ROLL CALL: Commissioners Lafferty, Meenes, Merz, and Stine.
Commissioner Sabellico arrived at 5:15 p.m.

APPROVAL OF MINUTES:
Minutes of the Regular Meeting held on March 1, 2023
Motion by Commissioner Meenes, Second by Chair Merz to approve the Minutes of the Regular
Meeting held on March 1, 2023. Motion failed, 2/0/2/2 (Lafferty, Stine – Abstain; Kamenjarin,
Sabellico – Absent).
Commission consensus to continue this item to the next Planning Commission meeting.
PUBLIC COMMENT:
Danika Steele gave a compliment to staff, expressed her appreciation for what they do and
excitement about Children’s Paradise expanding into Carlsbad.
CONSENT CALENDAR: None.
PUBLIC HEARINGS:
1. ZCA 2023-0001/ LCPA 2023-0017/ PUB 2023-0002 – ACCESSORY DWELLING UNIT
AMENDMENTS 2023 – Request for adoption of a resolution recommending approval of
amendments to the Zone Code and Local Coastal Program to ensure consistency with state
law related to accessory dwelling units and junior accessory dwelling units. The City Planner
has determined that the proposed amendments are exempt from the California
Environmental Quality Act (CEQA) pursuant to Sections 15061(b)(3) and 15282(h) of the CEQA
Guidelines.

Chair Merz opened the duly noticed public hearing at 5:06 p.m.
City Planner Eric Lardy introduced Associate Planner Shelley Glennon who provided the
PowerPoint presentation (on file in the Office of the City Clerk).

As part of the presentation, Associate Planner Glennon made a recommendation to:
1) Adopt a resolution recommending approval of Zone Code Amendment (ZCA 2023-
0001) and Local Coastal Program Amendment (LCPA 2023-0017) (Exhibit 1).
Chair Merz opened the public testimony at 5:12 p.m.
Hearing no one wishing to speak, Chair Merz closed the public testimony at 5:13 p.m.
Commissioner Sabellico arrived at 5:15 p.m.
In response to Commissioner Meenes’ inquiry on how the state defines proximity to public
transit, Associate Planner Glennon responded that the Accessory Dwelling Unit (ADU) height
limitation is specific to regional public transit and state defines it as public train (fixed-rail)
stations and regional rapid bus stops. She added that the Carlsbad Poinsettia and Carlsbad
Village train stations are the only public transit stops that meet that definition. She further
explained that there is a parking exemption standard that does allow for ADUs to be exempt
from parking requirements if located one-half mile walking distance of public transit including
bus stops.
In response to Commissioner Stine’s inquiry on Coastal Development Permit (CDP)
applications and Accessory Dwelling Units (ADUs) as part of the applications and how the
ADUs are going to be processed under this new law, Associate Planner Glennon responded
that ADUs don’t require a CDP if over the counter building permit approval required only and
processed through the building plan check process. She explained that those that require a
minor CDP, staff ensures it will meet the 60-day review requirement. She further explained
that if an ADU is being proposed with a single-family home that requires a CDP concurrently,
staff can postpone the approval of the ADU until single-family home is approved.
In response to Commissioner Lafferty’s inquiry who determines if they do not pose a threat
to public health and safety, Associate Planner Glennon responded that the determination is
made by the Building Official when the building permit is submitted.
In response to Commissioner Lafferty’s inquiry on ADUs front yard exemption, Associate
Planner Glennon confirmed that the 800 square foot ADU must still meet the four-foot side
and rear setback requirements.
In response to Commissioner Lafferty’s inquiry, City Planner Eric Lardy responded that if there
were a historic district established then State law would apply. He also responded if there
was a demolition of a structure as part of an ADU application, staff would evaluate it as part
of our processes and compliance to the California Environmental Quality Act (CEQA).
Motion by Commissioner Stine, seconded by Commissioner Meenes, to adopt Resolution No.
7473. Motion carried, 5/0/1 (Kamenjarin – Absent).

Regular Meeting held on March 1, 2023. Motion carried, 3/0/2/1 (Lafferty, Stine -Abstain;
Kamenjarin -Absent).
DEPARTMENTAL REPORT: None.
PLANNING COMMISSION MEMBER REPORTS:
Commissioner Lafferty reported that the Historic Preservation Commission met on March 13,
2023, and discussed the following items: Carlsbad Mills Act Program Update and outreach
strategies, tour properties of historic significance, and review the Historic Preservation
Commission FY 2023/24 work plan.
Commissioner Stine reported that the Growth Management Committee will be presented a draft
performance standards report at next meeting to be held on March 23, 2023.
CITY PLANNER REPORTS:
City Planner Lardy reported that the deadline for applications for the Planning Commission
vacancy is on March 20, 2023, and a new commissioner should be appointed within the next two
months. He also reported that staff has agenda items for the next three meetings, April 5, April
19, and May 3, 2023.
CITY ATTORNEY REPORTS: None.
