All landscape plans shall be prepared to confonn with the Landscape Guidelines Manual
and submitted per the landscape plan check procedures on file in the Planning
Department.
Landscape plans s~all ?e designed to minimiz~ water use. LaWJ! and other wne 1 plants
(see _Landscape Guidelines Manual) shall be limited to areas of special visual importance
or high use. M~khes shall be used and irrigation equipment and design shall promote
water conservation.
The developer shall avoid tiees that have invasive root systems, produce excessive litter
and/or are too large relative to the lot size.
Prior to final occupancy, a letter from a California licensed landscape architect shall be
submitted to .the Planning Director certifying that all landscaping has been installed as
shown on the approved landscape plans.
All herbicides shall be applied by applicators licensed by the State of California.
The applicant shall pay a landscape plan check and inspection fee as required by Section
20.08.050 of the Carlsbad Municipal Code.
All landscape and irrigation plans shall show existing and proposed contours and shall
match the grading plans in terms of scale and location of improvements.
The minimum shrub size shall be S gallons.
As part of the plans submitted for building permit plan check, the applicant shall include
a reduced version of the approving resolutions on a 24" x 36' blueline drawing. Said
blueline drawing(,) shall also include a copy of any applicable Coastal Developmenl
Permit and signed approved site plan.
Prior to issuance of a building permit there shall be a deed restriction placed on the deed
to lots 1-19 and 44-49 subje<t to the satisfaction of the Planning Dir«tor notifying all
interested parties and successon: in interest that:
A. The distance between the original structures depicted on Exhibits 'A" -"CC'
9/28/90, and side property line shall be<ome the established side yard setback for
each lot and supersede the existing underlying R-1 Zone's side yard setbad
standard. No further development is permitted in this side yard setback.
B. AU room additions and add ons shall maintain a rear yard minimum distance o(
15 feet from the top of any rear yard slope, except patio covers and detache4
accessoiy structures which mll5t maintain a minimwn distance of fiv.: feet from the
lop of any rear yard dope. Fences and walls are excluded from this requirement;

Engineering Conditions:
18. The developer sh.a.II provide an acceptable means for maintaining the easements within the
subdivision and all the private streets, storm drain facilities located therein and to
distnbute the costs of such maintenance in an equitable manner among the ownen of the
units within the subdivision. Adequate provision for such maintenance shall be included
with the CC&R's subje<t to the approval of the City Engineer. TI1ose private storm drains
are located on Lots 67, 68 and 90.
19. This project is approved under the exp[e55 condition that the applicant pay the additional
public facilities fee adopted by the City Council on July 28, I 987, and any development
fees established by the City Council pursuant to Ordinance No. 9791 or subsequent
ordinance adopted to implement a growth or development management system or public
facilities phasing plan to fulfill the subdivider', agreement to pay the public facilities fee,
a copy of which i.-; on file with the City Clerk and is incorporated by this reference. If the
fees are not paid, this application will not be consistent with the General Plan and
approval for this project shall be void.
20. Al1 required fire hydrants, water mains, and appurtenances shall be operational prior to
combustible building materials being located on the project site.
21. 1his proje<t is approved upon the express condition tl1at building permits will not be
issued for development of the subj«:! property wiles, the City Engineer detennines tl1at
sewer facilities are available at the time of application for such sewer permits and will
continue lo be available until time of occupancy.
22. Unless a standard variance has been issued, no variance from City Standards is authorized
by virtue of approval of this Site Plan.
23. Tiie developer shall comply with all the rules, regulations and design requirements of the
respective sewer and water agencies regarding services to the project.
24. The developer shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and
Cable ·rv authorities.
25. All concrete terrace drains shall be maintained by the homeowner's association (if on
commonly owned property) or the individual property owner (if on an individually owned
lot). An appropriately worded statement dearly identifying tlie responsibility shall be
placed in the CC&R's.
26. Prior to hauling dirt or construction materials to any proposed construction site within this
project the developer shaU submit to and receive approval from the City Engineer for the
proposed haul route. The developer shall comply with all conditions and requirements the
City Engineer may impose with regards to the hauling operation.
27. The developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance with
the Carlsbad Municipal Code and the City Engineer. Reference Chap 1 l.06.

WHEREAS, a verified application has been' filed with the City of Carlsbad and
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Title 21
of the Carlsbad Municipal Code; and
WHERE.AS. pursuant to the provisions of the Municipal Code, the Planning
Commission did, on the 17th day of October, 1990, and on the 7th day of November, 1990,

Prior to the issuance of any building permits for the project, the develope shall post a cash
deposit and enter into an agreement with the City agreeing to pay a proportional share
of the improvement of Nga Road to major arterial standards from Mimosa Drive tluu El
Camino ReaL The developers contnbution shall be fixed at 4.4 pen:ent of the cost of the
work including Engineering inspection and administration as determined by the City
Engineer and shall be paid to Hillman upon completion of the improvements. Tlus
condition is required lo assure compliance with circulation standards of the Growth
Management Ordinance and Local Facilities Management Plans for Zone 6 and 19.

Approval is granted for SDP 90-6, as shown on Exhibit(,) "A" -'CC', dated September 28,
1990, incorporated by reference and on file, in the Planning Department. Development
shall occur suhstantially as shown unless othe1wise noted in these conditions.
The developer shall provide the City with a repro<luciLle 24" x 36'". mylar copy of the _Site
Plan as approved by the Planning Commission. The Site Plan shall reflect the conditions
o( approval by the City. The Plan copy shall be submitted to the City Engineer prior to
building, grading or improvement plan submittal, whichever occurs first.
Th.is project is also approved under the express condition that the applicant pay th.; public
facilities fee adopted by the City Council on July 28, I 987 and as amended from time ro
time, and any development fees established by the City Council pursuant to Chapter 21.90
of the Carlsbad Municipu.l Code or other ordinance adopted to implement a growth
management system or facilities and improvement plan and to fulfill the subdivider's
agreement to pay the public facilities fee dated March 21, 1990, a copy of which is on file
with the City Clerk and is incorporated by th.is reference. If the fees are not paid this
application will not be consistent with the General Plan and approval for this project will

This approval shall become null and void if building permits are not issued for this project
within eighteen months year from the date of project approval,

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgement. The permit is not valid and
development shall not conmence until a copy of the permit, ·signed by the
permlttee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commlsslon
office.
2. Expiratlon .. If development has not conmenced, the permit will expire two
years from the date an whlch the Conmlssion voted on the application.
Development shall be pursued in a dillgent manner and completed in a
reasonable perlod of time. Application for extension of the permit must
be made prior to the expiratlon date.
3. Compliance. All development must occur in strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Conmission approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Conmission.
5. Inspections. The Conmlssion staff shall be allowed to inspect the slte
and the development during construction, subject to 24-hour advance notice.
6. Assignment. The permit may be assigned to any qualified person, provided

C. All proposed temporary erosion control measures, such as
interceptor ditches, sandbagging, debrls basins, temporary deslltlng
basins, hay-baling and hydroseeding shall be performed concurrently with
grading and silt traps shall be utilized 1n conjunction wlth plantings to
minimize soil loss from the construction site.
D. Maintenance of temporary erosion control measures is the
responsibility of the applicant, lncluding replacement of any devices
altered or dislodged by storms. Oesiltlng basin maintenance, including
removal of accumulated silt, shall occur prior to the onset of the rainy
season and on an as-needed basis throughout the winter.
E. Any areas trenched for the installation of utilities shall be
protected through the placement of excavated material on the upstream side
of the trench, where possible. Trenching shall occur In Increments so
that no trenches will remain open overnight.

reviewed In accordance with the 1980 Master Drainage Plan for the City of
Carlsbad, including the Model Erosion Control Ordinance contained In the
plan. The erosion, sedlmtntatlon and drainage control plans shall include:
A.) A runoff control plan designed by I licensed englneor qua1111ed In hydrology and hydraulics, which would assure no Increase In peak runoff
rate from the developed site over the greatest discharge expected from the
existing undeveloped site as a result of a 10-year, 6-hour frequency
storm. Runoff control shall be accomplished by a variety of measures,
Including but not limited to: on-site catchment basins, detention basins,

B.) Detailed maintenance arrangements and various alternatives for

permit, the applicant shall submit a detailed landscaping plan 1ndlcatlng the
type and location of plants and hydroseedlng material, 1rrlgat\on systems and
other landscape features for the proposed project. The plans shall be subject
to the review and written approval of the Executive Director, Oroughl

maximum extent feasible. The plant species list and landscape plan shall be
reviewed by the Executive Olrector, In consultation with the State Department
of Fish and Game, to guard against Introduction of any species which are

feasible along the limits _of grading.
!>. Archaeology/Paleontology. A limited testing program followed by a
program of lmplemental preservation and/or Impact mitigation for sites
Identified In the Negative Declaration for the project shall be completed a1
recomended In the Negative Oeclaratlon and required by the City of Carlsbad.
Any change in this requirement shall be reported to and subject to the written
approval of the Executive Director.
7. Disposal of Graded Spoils. Prior to the 1ssuance of the coast~l
development permit, the applicant shall ldentlf~ the location for the disposal
of graded spoils. If the site Is located wHhln the coastal zon,, • separate
coa,tal development permit or permit amendment shall first be obtained from
the California Coastal Comlsslon or Its successors in interest.

7. Disposal of Graded Spoils. Prior to the issuance of the coastal

of graded spoils. If the site is located witl,in the coastal zone, a separate
coastal development permit or permit amendment shall first be obtained from
the California Coastal Con,11isslon or its successors in Interest.
