Recommended Action
Adopt a resolution appointing one member to the Parks & Recreation Commission.
Executive Summary
The City Council is being asked to appoint one member to the Parks & Recreation Commission,
which makes recommendations and advises the City Council on issues related to the creation,
operation, maintenance and management of community recreation programs, playgrounds and
recreation activities and facilities, among other duties.
The commission consists of seven members who must be confirmed by the City Council.
Members must be residents of Carlsbad and normally serve four-year terms.
Explanation & Analysis
Commissioner Michael Luna was appointed to the Parks & Recreation Commission in December
2019, to fill the unexpired term of Commissioner Ron Withall for a term ending in December
2020. Commissioner Luna was reappointed in January 2021 with a term ending in December
2024. Commissioner Luna resigned in February 2023, leaving an unexpired term ending in
December 2024 to coincide with the term of the District 2 Council Member.
The City Clerk’s Office received 11 applications from residents wishing to serve on the Parks &
Recreation Commission. In keeping with City Council Policy No. 88, Council Member Luna has
recommended the following two residents wishing to serve on the Parks & Recreation
Commission to advance in the process and interview with the full City Council:
District 2 recommendation
• Robert Bruce – District 2
• Joe Gisbert – District 1
Exhibit 2 contains the applications of those applicants moving forward in the interview process.
The Maddy Act (California Government Code Sections 54970-54974) requires that on or before
December 31 of each year the legislative body shall prepare a Local Appointments List, which
contains the appointive terms of Board and Commission members that will expire in the next

calendar year. The name of the incumbent appointee, the date of appointment and the term
expiration date is also included on the list. Based on the prepared list, the City Clerk’s Office
accepts applications (available on the city’s website and in the City Clerk’s Office) for any
upcoming vacancies.
Carlsbad Municipal Code Section 2.15.050(2), which covers the general functions, powers, and
duties of boards and commissions, states, “Although each member of the City Council elected
by a district shall use his or her best efforts to appoint individuals residing in that district to
these commissions, members of the City Council may appoint individuals not residing in their
districts in their discretion in order to assure that the most interested and qualified individuals
serve on the commissions.”
According to City Council Resolution No. 2018-178, nominees to this unscheduled vacancy on
the Parks & Recreation Commission shall be appointed by the Council Member for District 2
with the approval of the City Council.

Members of the Parks & Recreation Commission are subject to the provisions of California’s
Political Reform Act of 1974 and must file statements of economic interest each year and
complete two hours of ethics training every two years.
Fiscal Analysis
This action has no financial impact.
Next Steps
Following the appointment of one member to the Parks & Recreation Commission, the City
Clerk’s Office will update the commission roster and coordinate the oath of office and the filing
of appointees’ statement of economic interest and ethics training certificate.
Environmental Evaluation
This action does not require environmental review because it does not constitute a project
within the meaning of the California Environmental Quality Act under California Public
Resources Code Section 21065 in that it has no potential to cause either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the
environment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPOINTING ONE MEMBER TO THE PARKS & RECREATION
COMMISSION
WHEREAS, Commissioner Michael Luna was appointed to the Parks & Recreation Commission
in December 2019, to fill the unexpired term of Commissioner Ron Withall for a term ending in
December 2020; and
WHEREAS, Commissioner Luna was reappointed in January 2021 with a term ending in
December 2024; and
WHEREAS, Commissioner Luna resigned in February 2023; and
WHEREAS, an unscheduled vacancy on the Parks & Recreation Commission exists.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the following Carlsbad resident is appointed to serve on the Parks & Recreation
Commission, for a term ending in December 2024, to coincide with the term of the
District 2 Council Member, or until a replacement is appointed.

First and foremost, I am a Carlasbad dad. I have three kids whow have played flag football, soccer,
baseball, and softball on Carlsbad fields for years. We regularly visit parks and facilities throughout
Carlsbad for various events and activities, and spent a fair amount of our summer days at the beach.
I'm also an attorney and I have substantial leadership and operations experience.

I am on my third season as a head coach, and I have been an assistant coach for
many years. My entire adult life has been spent in public service, as a member of the
military and as a prosecutor.

Additional information or comments
I recognize the challenges the city faces with population growth and the expectations that Carlsbad
continue to offer sufficient world-class recreation space of the sort we have enjoyed for years. I look
forward to being a part of crafting solutions to growing demand for open space, recreation space, and
sustainable growth.

Park\Community Center. In charge of the rentals\reservations for the courts, community center and Wildlife park.
I'm currently a tennis player and pickleball player and use many of the recreational facilities and parks in Carlsbad.

For almost five years, I have been volunteering at the Carlsbad Pine Street Community Center serving
meals to the seniors. I have been assisting in the dining room and in the kitchen. Before moving to
Carlsbad, I delivered Meals on Wheels for the Torrance Chapter for 4 years. I was also on the Board of
Directors for this Chapter and was responsible for driving new membership and awareness.
