ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Blackburn announced that the City Council is serving as the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item No. 5. PLEDGE OF ALLEGIANCE: Council Member Luna led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in recognition of LGBTQ Pride Month Mayor Pro Tem Bhat-Patel read the proclamation. Founder and Executive Director of the North County LGBTQ Resource Center Max Disposti and Director of Pride by the Beach Roxanne Deatherage said a few words and rejected the proclamation. PUBLIC COMMENT: Terry Burns spoke regarding the lack of an invocation at City Council Meetings. Educational Director and Founder of CleanEarth4Kids.org Susan Hume expressed her concerns regarding lead exposure from aviation fuel at Palomar Airport. CleanEarth4Kids.org representative John Botthoff expressed his concerns regarding lead exposure and lower math and reading test scores in schools. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: No reportable action. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 10, with Item No. 3 as Option 1. Motion carried unanimously, 5/0, with the exception of Consent Calendar Item No. 1, where the motion carried 4/1 (Blackburn – Abstain). 1. REQUEST FOR THE SAN DIEGO COUNTY LOCAL AGENCY FORMATION COMMISSION TO DETACH CERTAIN AREAS SERVED BY THE CITY OF CARLSBAD FROM LEUCADIA WASTEWATER DISTRICT’S SERVICE AREA – Adoption of Resolution No. 2023-143 requesting the San Diego County Local Agency formation Commission to hold proceedings for the Leucadia Wastewater District change of organization detachment and delegating authority to the City Manager or designee to sign the application and other documents necessary to complete the change of organization. CONTINUATION OF THE DECLARATION OF A STORM-RELATED LOCAL EMERGENCY FOR REPAIR OF A SINKHOLE ON HAYMAR DRIVE – Adoption of Resolution No. 2023-144 continuing the declaration of a storm-related local emergency for repair of a sinkhole in the area of Haymar Drive. (Staff contact: Tom Frank and Vicki Quiram, Public Works Department) 3. AUTHORIZE THE PURCHASE OF TYPE 1 FIRE ENGINES AND THE APPROPRIATION OF ADDITIONAL FUNDS FOR THE PURCHASE – 1) Adoption of Resolution No. 2023-145 authorizing the purchase of two Type 1 fire engines from Seagrave Fire Apparatus, LLC, via Houston-Galveston Area Council Contract No. FS12-19, in an amount not to exceed $2,076,188, and authorizing the Deputy City Manager, Administrative Services, to appropriate $120,094 to the Fleet & Facilities Vehicle Asset Replacement Fund and $114,094 to the Fire Department’s fiscal year 2022-23 operating budget in the General Fund for a total additional appropriation of $234,188; or 2) Adoption of a resolution authorizing the purchase of one Type 1 fire engine from Seagrave Fire Apparatus, LLC, via Houston-Galveston Area Council Contract No. FS-12-19, in an amount not to exceed $1,038,094, and authorizing the Deputy City Manager, Administrative Services, to appropriate $114,094 to the Fire Department’s fiscal year 2022-23 operating budget in the General Fund. AWARD OF AGREEMENT TO FEHR & PEERS FOR TRANSPORTATION PLANNING, ENGINEERING DESIGN AND ENVIRONMENTAL ASSESSMENT SERVICES FOR THE 2023 SAFE ROUTES TO SCHOOL PROGRAM – Adoption of Resolution No. 2023-146 accepting proposals and awarding an agreement to Fehr & Peers to provide transportation planning, engineering design and environmental assessment services for the 2023 Safe Routes to School Program in an amount not to exceed $125,270. (Staff contact: Nathan Schmidt, Public Works Department) 5. AWARD OF CONTRACT TO HOUALLA ENTERPRISES LTD. DBA METRO BUILDERS & ENGINEERS GROUP LTD., AND AUTHORIZE AN ADDITIONAL APPROPRIATION OF FUNDS FOR CONSTRUCTION OF THE RECYCLED WATER PHASE III, D-4 RESERVOIR PROJECT (CIP PROJECT NO. 5210) – Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1708 accepting bids, awarding a contract to Houalla Enterprises Ltd. dba Metro Builders & Engineers Group, Ltd. for construction of the Recycled Water Phase III, D-4 Reservoir and appropriating additional funds from the Recycled Water Connection Fund to Capital Improvement Program Project No. 5210. AGREEMENT WITH SAN DIEGO HUMANE SOCIETY FOR ANIMAL CONTROL SERVICES – Adoption of Resolution No. 2023-147 authorizing the City Manager to execute an agreement with the San Diego Humane Society for animal control services in an amount not to exceed June 6, 2023 Carlsbad City Council Regular Meeting Page 3 $720,000 for fiscal year 2023-24. INITIATING PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS WITHIN STREET LIGHTING AND LANDSCAPE DISTRICT NO. 1, A SPECIAL ASSESSMENT DISTRICT – Adoption of Resolution No. 2023-148 initiating the proceedings, approving the preliminary Engineer’s Report for fiscal year 2023-24 and setting a public hearing for July 11, 2023, for the annual levy of assessments within Street Lighting and Landscaping District No. 1, a special assessment district. INITIATING PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS WITHIN STREET LIGHTING AND LANDSCAPE DISTRICT NO. 2, A SPECIAL ASSESSMENT DISTRICT – Adoption of Resolution No. 2023-149 initiating the proceedings, approving the preliminary Engineer’s Report for fiscal year 2023-24 and setting a public hearing for July 11, 2023, for the annual levy of assessments within Street Lighting and Landscaping District No. 2, a special assessment district. CS-448 – ALTERNATIVE HOUSING AND HOUSING FOR PERSONS EXPERIENCING HOMELESSNESS – Adoption of Ordinance No. CS-448 approving an amendment to the Zoning Ordinance, Title 21 of the Carlsbad Municipal Code, to implement a portion of Objective g of Housing Element Program 1.3 - Alternative Housing and Objective h of Housing Element Program 2.13 - Housing for Persons Experiencing Homelessness (Case Name: Alternative and Temporary Housing Amendments 2023; Case No.: ZCA 2023-0002/ LCPA 2023-0018 (DEV 2023-0040)). ORDINANCE NO. CS-449 – ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS – Adoption of Ordinance No. CS-449 approving an amendment to the Zoning Ordinance, Title 21 of the Carlsbad Municipal Code, to ensure consistency with state law related to accessory dwelling units and junior accessory dwelling units (Case Name: Accessory Dwelling Unit Amendment 2023; Case No.: ZCA 2023-0001/ LCPA 2023-0017/ PUB 2023- 0002). (Staff contact: Faviola Medina, City Clerk’s Department) City Manager’s Recommendation: Adopt Ordinance No. CS-449. City Attorney Cindie McMahon titled the ordinance. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Ordinance No. CS-449. Motion carried unanimously, 5/0. PUBLIC HEARING: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 13. REPORT ON OPTIONS RELATED TO A SECTION 115 PENSION TRUST – Receive an informational report on options related to a Section 115 Pension Trust and provide direction to staff as necessary. (Staff contact: Zach Korach, Administrative Services Department) City Manager’s Recommendation: Receive the report and provide direction as necessary. Finance Director Zach Korach reviewed a PowerPoint presentation (on file in the Office of the City Clerk). City Council discussion ensued. City Council received the report. Motion by Mayor Blackburn, seconded by Mayor Pro Tem Bhat-Patel, directing staff to pursue the establishment of a Public Agencies Post-Employment Benefits Section 115 Trust and return at a future meeting to select the trust administrator, investment manager and investment documents. Motion carried unanimously, 5/0. 14. ANNUAL WORK PLANS FOR THE PLANNING COMMISSION AND HISTORIC PRESERVATION COMMISSION – 1) Adoption of Resolution No. 2023-152 accepting the Fiscal Year 2022-2023 Planning Commission Work Plan Annual Report and approving the Fiscal Year 2023-2024 Planning Commission Work Plan; and 2) Adoption of Resolution No. 2023-153 approving the Fiscal Year 2023-2024 Historic Preservation Commission Work Plan. (Staff contact: Eric Lardy and Mike Strong, Community Development Department) City Manager’s Recommendation: Adopt the resolutions. Community Development Director Mike Strong reviewed a PowerPoint presentation (on file in the Office of the City Clerk). June 6, 2023 Carlsbad City Council Regular Meeting Page 5 Planning Commission Chair Peter Merz spoke briefly regarding the Planning Commission’s accomplishments and expressed his gratitude for staff and fellow commissioners. Historic Preservation Commission Chair Chad Majer gave a brief overview on the Historic Preservation Commission Work Plan activities for FY 2023-24. Council thanked staff and both commissioners for their hard work. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-152 and Resolution No. 2023-153. Motion carried unanimously, 5/0. 15. AWARD OF CONTRACT TO GRANITE CONSTRUCTION INC. FOR THE 2022 EAST-WEST CORRIDORS EMERGENCY RESURFACING AND RESTRIPING PROJECT (CIP PROJECT NO. 6001- 22E) – Adoption of Resolution No. 2023-154 accepting bids and awarding a contract to Granite Construction Inc. for the 2022 East-West Corridors Emergency Resurfacing and Restriping Project, Capital Improvement Program Project No. 6001-22E, in an amount not to exceed $6,827,171. (Staff contact: Eric Zielke and Hossein Ajideh, Public Works Department) City Manager’s Recommendation: Adopt the resolution. Transportation Director Tom Frank reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to Mayor Blackburn’s inquiry, Transportation Director Frank confirmed that going from two lanes to one lane on Carlsbad Village Drive does not contain any raised medians. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2023-154. Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members.
