PLEDGE OF ALLEGIANCE: Commissioner Meenes led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PUBLIC COMMENT: None. CONSENT CALENDAR: None. PUBLIC HEARINGS: 1. CDP 2021-0056 / V 2021-0003 (DEV2021-0227) – EDWARDS RESIDENCE - Request for adoption a Planning Commission Resolution (Exhibit 1), approving Coastal Development Permit CDP 2021-0056 and Minor Variance V 2021-0003 based upon the findings and subject to the conditions contained therein. ACTION TYPE: Quasi-judicial STAFF RECOMMENDATION: Adopt the resolutions. PLANNER: Eric Lardy ENGINEER: Nichole Fine Commissioners provided their disclosure as follows: • Commissioners Kamenjarin, Meenes, Merz, and Sabellico disclosed they visited the site. • Commissioner Lafferty disclosed she visited the site and looked it up on Goggle maps. Chair Merz opened the duly noticed public hearing at 5:06 p.m. City Planner Eric Lardy introduced the item and explained that he did not have a PowerPoint presentation because this item could have gone as a consent item. He added that the applicant was available for any questions. As part of the overview, City Planner Eric Lardy made a recommendation to adopt a resolution recommending approval of Coastal Development Permit (CDP 2021-0056 and Variance (V2021-0003)). In response to Commissioner Meenes’ inquiry regarding no improvements exist along the subject property’s frontage on Garfield Street and if sidewalks were required of the applicant, Applicant Sam Wright responded Garfield is considered a design alternative street. PLANNING COMMISSION Minutes April 19, 2023 Planning Commission Regular Meeting Page 2 In response to Commissioner Lafferty’s inquiry on how is that equitable to the rest of the city, Assistant Senior City Attorney Ron Kemp explained that the city can only require improvements as a result of some kind of a development because there is some impact to the city. He further explained that Proposition 218 passed and allowed people to vote on an assessment district. In response to Commissioner Stine’s inquiry on the applicant’s consideration of the ocean view from Magee Park, Applicant Sam Wright responded that they met with the city during the preliminary process and there were no requirements of certain height limitations to maintain views. City Planner Eric Lardy added that the project is within the beach overlay zone and it is not one of the city scenic corridors identifed. Chair Merz opened the public testimony at 5:40 p.m. Carlsbad resident Marian Edwards asked if Magee Park is publicly owned or privately owned. She commented there is already approval for a two-story home in the neighborhood and it would block the ocean view. Hearing no one else wishing to speak, Chair Merz closed the public testimony at 5:43 p.m. Recessed at 5:47 p.m. to confirm Magee Park is city owned. Resumed at 5:57 p.m. City Planner Eric Lardy confirmed the records through the County Assessor’s office and the city’s website that the property is owned by the City of Carlsbad. Commissioner Lafferty expressed her concern for the variance reduced setback adding that the city will lose the corridors that are created for access and safety requirements that are minimum standards setback requirements. Motion by Commissioner Kamenjarin, seconded by Commissioner Stine, to continue the item to May 3, 2023, to get further determination from staff. Motion carried, 7/0. DEPARTMENTAL REPORT: 2. HOUSING ELEMENT PROGRAMS (1.1.n, 1.3.c, 1.3.d, 1.3.e, 1.8.d, and 2.13.j) - To present an evaluation and update to the Planning Commission on General Plan Housing Element Programs 1.1 (Objective N), 1.3 (Objectives C, D and E), 1.8 (Objective D), and 2.13 (Objective J). ACTION TYPE: Administrative PLANNER: Scott Donnell ENGINEER: N/A As part of the presentation, Senior Planner Scott Donnell, Associate Planner Shelley Glennon and Principal Planner Robb Efird presented an evaluation and update on the General Plan Housing Element. The PowerPoint presentation is on file in the Office of the City Clerk. April 19, 2023 Planning Commission Regular Meeting Page 3 In response to Commissioner Stine’s inquiry on the projection to revenue impact if this change in the housing element is adopted, City Planner Eric Lardy explained that this change was adopted by the City Council last March and revenue projections and nexus studies were prepared to ensure that these complied with state law and requirements. He added that one of the main reasons for the change was to encourage different sizes of dwelling units so if the fee is a flat fee it encourages to build the largest unit possible. In response to Commissioner Hubinger’s inquiry on future in housing in five to 10 years, City Planner Eric Lardy responded that the city has a Housing Plan and it covers an eight-year period and the city is in year three of that. He added that staff is looking at the numbers and assignments given to the city by the state to implement. In response to Commissioner Lafferty’s inquiry of how does the city ensure the maximum destiny is reached, Senior Planner Scott Donnell explained that the purpose of the program is to ensure every project has the ability to hit the maximum destiny requirement. Chair Merz opened the public testimony at 6:46 p.m. Hearing no one wishing to speak, Chair Merz closed the public testimony at 6:47 p.m. 3. PLANNING COMMISSION WORK PLAN FOR FISCAL YEAR 2023-2024 - Request for a recommendation of approval of the Planning Commission Work Plan for fiscal year 2023- 2024. The proposed action does not constitute a “project” pursuant to the California Environmental Quality Act. ACTION TYPE: Administrative STAFF RECOMMENDATION: Adopt the resolutions. PLANNER: Eric Lardy ENGINEER: N/A As part of the presentation, City Planner Eric Lardy made a recommendation to adopt a resolution recommended approval of the Planning Commission Work Plan for fiscal year 2023-2024. Commissioner Stine and Meenes expressed they would like to have included in the workshop an update on state laws. Commissioner Lafferty expressed she would like to have a topic of discussion on the historic issues regarding the Mills Act. Motion by Commissioner Kamenjarin, seconded by Commissioner Stine, to nominate Chair Merz to attend the City Council meeting with staff. Motion carried, 7/0. Motion by Commissioner Meenes, seconded by Commissioner Sabellico, to adopt Resolution No. 7476 for staff recommendation of the Work Plan Annual Report and approval of the Work Plan for Fiscal Year 2023-2024. Motion carried, 7/0. April 19, 2023 Planning Commission Regular Meeting Page 4 PLANNING COMMISSION MEMBER REPORTS: Commissioner Hubinger expressed he is looking forward to working with the other commissioners and contributing to the city. Commissioner Kamenjarin congratulated staff on the new Planning Commission staff report format. CITY PLANNER REPORTS: City Planner Eric Lardy reported the Planning Commission agenda for May 3, 2023 will be full. He explained that there may not be a Planning Commission meeting on May 17, 2023 and if so, the next meeting will take place on June 7, 2023. He added that the Zoning Code Amendments for Accessory Dwelling Units {ADUs} and Housing Element programs are going to the City Council on May 9, 2023, and the lonis' appeal is going to the City Council on May 16, 2023.
