s Recommendation: Adopt the resolution. Parks & Recreation Director Kyle Lancaster & Public Works Manager John Maashoff reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Owner/Operator of Carlsbad Water Polo James Hamilton spoke in support of the renovation/replacement project. City Council discussion ensued. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-055. Motion carried, 4/0. 9. VILLAGE & BARRIO MASTER PLAN AND CORRESPONDING AUTHORITY FOR APPROVAL OF THE PLAN – Consider a request from Council Member Burkholder to engage in a discussion regarding the Village & Barrio Master Plan and the corresponding authority for approval of the plan. (Staff contact: Sheila Cobian, City Manager’s Department) City Manager’s Recommendation: Consider the request. City Manager Scott Chadwick introduced Council Member Burkholder who presented the report. Council Member Burkholder explained that the discussion would be regarding the Village & Barrio Master Plan and the corresponding authority for approval of the plan. Jan Neff Sinclair spoke against the recommended request. TJ Childs spoke against the recommended request. Council Member Acosta expressed concern with any change to the plan since it has been in place for approximately two years. Mayor Pro Tem Bhat-Patel explained that the current plan in place has not received enough feedback to be revised. Mayor Blackburn expressed that staff should come back and provide information regarding the current Village & Barrio Master Plan. Council Member Burkholder withdrew the request. 10. MAYORAL APPOINTMENT OF ONE MEMBER TO THE SENIOR COMMISSION – Adoption of Resolution No. 2023-056 appointing one member to the Senior Commission. (Staff contact: Tammy McMinn, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution.
