PROPOSED MINOR SUBDMSION NO. 868, PRAVE.ll CONDO CONVERSION A preliminary decision has been made, pursuant to Section 20.24.120 of the Ciry of Carlsbad Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to the following conditions: 2. 3. 4, 5. 6. 7. 8. 9. 10. The applicant may request a review of the preliminary conditions within ten (10) days of the date of this approval. The request must be submitted in writing to the City Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad Municipal Code. The parcel map shall comply with the Land Use Planning Office memorandum for CP 91-7 /Minor Subdivision No. 868, dated September 5, 1991 (Attached Hereto). The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative parcel map approval. The developer shall provide the City with the reproducible 24" x 36" mylar copy of the tentative parcel map as approved by the Ciry Engineer. The tentative parcel map shall reflect the conditions of approval by the City. The map copy shall be submitted to the Ciry Engineer and approved prior to submittal for a final map. Unless a standard variance has been issued, no variance from City Standards is authorized by vinue of approval of this tentative parcel map. All required fees and deposits shall be paid prior ro parcel map recordation. Prior to approval of the parcel map rhe developer !!hall pay und/or enter into an agreement wirh the City to pay any drainage area fees established as a resulr of the forthcoming Masrer Drainage Plan Update. The applicant shall pay park-in-lieu fees to the City prior to the approval of the p,ircel map as required by Chapter 20.44 of the Carlsbad Municipal Code. This projecr is approved under the express condition that the applicant pay the additional public facilities fee adopted by the City Council on July 28, 1987, and any development fees established by the City Council pursuant to Ordinance No. 9791 or subsequent ordinance adopced to implemem a growth or development management system or public facilities phasing plan to fulfill the subdivider', agreement to pay the public facilities fee, a copy of which is on file with the City Clerk and is incorporated by this reference. [f the fees are not paid, this application will nor be consistent with the General Plan and approval for this project shall be void. Prior to approval of a final map the 4" drain shown on the tentative map shall be modified to meet Ciry standards, to the satisfaction of the City Engineer. WOJCIK Principal Civil Engineer TENTATIVE PARCEL MINOR SUBDIVISION NO._808 __ SEPTEMBER 5, 1991 TO: PRINCIPAL LAND USE ENGINEER FROM: ASSISTANT PLANNING DIRECTOR SUBJECT: CP 91-7/MS 868 • PAAVER CONDO The PlanninfJ Department has completed a review of the application for a two-unit condominium conversion located at 6-809-11 Corinthia Street, Carlsbad, California. It is the Planning Director's Determination that, tmsed upon the attact1ed conditions, the project is consistent with the City's condominium regulations (Chapter 21 .45) ancl with ail other applicable City ordinances and policies. Further, !he project has been found to be categorically exempt from environmental review according lo Section ·15303(3)(b) of the California Environmental Quality Act and a Notice of Exemption was filed on September 5, 1991. This memorandum constitutes approval of CP 91-7 and recommendation for approval of MS 868, based upon the findings and subject to the conditions listed below. Findings: 1 . The project is consistent with the City of Carlsbad's General Plan Land Use Element and all other elements of the General Plan. 2. Adequate public facilities necessary •to serve this project will be provided as required by the City Engineer in conjunction with the approval of the parcel map (MS 868) required for this project. 3. The project, as conditioned, is consistent with the design criteria and development standards of Chapter 21.45 (Planned Development Ordinance) of the Carlsbad Municipal Code. Condltlona.: 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. Approval is granted for CP 91-7 as shown on Exhibit "A", dated September 5, 1991, on tile in the Planning Department and incorporated herein by reference. A copy of the final Planned Development Site Plan, incorporating all conditions of approval, shall be submitted to and approved by the Planning Director prior to final rnap approval of MS 868. Approval of CP 91-7 is granted subject to approval of MS 868. CP 91-7 is subject to all condrtions of MS 868, incorporated herein by reference. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable city ordinances in effect. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Director prior to final map approval. Building identification and/or address shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. This project is being approved as a condominium project for residential homeownership purposes. tt any of the units in the project are rented, the minimum time increment for such rental shall be not less than 26 days. A condition so stating this shall be placed in the CC&R's for the project. This project shall comply with all conditions and mitigation required by the Zone 6 Local Facilities Management Plan approved by the City Council on November 1 O, 1987, incorporated herein and on file in the Planning Department and any future amendments to the plan prior to the final map approval. The applicant shall have a compliance inspec1ion performed by the City of Carlsbad Building Department prior to final map approval. The applicant shall notify all tenants that the units are converting to condominiums and submrt a tenant notification form to the Planning Director prior to final map approval.
