The City has completed a review ol the application for a two•unit condominium di,velopment
located at 2201-2203 Levante Street.
It is the Planning Director's determination that bas•d on th• attach•d conditions, th• project Is
consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable
City Ordinances and Policies. Further, the project has been found to be categorically exempt
from environmental review according to Section 15301 (k) of the California Environmental Quality
Act and a Notice of Exemption was filed on September 24, 1993.
This memo, including the listed findings and conditions, constitutes approval of CP 93-oe.
Find Inga:
1 . The project is consistent with the City's General Plan Land UH Element, and with alt
other elements of Iha City's General Plan.

Adequate public facilities necessary to serve this proj•ct will be provided as required by
the City Engineer in conjunction with the approval of the parcel map (MS 93-09) required
for this project.
The project is conslst•nt with the deslg,n criteria and developm•nt st•nd•rde of Chapter
21 .45 (Planned Development Ordinance) of the City's Zoning Code.
Condltton1:
1. Approval I• granted for CP 93-06 • shown on Exhibit 'A', dated S•ptember 2<1, 1!!193, on
file in the Planning Department and incorporated herein by reference.
2. A copy of the final planned d•v•lopment site pl•n, incorpOf•t•d all condition• of approval,
shall be submitted to and approved by the Planning Director prior to final map approval

A preliminary decision has been made, pursuant to Stctlon 20.24.120 of Iha City of Carlsbad
Municipal Code, to approve the tenlati..-e pa,cel map of tha proposed rnlnor :5ubdivl:5ion subject
to the following conditions:
1, The tentative parcel map approval shall •xpi1-twenty-four (24) months from the date of
the letter containing the final decision for tentative parcel map approval.
2. The applicant shall provide the City with the approved tentative parcel map, The map
shall be to scale on a reproducible 24" x 36' xerox or photo mylar, The tentative parcel
map shall reMct the conditions or approval by the City. The reproducible shall be
submitted to the City Engineer, reviewed and signed by the City's project engineer and
project planner prior to submittal of the building plans, final map, improvement or grading
plans, whichever occurs first.
3. Unless a standards variance has been issued, no varianc• from City Standards is
authoriied by virtue of approval of this tentative parcel map.
4. The applicant shall comply with all the rules, regulations and deelgn requirements of the
respective sewer and water agencies regarding services to the project.

The appllcant shall be responsible for coordination with S.D.G.&E., Pacific Ball Telephor,a,
and Cable TV authorities.
Prior to approval of the parcel map the applicant shall pay all current fees and deposits
required.
The applicant shall defend, Indemnify and hold harmless the City and its •g•nts, officers,
and employees from any claim, action or proceeding against the City or its agents,
officers, or employees to attack, set aside, void or null an approval of the City, the
Planning Commission or City Engineer which has been brought against the City within
the time period providad for by Section 66499.37 of the Subdivision Map Act.
Ill. Prior to approval of the parcel map the owner shall pay and/or enter Into an agreement
with the City to pay any drainage area tees established as a result of the Master Drainage
Plan Update.
9. Prior to approval of Ihm parcel map ths applicant shall pay park-in-lieu fees to the City as
required by Chapter 20.44 of the Carlsbad Municipal Code.

This project is being approv•d as a condominium prc:ij•ct fc:>r r•aid•ntial homeown,rship
purposes. If any of the units in the project are rented, the minimum time increment for
such rental shall be not less than 26 days. A condition so stating this shall be placed in
the CC&R's for the project.
This project shall comply with all conditions and mitigation required by th• Zone S
Local Facilities Management Plan approved by the City Council on November 10, 1987,
incorporated herein and on file in the Planning Department and any future amendment!
to the plan prior to the final map approval.
The applicant shall have a· compliance in1pectlon performed by the City of Carlsbaa
Building Department prior to final map approval.
The applicant shall notify all tenants that the units are converting to condominiums and
submit a tenant notification form to the Planning Director prior to final map approval.
Prior to the issuanc• of building permits, or prior to the recordation of a final map and/or
issuance of certificate of compliance for the compliance for the conversion of exlstln1,1
apartments to air-space condominiums, the applicant shall pay to the City an inclusionary
housing in-lieu/impact lee as an individual fee on a per market-rate dwelling unit basis,

Prior to the approval of the parcel map the appllcsnt shall pay the recording fees for all
agreements, easements and documents required for this project.
The project Is approved under Iha express condition the appllcant pay the additional
public facilities fee prior 10 parcel map approval in accordance ~ith Ci'¥ Council
Resolution No. 9169 adopted July 26, 1967 and as amended from time to _time. The
applicant further agrees to pay any development fees established by th~ C1~ Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code. The applicant s wntten
agreement to pay said lees Is on file with the office of the (:ity ~lerk .and Is lncorpo_rated
herein by this reference. If the tees are not paid, this apphcation will not be consistent
with the General Plan and approval for this project shall be void.
Prior to approval of the parcel map the owner of the subject property shall execute an
agreement holding the City harmless regarding drainage across th.a act1acent property,
The final parcel map shall comply with the requirements of Condominium Permit (GP)
93-06.
The applicant may request a review of the preliminary decision with the City Engineer in writing
within ten (1 o) days of the date of this letter. Upon such .written request, the City Engineer shall
arrange a time and place with the applicant for such review.
