Executive Summary The City of Carlsbad has an ongoing Pavement Management Program that resurfaces and restripes Carlsbad roads to keep streets in top condition, free of cracks and potholes. While this work is being done, the city will also restripe the roadways to create enhanced bicycle lanes, supporting the effort to balance the needs of all roadway users. In total, this project will resurface and restripe about 16 miles of several east-west arterial streets throughout the city: The project includes the following segments as shown in Exhibit 2 Capital Improvement Program Project No. 6001: • Carlsbad Village Drive (Interstate 5, or I-5, to College Boulevard), approximately 3.3 miles • Tamarack Avenue (Carlsbad Boulevard to Carlsbad Village Drive), approximately 3.5 miles • Cannon Road (220 feet west of Avenida Encinas to Faraday Avenue), approximately 1.6 miles • Poinsettia Lane (Carlsbad Boulevard to Melrose Drive), approximately 5.0 miles • La Costa Avenue (I-5 to Fairway Lane, just past El Camino Real), approximately 2.3 miles • Olivenhain Road (Encinitas city limits to Rancho Santa Fe Road intersection), approximately 0.2 miles A location map is provided as Exhibit 2. June 6, 2023 Item #15 Page 1 of 31 The restriping will create enhanced bicycle lanes as recommended in the Safer Streets Together Plan, approved by the City Council on Sept. 27, 2022. The plan was developed as a result of the city’s state of local emergency for bike, e-bike, and traffic safety, first proclaimed by the City Manager on Aug. 23, 2022, and ratified in a resolution by the City Council on Aug. 30, 2022. Subsequent extensions of the emergency have been approved by the City Council, with the most recent extension approved on May 16, 2023. Staff have determined Granite Construction Inc. is the lowest responsive and responsible bidder with a bid in an amount of $6,827,171, as detailed below. Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(I)(6), which cover purchasing for construction contracts, require the City Council’s approval for all formally bid contracts when the value exceeds $200,000, making the project subject to this requirement. Staff recommend acceptance of bids and award of the construction contract to Granite Construction Inc. for the project in an amount not to exceed $6,827,171. Explanation & Analysis The City Council approving the project’s plans and specifications and authorizing advertising the project for construction bids on Feb. 7, 2023. (Resolution No. 2023-50) The project was then advertised using the city’s formal bidding procedures. Staff received seven bids for construction of the project on March 30, 2023. Staff completed review of the bid documents and determined the lowest responsive and responsible bidder was Granite Construction Inc., with a bid of $6,827,171. Costs from all seven bids were higher than anticipated due to price fluctuations and inflation associated with asphalt concrete and slurry seal line items. Granite Construction Inc. was deemed responsive because its bid met the requirements of the bidding documents and deemed responsible because it submitted a list of similar projects to show its capability and qualification to perform the specified work. The construction contract contains general performance standards and references technical specifications, which if not met, allow the city to withhold payment. The contract also includes a one-year warranty period from notice of completion. As stated in the Feb. 7, 2023, staff report, this project is structured so that work can proceed on the transportation and safety enhancements on the city-owned portions of the streets before the city receives Caltrans’s approval to do the resurfacing and restriping of the segments within Caltrans’s right-of-way. Since that time, staff have been working diligently with the Caltrans staff and have now received full approval for the proposed striping modifications through the five freeway interchange areas along Interstate 5. During the bidding process and in coordination with the California Coastal Commission staff, city staff determined that a coastal development permit was needed for two road segments in the Coastal Zone that included vehicle lane reductions. Those two road segments include Poinsettia Lane between Carlsbad Boulevard and Avenida Encinas and Tamarack Avenue between Skyline Drive and El Camino Real. The scope of the two subject road segments, which is approximately 0.7 miles, equates to approximately 5% of the total scope of the project. June 6, 2023 Item #15 Page 2 of 31 Staff have applied for the required permit. The permitting process is expected to be complete by August 2023. Until the outcome of the permitting process is known, staff will direct the contractor to delay the road striping work on these segments. If the permit is approved, the road segments will be striped to include the vehicle lane reductions. If the permit is denied or not approved within the project’s anticipated timeframe, the road segments will be striped as they are currently configured. Fiscal Analysis Sufficient funding is available in the Pavement Management Program, Capital Improvement Program Project No. 6001, to complete the project. The program funding sources include non- jurisdictional fees, which are generated from trash haulers, gas tax and TransNet local funds.1 The available funds and estimated construction costs are shown in the following table: Pavement Management Program Capital Improvement Program Project No. 6001 Total appropriation to date $53,799,889 Total expenditures and encumbrances to date -$44,649,554 Total available balance $9,150,335 2022 East-West Corridors Emergency Resurfacing and Restriping Project Capital Improvement Program Project No. 6001-22E Construction contract - Granite Construction Inc. -$6,827,171 Construction contingency -$760,000 Construction management, inspection and material testing (estimated) -$480,000 Total estimated construction costs -$8,067,171 Remaining balance $1,083,164 Additional appropriation needed $0 A small portion of this project on La Costa Avenue is within the City of Encinitas, and the City of Encinitas approved the construction drawings for the improvements within its right-of-way during its City Council meeting on March 22, 2023, as shown in Exhibit 3. The preliminary estimate of the work within the City of Encinitas’s right-of-way was approximately $220,000. Based on the current bid, the estimate has increased to approximately $261,000. The actual amount of the reimbursement will be based on the final construction cost. Upon the project’s completion, staff will determine the final construction cost associated with the improvements within the City of Encinitas’s right-of-way and finalize a memorandum of understanding with the City of Encinitas addressing reimbursement for the work within its right-of-way. Carlsbad Municipal Code sections 3.28.040(C)(5) and 3.28.090(B) authorizes the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which for this project is $760,000. 1 TransNet is a countywide sales tax collected to fund regional transportation projects. Next Steps Once the City Council accepts bids and awards the construction contract to Granite Construction, staff will issue a purchase order, schedule a pre-construction meeting with Granite Construction and issue a notice to proceed for construction of the project, which is expected to commence in June 2023. The duration of the construction contract is 90 working days, not including rainy days and delays from change orders that may extend the contract duration. Upon successful completion of the project, which is expected to be in fall 2023, a notice of completion will be recorded to release bonds issued for the project. Environmental Evaluation The City Planner has determined that the project is exempt from the California Environmental Quality Act under CEQA Guidelines Section 15301(c), which covers the repair of existing public structures and facilities involving negligible or no expansion. The action authorizes staff to implement an organizational or administrative activity of government that by itself will not result in a direct physical change in the environment. The action being considered is related to the City’s Climate Action Plan (CAP) and supports implementation of the following CAP City Actions: CET-1 Complete and Implement the Citywide Active Transportation Plan and CET-3 Improve Traffic Flow. STRATEGIC PLAN: The proposed action aligns with the Quality Transportation vision of the Strategic Plan by providing effective, safe and easy transportation for all modes of movement. It is anticipated that the Encinitas portion of the work will be approximately $220,000. BACKGROUND: Several roadways in the City of Carlsbad are being restriped by the City of Carlsbad. The vast majority of two of the roads lie within the City of Carlsbad with two small portions within the City of Encinitas. The Carlsbad project will resurface and restripe several east-west arterial streets, including some of their major east-west corridors. The restriping will create narrower lanes and enhance bicycle lanes by widening them and/or adding bike buffers. The item was presented to City Council on March 15, 2023 and was withdrawn from the agenda after discussion to be reviewed at a future meeting. ANALYSIS: The City of Carlsbad notified the City of Encinitas about their upcoming roadway restriping project on Carlsbad Village Drive, Tamarack Avenue, Cannon Road, Poinsettia Lane, La Costa Avenue and Olivenhain Road. Encinitas staff noticed that small portions of the Carlsbad work were located within the City of Encinitas and requested to review the plans. The Carlsbad work within Encinitas includes small portions of La Costa Avenue east of Interstate 5, and Olivenhain Road east of Los Pinos Circle. These roadways are being restriped by the City of Carlsbad with narrower 10’, 10.5’ or 11’ wide travel lanes and widened or buffered bike lanes . The safety and mobility enhancements being proposed by the City of Carlsbad are similar to restriping projects conducted in the City of Encinitas. Encinitas staff agrees with potential benefits and effectiveness of the restriping project by the City of Carlsbad on the City of Encinitas right of way. California Government Code section 830.6 provides a statutory defense to public entities by providing design immunity against claims arising out of an alleged design defect. In order to take advantage of the design immunity defense, the plan or design requires discretionary approval prior to construction by the legislative body, or other employee exercising discretionary authority, to give such approval. Staff is presenting the design and plans for the Council’s approval prior to Carlsbad soliciting construction bids on the project. The City Engineer has the technical background to review and oversee public works projects, and approves the design and plans, as prepared. NOW, THEREFORE, the City Council of the City of Encinitas does resolve as follows: SECTION 1: The City Council finds and declares as follows: The City of Carlsbad (“Carlsbad”) retained Michael Baker International as the engineering firm to design and prepare the plans for the restriping of La Costa Avenue from Interstate 5 to City Limit (“Project”). Carlsbad informed the Encinitas City Engineer that the design and plans are complete, and that construction of the Project may begin. The Encinitas City Engineer or designee reviewed the completed design and plans for the Project and agrees that the design and plans are complete, and the Project may be constructed. The City Council wishes to obtain the immunities set forth in Government Code section 830.6 with regard to the design, plans and construction of the Project. SECTION 2: Design Immunity; Authorization. The design and plans for the Project are determined to be consistent with the City’s DocuSign Envelope ID: E112A898-8CE9-435D-B8C4-E71F2134F598 June 6, 2023 Item #15 Page 29 of 31 standards and is approved. The design and plan approval set forth in this Resolution occurred before actual work on the Project’s construction commenced. The approval granted by this Resolution conforms with the City’s General Plan. The City Engineer, or designee, is authorized to act on the City's behalf in approving any alterations or modifications of the design and plans approved by this Resolution. The approval and authorization granted by this Resolution is intended to avail the City of Encinitas of the immunities set forth in Government Code section 830.6.
