ANNOUNCEMENT OF CONCURRENT MEETINGS: City Council is serving as the City Council, the Carlsbad Municipal Water District Board of Directors and the Community Development Commission on Departmental and City Manager Reports Item No. 8. INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Luna led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Feb. 14, 2023 Minutes of the Special Meeting held Feb. 15, 2023 Minutes of the Special Meeting held Feb. 27, 2023 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to approve the minutes as presented. Motion carried, 4/0/1 (Luna – Abstain). PRESENTATIONS: Proclamation in recognition of the Carlsbad Chamber of Commerce 100th Year Anniversary Mayor Blackburn read the proclamation. Carlsbad Chamber of Commerce President and CEO Bret Schanzenbach accepted the proclamation and said a few words. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. PUBLIC COMMENT: Sierra Huff spoke regarding her concerns with Critical Race theory in Carlsbad schools. Kyle Gattil spoke regarding his concerns with Critical Race theory in Carlsbad schools. Jake Douglas spoke regarding his concerns with Critical Race theory in Carlsbad schools. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 5. Motion carried, 5/0. 1. AGREEMENT WITH SAN DIEGO GAS & ELECTRIC TO PROVIDE, INSTALL AND MAINTAIN ELECTRIC VEHICLE CHARGING STATION INFRASTRUCTURE AT A CITY PARKING LOT (CIP PROJECT NO. 4090) – Adoption of Resolution No. 2023-075 authorizing execution of an March 14, 2023, 5 p.m. CITY COUNCIL Minutes March 14, 2023 Carlsbad City Council Regular Meeting Page 2 application and agreement with San Diego Gas & Electric to provide, install and maintain electric vehicle charging station infrastructure as part of the State Street Parking Lot Electric Vehicle Charging Stations Project, Capital Improvement Program Project No. 4090. (Staff contact: Molly Amendt, Public Works Department) 2. AWARD OF AGREEMENT TO WEATHERPROOFING TECHNOLOGIES INC. FOR CITYWIDE ROOF INSPECTION, MAINTENANCE AND ON-CALL LEAK RESPONSE SERVICES – Adoption of Resolution No. 2023-076 accepting bids and awarding a services agreement to Weatherproofing Technologies, Inc. for citywide roof inspection, maintenance and on-call leak response services in an amount not to exceed $183,970 per agreement year. ADVERTISE FOR BIDS FOR SEGMENT 2 OF THE AVENIDA ENCINAS COASTAL RAIL TRAIL AND PEDESTRIAN IMPROVEMENTS PROJECT, AND APPROVAL OF A ROADWAY RECONFIGURATION FOR AVENIDA ENCINAS FROM POINSETTIA LANE TO WINDROSE CIRCLE – Adoption of Resolution No. 2023-077 approving the plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for Segment 2 of the Avenida Encinas Coastal Rail Trail and Pedestrian Improvements Project and approving a roadway reconfiguration resulting in level of service ‘D’ for one segment of Avenida Encinas from Poinsettia Lane to Windrose Circle in both southbound and northbound directions. AGREEMENT WITH DUGMORE DESIGN STUDIO LANDSCAPE ARCHITECTURE FOR LANDSCAPE PLAN CHECK AND INSPECTION SERVICES – Adoption of Resolution No. 2023-078 approving a professional services agreement with Dugmore Design Studio Landscape Architecture to provide landscape plan check and inspection services in an amount not to exceed $250,000 per year. APPLYING THE CITY’S EQUAL EMPLOYMENT OPPORTUNITY AND WORKPLACE CIVILITY POLICY TO ELECTED AND APPOINTED OFFICIALS – Adoption of Resolution No. 2023-079 applying Administrative Order 45 – Equal Employment Opportunity and Workplace Civility Policy to all elected city officials and all members of the city’s advisory boards, commissions and committees. March 14, 2023 Carlsbad City Council Regular Meeting Page 3 DEPARTMENTAL AND CITY MANAGER REPORTS: 6. CHANGE TO FLEET POLICE VEHICLE ORDER – Adoption of Resolution No. 2023-080 authorizing the City Manager or designee to modify the current order of 40 police interceptor utility vehicles for the Police Department from hybrid engine vehicles to non-hybrid conventional engine vehicles. (Staff contact: Bradley Northup, Public Works Department and Jeffery Smith, Police Department) City Manager’s Recommendation: Adopt the resolution. Public Works Superintendent Bradley Northup & Assistant Police Chief Christie Calderwood reviewed a PowerPoint presentation (on file in the Office of the City Clerk) In response to an inquiry from Council Member Acosta, Public Works Superintendent Bradley Northrop explained that the existing lifespan for police patrol vehicles in the fleet is currently four years. In response to an inquiry from Council Member Acosta, Public Works Superintendent Bradley Northrop explained that there are multiple manufacturers that offer police patrol vehicles however due to their nature they can not be purchased on a dealer lot and require a factory order. He further explained that currently, Ford Motor Company is the only manufacturer of police interceptor vehicles with hybrid engine configuration. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Public Works Superintendent Bradley Northrop explained that the purchase cost would not increase by more than 3% per annum for each model year. In response to an inquiry from Council Member Acosta, Public Works Superintendent Bradley Northrop explained that there was correspondence from Ford Government Sales Regional Manager Rick Keithley requesting customers to switch powertrains to increase the likelihood of orders being produced. He further explained that companies are not being forthcoming and saying that they can not produce the hybrid vehicles since vehicle orders will be canceled and moved to competitors. Public Works Superintendent Northrup further explained that correspondence was sent to Ford Government Sales Regional Manager Keithley asking what specifically the cause was, as well as the likelihood the City would be receiving the hybrid vehicles and the response was ultimately confirmation that the vehicles would not be expected to be offered in the configuration that Ford was offering. Council Member Acosta explained that she would have liked to have a compromise or more information regarding the climate impact and that she is disappointed that the item will pass, as it will be bad for the environment. Council Member Acosta further explained that she would like to see calculations of the greenhouse gas impact of the decision that was made and would like that impact offset since it is a step backward for the climate. Motion by Mayor Pro Tem Bhat-Patel, seconded by Mayor Blackburn, to adopt Resolution No. 2023-080. Motion carried, 4/1 (Acosta – No). March 14, 2023 Carlsbad City Council Regular Meeting Page 4 7. AUTHORIZATION TO EXPLORE OPTIONS FOR POTENTIAL USES OF THE CITY-OWNED PARKING LOT PROPERTIES AT THE SHOPPES AT CARLSBAD SHOPPING MALL – Adoption of Resolution No. 2023-081 identifying the city’s project team and future negotiating agents responsible for exploring options for potential uses of the city-owned parking lot properties located at The Shoppes at Carlsbad, including compliance with the Surplus Land Act and working with the representatives from Brookfield Properties or other parties identified through the Surplus Land Act process toward the lease or sale of properties. Real Estate Manager Curtis Jackson & Deputy City Manager Community Services Gary Barberio reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Vice President of Brookfield Properties Tony Pauker was available to answer questions. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-081. Motion carried, 5/0. 8. COST RECOVERY POLICY FOR THE CITY OF CARLSBAD, CARLSBAD MUNICIPAL WATER DISTRICT, AND COMMUNITY DEVELOPMENT COMMISSION – 1) Adoption of Resolution No. 2023-082 adopting a City Council Policy for Cost Recovery; and 2) Adoption of a Carlsbad Municipal Water District Board of Directors Resolution No. 1701 adopting a Cost Recovery Policy; and 3) Adoption of a Community Development Commission Resolution No. 558 adopting a Cost Recovery Policy. (Staff contact: Zach Korach, Administrative Services Department) City Manager’s Recommendation: Adopt the resolutions. Finance Director Zach Korach & Senior Management Analyst Jeremy Bates reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-082, Carlsbad Municipal Water District Board of Directors Resolution No. 1701 and Community Development Commission Resolution No. 558. Motion carried, 5/0. 9. MAYORAL APPOINTMENT OF ONE MEMBER TO THE SENIOR COMMISSION – Adoption of Resolution No. 2023-083 appointing one member to the Senior Commission.
