The Planning Department has completed a review of the application for a two•un.it
condominium conversion lornted at 2528 and 2530 Luciernaga Street, Carlsbad, California.
It 1s the Pbrm.ing Director's Determination that based on the attached conditions, the
project i, consistent with the City's condominium regulations (Chapter 21 .45) and with all
other applicable City ordinances and policies. Further, the project has been found to be
cm(egorically exempt from environmental review according to Section 15303(h) of the
California Environmental Quality Act and a Notice of Exemption was filed on .June 25,
1990.
This memorandum, including the listed findings and conditions, constitutes approval of Cl'
90-6.
1. The prujcc.t is consistent with the City's Gc.,neral Plan Land Use Element, having ~
densiry of 6.2 du/He: in an RM designation, and with all 01 her clements of the City's
Gencrnl Plan.
2. Adequate public facilities necessary to serve this project will be provided as required
by the City Engineer in conjunction with the approval of the parcel map for chis
project.
3. · The projec.t is consistent with the design criieria ancl development standards of
21 .45 (Planned Development Ordinance) of the City's /.,ming Code.

Approval is granted for Cf' 90-6 as shown on Exhibits "A"-"E", dated June 25 1990
on file in the Planning Department and incorporated herein by refncnee. ' '
Approval of CP 90"6 rs subject to the approval of MS 844 and subject to all
conditions of MS 844, incorporated ht"rein by reference.
Approv.il of this request shall not exclude compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of final map
approval.
The applicant shall establish a homeowners assoc1anon and concsponding
covenants, conditions and restrictions. Said CC&ll's shall be submitted to and
approved by the Planning Director prior to final map approval.
Building identification and/or addresses shall be placed on all new and existin,:
buildings so as to be plainly visible from the street or ~c:cess road; color of
identification and/or addresses shall contrast to th('<r background color.
This project is being approv<'.d as a condominium permit for residential home
ownership purposes. If ;my of the units in the project are rented, the minimum time
increment for such rental shall be not less than 26 <lays. A condition so stating· this
shall be placed in the CC&H"s for the project.
This project shall comply with all conditions and mitigation required by the Zone
6 Local Facilities Management Plan approved by the City Council on November 10,
1987. incorporated herein and on file in the Planning Department. and any future
amendments to the Plan made prior to rhe final map approval.
8. The applicant shall have a compliance inspecrion performed by the l3uilding
l)c,partment prior to final map npproval.
9. The applicant shall notify all tenants that the units are converting to C\mdominiums
and submit a tenant notification fonn to the Planning Director prior to final map
approval.
