ANNOUNCEMENT OF CONCURRENT MEETINGS: None. INVOCATION: None. PLEDGE OF ALLEGIANCE: Council Member Luna led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in recognition of Cesar Chavez Day Council Member Acosta read the proclamation. Cross Connection Control Technician John Gil said a few words. Presentation of donation from Friends of Carrillo Ranch Recreation Services Manager Mick Calarco introduced Vice President of Friends of Carrillo Ranch Rick Dryer who said a few words. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: No reportable action. PUBLIC COMMENT: Pierre Cochet-Weinandt spoke regarding his concerns about the purchase of Police Department vehicles and Climate Action Plan. Mike Borrello spoke regarding the movie topic at Calavera Hills school and CRT. Cory Miholich introduced himself as an applicant to the Planning Commission. Paige DeCino spoke regarding the purchase of Police Department vehicles. Sierra Club Member Barbara Diamond spoke regarding her concerns with the city’s climate emergency. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 5. Motion carried unanimously, 5/0. REPORT ON CITY INVESTMENTS AS OF JANUARY 31, 2023 – Accept and file Report on City Investments as of Jan. 31, 2023. GENERAL PLAN AND HOUSING ELEMENT ANNUAL PROGRESS REPORT FOR CALENDAR YEAR 2022 – Adoption of Resolution No. 2023-084 accepting the General Plan and Housing Element Annual Progress Report for calendar year 2022 and finding that it satisfies the city’s reporting requirements to the state. (Staff contact: Robert Efird, Community Development Department) 3. 2023 HAZARD REDUCTION PROGRAM – Adoption of Resolution No. 2023-085 declaring weeds and rubbish upon private property in the City of Carlsbad as public nuisances under the terms of the City of Carlsbad’s Hazard Reduction Program and scheduling a public hearing on the topic for April 18, 2023. (Staff contact: Randy Metz, Fire Department) 4. ACCEPTING A $12,905 DONATION FROM THE FRIENDS OF CARRILLO RANCH, INC. – Adoption of Resolution No. 2023-086 accepting a $12,905 donation from the Friends of Carrillo Ranch, Inc. to support the California History & Art Field Trip Program at Leo Carrillo Ranch Historic Park. REJECTION OF BIDS RECEIVED AND AUTHORIZATION TO RE-ADVERTISE FOR BIDS FOR THE PUBLIC PARKING LOTS AMERICANS WITH DISABILITIES ACT IMPROVEMENTS PROJECT, CIP PROJECT NOS. 6049, 6052 AND 4090 – Adoption of Resolution No. 2023-087 rejecting the bids received and authorizing the City Clerk to re-advertise for bids for the Public Parking Lots Americans with Disabilities Act Improvements, CIP Project Nos. 6049, 6052 and 4090. (Staff contact: Scott Lyle and Hossein Ajideh, Public Works Department) ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: None. PUBLIC HEARING: 6. FISCAL YEAR 2021-22 GROWTH MANAGEMENT PROGRAM MONITORING REPORT – Adoption of Resolution No. 2023-088 accepting the Fiscal Year 2021-22 Growth Management Program Monitoring Report and finding that it satisfies the city’s monitoring requirements. (Staff contact: Jennifer Jesser, Community Development Department) City Manager’s Recommendation: Take public input, close the public hearing, and adopt the resolution. City Planner Eric Lardy reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Blackburn opened the duly noticed public hearing at 5:33 p.m. March 21, 2023 Carlsbad City Council Regular Meeting Page 3 Hearing no one wishing to speak, Mayor Blackburn closed the duly noticed public hearing at 5:33 p.m. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-088. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 7. UPDATE ON THE CITY’S RESPONSE TO THE LOCAL TRAFFIC SAFETY EMERGENCY, CONSIDERATION OF A VISION ZERO RESOLUTION AND OPTION TO EXTEND THE EMERGENCY PROCLAMATION FOR AN ADDITIONAL 60 DAYS – 1) Receive a report on actions taken to date relating to a local traffic safety emergency proclaimed Aug. 23, 2022; and 2) Adoption of Resolution No. 2023-089 endorsing the Vision Zero goal to achieve zero traffic-related deaths or serious injuries in the City of Carlsbad; and 3) Adoption of Resolution No. 2023-090 extending the Proclamation of Bicycle, E-bicycle and Motorized Mobility Device Safety Local Emergency in the City of Carlsbad until May 20, 2023, at 5 p.m., unless otherwise extended or terminated by the City Council. (Staff contact: Geoff Patnoe, City Manager’s Department) City Manager’s Recommendation: Receive the report and adopt the resolutions. Assistant City Manager Geoff Patnoe, Transportation Director Tom Frank and Chief Innovation Officer David Graham reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to Council Member Luna’s inquiry, Transportation Director Frank explained that roadways cannot be designed for impaired drivers, but safety measure barriers can be provided. In response to Council Member Acosta’s inquiry, Transportation Director Frank explained that with the emergency proclamation in place it prioritizes the Vision Zero project and helps in discussions with other permitting agencies. In response to Mayor Blackburn’s inquiry, City Manager Chadwick explained that Vision Zero and Safer Streets creates a common vernacular within other cities and their residents. Transportation Director Frank also explained that Safer Streets Together will not be changed, but by using the Vision Zero philosophy, the city could apply for grants later in the process. City Council received the report. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-089 and Resolution No. 2023-090. Motion carried unanimously, 5/0. HEPATITIS A – 2017 OUTBREAK AND CURRENT SITUATION – Receive a report on the 2017 Hepatitis A outbreak in San Diego County and an update on recent reports from the County of San Diego regarding a slight increase in Hepatitis A cases identified among people experiencing homelessness. (Staff Contact: Kim Young, Fire Department) City Manager’s Recommendation: Receive the report. Assistant Director of Emergency Services Kim Young reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Father Raymond Moore Hall Director of Community Services Socorro Anderson spoke regarding providing showers and vaccinations for those experiencing homelessness. City Council received the report. 9. MAYORAL AND CITY COUNCIL APPOINTMENTS TO THE COMMUNITY-POLICE ENGAGEMENT COMMISSION – 1) Adoption of Resolution No. 2023-091 appointing one member to the Community-Police Engagement Commission (Mayoral); and 2) Adoption of Resolution No. 2023-092 appointing one member to the Community-Police Engagement Commission (District 1); and 3) Adoption of Resolution No. 2023-093 appointing one member to the Community-Police Engagement Commission (District 2); and 4) Adoption of Resolution No. 2023-094 appointing one member to the Community-Police Engagement Commission (District 3); and 5) Adoption of Resolution No. 2023-095 appointing one member to the Community-Police Engagement Commission (District 4). Patrick Connolly spoke to his qualifications to be appointed to the Community-Police Engagement Commission. Taffy Cannon spoke to her qualifications to be appointed to the Community-Police Engagement Commission. Socorro Anderson spoke to her qualifications to be appointed to the Community-Police Engagement Commission. Michael Zepeda, Jr. spoke to his qualifications to be appointed to the Community-Police Engagement Commission. Dan Frazee spoke to his qualifications to be appointed to the Community-Police Engagement Commission. Motion carried unanimously, 5/0. Motion by Council Member Acosta to adopt Resolution No. 2023-095 appointing Dan Frazee to the Community-Police Engagement Commission. Motion carried unanimously, 5/0. Motion by Council Member Burkholder to adopt Resolution No. 2023-092 appointing Michael Zepeda, Jr. to the Community-Police Engagement Commission. Motion carried unanimously, 5/0. Motion Council Member Luna to adopt Resolution No. 2023-093 appointing Taffy Cannon to the Community-Police Engagement Commission. Motion carried unanimously, 5/0. Motion by Mayor Blackburn to adopt Resolution No. 2023-091 appointing Patrick Connolly to the Community-Police Engagement Commission. Motion carried unanimously, 5/0. 10. APPOINTMENT OF PRIMARY AND ALTERNATE MEMBERS TO THE NORTH COUNTY DISPATCH JOINT POWERS AUTHORITY – Adoption of Resolution No. 2023-096 appointing a Primary Member and an Alternate Member to the North County Dispatch Joint Powers Authority Regional Committee Assignment. (Staff contact: Faviola Medina, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution. Motion by Mayor Blackburn to adopt Resolution No. 2023-096 appointing Council Member Acosta as Primary Member to the North County Dispatch Joint Powers Authority. Motion carried unanimously, 5/0. Motion by Mayor Blackburn to adopt Resolution No. 2023-096 appointing Council Member Burkholder as Alternate Member to the North County Dispatch Joint Powers Authority. Motion carried unanimously, 5/0.
