Recommended Action
Adopt a resolution approving Amendment No. 4 to the professional services agreement with
GHD Inc., for additional engineering design and environmental permitting services for the
Beach Access Repairs and Upgrades from Pine Avenue to Tamarack Avenue Project, increasing
the not to exceed amount by $189,935 and extending the term by three years.
Executive Summary
This project will make necessary repairs and upgrades to the five beach access stairways, the
elevated upper sidewalk, hand railings, guardrails and lighting on the west side of Carlsbad
Boulevard between Pine Avenue and Tamarack Avenue.
The city, along with the California Department of Parks and Recreation, or State Parks, wants to
provide the necessary repairs and maintenance to improve the safety and accessibility of these
heavily used access routes to the beach, which attract thousands of residents and visitors year-
round.
The City Council authorized a professional services agreement with GHD Inc. in January 2018, in
an amount not to exceed $500,000. The project has since faced multiple design and permitting
challenges because the project is within State Parks property and the coastal zone.
The agreement has been amended three times under the delegated authority of the City
Manager and is set to expire on May 10, 2023. Approval of the proposed fourth amendment
exceeds the City Manager’s authority under Carlsbad Municipal Code Section 3.28.040(D)(3), so
requires the City Council’s approval.

Staff are requesting an amendment to the agreement with GHD Inc. to supplement the scope of
work, increase the not to exceed amount by $189,935 and extend the term for an additional
three years until May 9, 2026.
Sufficient funding is available in the project’s account to cover the additional cost needed for
this amendment.
Explanation & Analysis
The upper and lower sidewalks, along with
the seawall and stairways along the west
side of Carlsbad Boulevard between Pine
Avenue and Tamarack Avenue, were built
between 1986 and 1988. The upper
sidewalk between Pine Avenue and Maple
Avenue is elevated and cantilevered over
the bluff. There are four elevated stairways
within the project area, and one on-grade
stairway near Tamarack Avenue.
City staff observed these facilities had
deteriorated and needed further
investigation and repairs. Comprehensive
evaluation identified deficiencies that
include deterioration of the elevated upper
sidewalk structure, exposed and rusted steel reinforcements, cracked and broken away
concrete and rusting of stairway components.
The repair project was originally considered a maintenance project but has expanded into an
improvement project to address code requirements and increased demand for beach access.
Additional work that was not in the original scope of the agreement was subsequently
identified for improved access, mobility and aesthetics. This work involves:
• Widening the upper sidewalk
• Removing the metal beam guardrails
• Replacing streetlights
• Replacing the walking surfaces and stairs adjacent to the Tamarack Avenue restrooms
• Installing walkway lighting
• Extending the lower sidewalk’s retaining walls to help maintain the slope at the base of
the stairways
Construction phasing of the project has been modified and extended to minimize impacts along
Carlsbad Boulevard and Tamarack State Beach during the summer season from Memorial Day
through Labor Day. Construction will occur in two phases, over a total of 15 months.
The project’s geographical limits are entirely within the State Parks’ right-of-way as shown on
the location map provided as Exhibit 2. As a result, the city must comply with the state’s design
standards and coordinate design reviews and approvals with State Parks. Additionally, city staff
have coordinated with State Parks staff to determine how to reimburse State Parks for its costs
associated with the plan reviews and construction inspection services.

Project timeline
Jan. 10, 2018 The City Council adopted Resolution No. 2018-002, authorizing execution of a
professional services agreement with GHD Inc. in an amount not to exceed
$500,000 to provide engineering and environmental analysis for the project.
April 24, 2020 The term of the agreement was extended for an additional three-year period,
and the scope of services were amended to include additional design
improvements requiring additional studies and analysis, and environmental
analysis. These additional services constituted Amendment No. 1, and the
additional fees were not to exceed $220,000. The amendment extended the
agreement term to May 10, 2023.
June 14, 2021 The agreement was amended a second time to include services for a
topographical survey along Carlsbad Boulevard in an amount not to exceed
$6,000.
Jan. 31, 2022 A third amendment in an amount not to exceed $99,855 added services to
prepare visual simulations to develop the plans, revise the project description
to include additional design features and revised technical studies and add the
requirement for an additional 65%-completed design to be submitted to the
city. Amendment No. 3 increased the total agreement not to exceed amount
to $825,855.
The proposed Amendment No. 4 will provide additional funding in an amount not to exceed
$189,935 for GHD to complete the engineering design and environmental permitting services
for the project for a new total agreement amount not to exceed $1,015,790 and extend the
term by three years until May 9, 2026.
Fiscal Analysis
Sufficient funds are available in the Capital Improvement Program Project No. 3896 budget to
cover this amendment and complete the engineering design and environmental permitting for
the project. Fiscal impacts for Amendment No. 4 to the agreement with GHD Inc. is shown in
the following table:

Staff recommend Option 1 for the City Council’s approval.
Next Steps
Upon the City Council’s approval, staff will process Amendment No. 4 to the agreement, and
GHD Inc. will provide the additional services provided for in the amendment. Staff anticipate
that the design will be completed in late 2023.
Staff and GHD will continue to work on the final engineering design and environmental
clearance to prepare the construction plans, specifications, cost estimates and environmental
permits as needed to advertise the project for construction bids. Staff and GHD Inc. will
continue coordination with the State Parks staff to receive the necessary project approvals.
Staff plan to return to the City Council in late 2023 with a recommendation to approve the
plans and specifications and for authorization to advertise for construction bids. Staff plan to
return to the City Council with a request to award a construction contract in spring 2024.
Construction is expected to start in fall 2024 with completion in spring 2026.
Environmental Evaluation
This action does not constitute a project within the meaning of the California Environmental
Quality Act under Public Resources Code section 21065. It has no potential to cause either a
direct physical change in the environment or a reasonably foreseeable indirect physical change
in the environment and therefore does not require environmental review. Public input received
and technical information prepared during the process will be used in preparing an
environmental document to analyze the possible effects of the project. This action that amends
the professional services agreement does not have a legally binding effect on any possible
future discretionary action related to the project.

WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary,
desirable and in the public interest to maintain public safety and accessibility to make repairs and
upgrades to stairways, sidewalks, handrails and improve existing pathways to the beach area; and
WHEREAS, on Jan. 9, 2018, the City Council adopted Resolution No. 2018-002, authorizing GHD
Inc. to provide engineering and design services for the Beach Access Repairs and Upgrades from Pine
Avenue to Tamarack Avenue, Capital Improvement Program, or CIP, Project No. 3896, or Project, in an
amount not to exceed $500,000; and
WHEREAS, on April 24, 2020, Amendment No. 1 to the Agreement was executed to revise the
scope of services for an additional fee of $220,000 and to extend the term of the Agreement by three
years; and
WHEREAS, on June 14, 2021, Amendment No. 2 to the Agreement was executed to revise the
scope of services for an additional fee of $6,000; and
WHEREAS, on Jan. 31, 2022, Amendment No. 3 to the Agreement was executed to revise the
scope of services for an additional fee of $99,855; and
WHEREAS, the term of Agreement currently ends on May 10, 2023; and
WHEREAS, to complete the Project, the parties desire to amend the scope of work for additional
engineering design and environmental permitting services, for an additional amount of $189,935 for a
total agreement not to exceed amount of $1,015,790, and to extend the term by three years until May
9,2026;and
WHEREAS, sufficient funding from the General Capital Construction and Infrastructure
Replacement funds is available in the project account to cover the additional fee associated with
Amendment No. 4 to the Agreement; and
WHEREAS, the City Planner has determined that the project is exempt from the California
Environmental Quality Act under State Guidelines Section 21065, in that it has no potential to cause

AMENDMENT NO. 4 TO EXTEND AND AMEND THE AGREEMENT FOR
ENGINEERING SERVICES FOR BEACH ACCESS REPAIRS ALONG CARLSBAD
BOULEVARD FROM PINE AVENUE TO TAMARACK AVENUE
GHD INC.
This Amendment No. 4 is entered into and effective as of the \ D -rt,--day of

10, 2018 {the "Agreem nt") by and between the City of Carlsbad, a municipal corporation, ("City"),
and GHD Inc., a Cali ornia corporation, ("Contractor") (collectively, the "Parties") for engineering
services and for beach access repairs along Carlsbad Boulevard from Pine Avenue to Tamarack
Avenue ("Services).
RECITALS
A. Under the Agreement, the City retained the Services of the Contractor for a period
of 850 days, for an amount not to exceed five hundred thousand dollars ($500,000).
B. On April 20, 2020, the Parties executed Amendment No. 1 to the Agreement to
extend the term of the Agreement for an additional three (3) years, to amend and supplement the
Scope of Work for to include widening the elevated upper sidewalk, and to increase the total
amount paid for Services by two hundred twenty thousand dollars ($220,000), for an amended
not to exceed amount of seven hundred twenty thousand dollars ($720,000) and
C. On June 14, 2021, the Parties executed Amendment No. 2 to the Agreement to
amend and supplement the Scope of Work for additional survey services along Carlsbad Blvd.,
and to increase the total amount paid for Services by six thousand dollars ($6,000), for an
amended not to exceed amount of seven hundred twenty six thousand dollars ($726,000); and
D. On January 31 , 2022, the Parties executed Agreement No. 3 to the Agreement to
amend and supplement the Scope of Work to include additional visual simulations of the proposed
improvements, additional design services for converting the existing guard rail to illuminated non-
traffic rated bollards, and additional biological mapping and CEQA services; and to increase the
total amount paid for Services by ninety nine thousand eight hundred fifty five dollars ($99,855),
for an amended not to exceed amount of eight hundred twenty five thousand eight hundred fifty
five dollars ($825,855); and
E. The Parties now desire to extend the Agreement for an additional three (3) years,
amend and supplement the Scope of Work to include final engineering, environmental, permitting,
and construction support for the completion of the project, and to increase the total not to exceed
amount.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor agree as follows:
1. In addition to those Services contained in the Agreement, as may have been
amended from time to time, Contractor will provide those services described in Exhibit "A", Scope
of Services and Fee (SUPPLEMENTAL).
2. City will pay Contractor for all work associated with the Services described in
Exhibit "A", Scope of Services and Fee (SUPPLEMENTAL) on a time and materials basis an
amount not-to-exceed one hundred eighty nine thousand nine hundred thirty-five dollars

($189,935). With this Amendment, the total Agreement amount shall not exceed one million fifteen
thousand seven hundred ninety dollars ($1,015,790). Contractor will provide City, on a monthly
basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related
activities and costs for approval by City.
3. The Agreement, as may have been amended from time to time, is hereby extended
for a period of three (3) years until May 9, 2026.
4. All other provisions of the Agreement, as may have been amended from time to
time, will remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor pursuant to the
Agreement, as may have been amended from time to time, will include coverage for this
Amendment.
6. The individuals executing this Amendment and the instruments referenced in it on
behalf of Contractor each represent and warrant that they have the legal power, right and actual
authority to bind Contractor to the terms and conditions of this Amendment.

Beach Access Repair - Amendment No. 4 Scope
March 27, 2023
Proposed Effort (May 2023 Through Construction May 2025)
The following tasks define our team’s scope to assist the City in advancing the project through
final permitting and design efforts, as well as bidding and construction services on a time and materials
basis.
TASK 1 PROJECT COORDINATION AND MEETINGS
GHD will attend up to thirteen (13) bi-weekly meetings during the remaining design, bid and
permitting process for six (6) months from May 2023 to the end of October 2023. In addition, we assume
participation in six (6) meetings with State Parks, Coastal Commission, regulatory agencies, City's Planning
and/or Parks and Recreation departments, as needed. We will produce meeting minutes for
documentation purposes. GHD will also produce progress reports to be submitted with the monthly
invoice for the project through the anticipated through the end of construction in May 2025. This task will
also include project management efforts related to overseeing the project and coordination with the team
and City staff when needed.
TASK 2 100% CONSTRUCTION DOCUMENTS AND FINAL SUBMITTAL
The GHD team will advance the design and associated plan set to the 100% level for all disciplines and
will provide a formal comment resolution table identifying all design review comments received. We will
update the construction documents based on the agreement and resolution of comments for final
submittal of sealed plans and specifications to the City. This submittal will represent the final contract
documents that will be issued for bid and construction. The Engineer’s Estimate of Probable
Construction Cost / Bid Schedule will be updated to match the 100% / Final submittal and unit costs
will be verified by O’Connor Construction Management, Inc. (OCMI) given recent material escalations,
bidding climate, and other project requirements.
Deliverables:
- 100% and Final Drawings for Construction
- 100% and Final Technical Specifications
- 100% and Final Engineer’s Estimate of Probable Construction Cost / Bid Schedule
Assumptions:
- The City will reproduce the complete final bid set of project drawings and specifications for the
project for distribution to potential bidders.
TASK 3 SDG&E COORDINATION
GHD will coordinate with the City and SDG&E as needed for the replacement of the existing street lights
and design review of new service for the proposed under rail lighting at the four (4) elevated stairways and
one (1) on grade stairway adjacent to the Tamarack Avenue restroom. We anticipate attending up to four
(4) meetings with City and/or SDG&E staff during the design period.

TASK 4 REMAINING PERMITTING EFFORTS
Our team has developed an Initial Study / Mitigated Negative Declaration (IS/MND) and supporting
documents for the project in accordance with California Environmental Quality Act (CEQA) guidelines, of
which three (3) versions have been reviewed by the City to date. The IS/MND and associated figures,
drawings have been further revised and are currently in a fourth round of review with the City. GHD will
continue to coordinate with the City to address further comments, if any. We assume up to two (2) more
rounds of review with the City before adoption and that additional technical studies or quantitative analysis
are not needed. Once the City Planning Commission approves for release, GHD will prepare the MND for
public review.
CEQA Public Review Period
Per CEQA Guidelines Section 15072, GHD will prepare a Notice of Intent (NOI) to Adopt an MND for review
by the City. The NOI together with the Public Draft IS/MND will be publicly distributed for 30 days as required
by the CEQA Guidelines. GHD will develop a mailing list in coordination with the City. The City has advised
that they will distribute the IS/MND to the State Clearinghouse, responsible agencies, affected property
owners, and persons requesting notice. The City will also prepare and post an advertisement for a local
newspaper, and will submit a copy of the NOI to the San Diego County Clerk.
Deliverable: One (1) electronic copy in both MS Word and PDF of the Public Draft IS/MND and NOI
Finalize MND
After the required 30-day review period, GHD will compile all comments received on the Public Draft
IS/MND, including comment letters, emails, and oral comments. GHD will conduct an initial review of all
comments received on the Public Draft IS/MND, number them, and categorize them by subject. GHD will
then prepare responses to each comment. GHD will prepare one draft and one final response to comments
document for City staff to review. The Final IS/MND presented to the City for consideration will consist of
the Public Draft IS/MND, comments received, the responses to comments, and the Mitigation Monitoring
and Report Program (see Task 6 below). For purposes of this proposal, GHD assumes a total of up to 10
comment letters consisting of up to 2-pages each will be received and require brief qualitative responses.
We will revise the Final IS/MND in response to up to two (2) rounds of City review, including preparation of
a comment tracking table.
GHD will prepare a draft Notice of Determination (NOD) and submit it to the City for review. GHD’s project
manager and environmental document task leader will attend one (1) Planning Commission meeting at
which the project will be considered for approval. We understand that the City will file the final NOD with the
State Clearinghouse and San Diego County Clerk within five (5) working days of project approval. This
scope of work does not include CEQA filing fees (e.g., County Clerk, California Department of Fish and
Wildlife), which we assume will be paid directly by the City.
Deliverables:
- One (1) electronic copy in both MS Word and PDF of each of the Final IS/MND
- One (1) electronic copy in both MS Word and PDF of NOD

Coastal Development Permit
GHD will prepare a Coastal Development Permit (CDP) application and support the City with acquisition of
the CDP under the City’s Local Coastal Plan (LCP). The CDP application will be submitted to the City for
up to two (2) rounds of review and revision and will be developed consistent with the project CEQA
documents. GHD’s project manager and environmental permitting task leader will attend one (1) Coastal
Commission hearing.
Deliverable: CDP application package submitted to the City for review and approval
Assumptions:
- The project is located in the California Coastal Commission (CCC) appeal jurisdiction and
additional support if appealed is outside this scope of work and can be provided on a time and
materials basis if needed.
TASK 5 BID SUPPORT SERVICES
After the completion of the construction documents, the design team will support the City during the bidding
stage. The GHD Team will be available to provide the following Bid Support Services:
- Preparation of Bid Addenda
- Prepare responses to bidder questions
GHD will provide these services on a time and materials basis up the allowable budget for this task.
TASK 6 CONSTRUCTION SUPPORT SERVICES
Our Team will provide assistance to the City during the three construction phases (1A, 1B and 2) of the
project to support the technical aspects of the design and any design changes. Construction is anticipated
to occur outside of prime vacation summer months (Memorial Day to Labor Day) and take 15 months to
complete. The GHD Team will be available to provide the following Construction Support Services:
- Attend site visits and meetings during 15 months of construction (assumes 2 hours per week)
- Review Contractor Shop Drawings and Submittals (assumes up to 20 submittals)
- Respond to Contractor RFIs (assumes up to 30 RFIs)
- One (1) structural site observation related to the construction for each of the project phases
- One (1) landscape pre-maintenance meeting
- One (1) walk-thru with the City for each of the project phases
- Prepare As-Built (Record) Drawings based on Contractor markups
GHD will provide these services on a time and materials basis up to the allowable budget for this task. If
more hours are required to perform the work an amendment to contract will be requested by GHD and

TASK 7 CONSTRUCTION MONITORING
Mitigation Monitoring Reporting Plan (MMRP) Revisions / Compliance Verification
GHD and KTUA will revise the current draft Mitigation Monitoring and Reporting Plan (MMRP) with City
concurrence to identify and delineate responsible parties for implementing any mitigation measures
presented in the IS/MND. The MMRP will include all mitigation measures, responsibility for their
implementation, and method and schedule for reporting on their implementation. Our team will coordinate
with the City to select and appoint qualified responsible parties / individuals (i.e. biologists, scientists, and
other qualified contractors) to implement and carry out monitoring and/or reporting activities. We will track
and manage the timing and completion of mitigation monitoring measures and reporting actions during
construction, as well as compliance verification dates. The scope outlined for this task is comprehensive
and supersedes the original scope and addenda for the project.
Deliverable: One (1) electronic copy in both MS Word and PDF of the MMRP

ASSUMPTIONS
The proposed project scope of work includes the following assumptions:
o The scope outlined for the Amendment 4 tasks is comprehensive and supersedes the original
scope and amendments for the project.
o Scope and fee based are based on schedule attached created February 2023
o No construction services to be provided between Memorial Day and Labor Day
o Scope and fee based on 15 months (60 weeks) of construction activities
o Assumes attendance at on site recurring construction meetings not required
o Assumes SWPPP will be prepared and submitted by contractor
o Assume City to coordinate tribal and cultural resource consultation efforts and requirements
o San Diego Gas and Electric (SDG&E) will not require that a new metered service or
transformers be provided
o There will be no further public outreach or stakeholder meetings needed
o City will pay for all permit and application fees for the project
o No historic built environment analysis and evaluation is needed
o This scope assumes no focused surveys for special status plant or wildlife species would be
required subsequent to the Biological Resources Assessment
o The City will provide documentation required to acquire the CDP and take over filing and
administration of the CDP once the application has been submitted to the City by GHD
o Assumes no 401, 404 or 1602 permits are needed for the project
o Comments from the City will be limited to one (1) round of consolidated comments to be
addressed per submittal
o Analytical test for agricultural suitability of soil samples and planting amendment
recommendations prepared by a licensed soils testing laboratory are available
o Frontend ‘boiler plate’ specifications will be provided by the City, with limited input required from
the GHD Team
o The City will reproduce the complete final bid set of project drawings and specifications for the
project for distribution to potential bidders
o GHD does not control the review and approval of regulatory agency permits
o City / Contractor to produce As-built record drawings

observation, ENGEO provides clients with services for establishment and management of Geologic Hazard Abatement Districts (GHAD)
