CALL TO ORDER: 5 p.m.
ROLL CALL: Blackburn, Bhat-Patel, Acosta, Burkholder, Luna.
ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Blackburn announced that the City
Council is serving as the Carlsbad Municipal Water District Board of Directors on Consent
Calendar Item No. 1.
INVOCATION: None.
PLEDGE OF ALLEGIANCE: Mayor Blackburn led the Pledge of Allegiance.
APPROVAL OF MINUTES: None.
PRESENTATIONS:
Systems Administration Appreciation Day
Council Member Burkholder read the proclamation. Maria Callander accepted the proclamation
and said a few words.
PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon
announced there was no reportable action.
PUBLIC COMMENT:
Jason Oziel spoke against roundabouts discussed at the July 18, 2023 City Council meeting.
CONSENT CALENDAR:
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent
Calendar Item Nos. 1 through 6. Motion carried unanimously, 5/0, with the exception of Item
No. 3, 4/0/1 (Blackburn – Abstain).
1. ADVERTISE FOR BIDS FOR THE CARLSBAD WATER RECYCLING FACILITY ROOF REPLACEMENT
PROJECT, CIP PROJECT NO. 4749 – Adoption of a Carlsbad Municipal Water District Board of
Directors Resolution No. 1713 approving the plans, specifications and contract documents
and authorizing the Secretary of the Board of Directors to advertise for bids for the Carlsbad
Water Recycling Facility Roof Replacement Project. (Staff contact: Molly Amendt and Dave
Padilla, Public Works Department)
2. AWARD OF CONTRACT TO A. PREMAN ROOFING, INC., FOR THE SENIOR CENTER ROOF
REPLACEMENT PROJECT, CIP PROJECT NO. 4738 – Adoption of Resolution No. 2023-208
accepting the bids and awarding a contract to A. Preman Roofing, Inc. for the roof
replacement as part of the Senior Center Repairs and Roof Replacement Project, Capital

3. ACCEPT GRANT DEED AND TEMPORARY CONSTRUCTION EASEMENT AND APPROVE OTHER
AGREEMENTS NEEDED FOR THE EL CAMINO REAL WIDENING PROJECT FROM POINSETTIA
LANE TO CAMINO VIDA ROBLE, CIP PROJECT NO. 6072 – Adoption of Resolution No. 2023-
209 accepting a Grant Deed and a Temporary Construction Easement with the owners of
Assessor Parcel Number 213-050-16-00 and authorizing the City Manager to execute a joint
use agreement and consent agreement and covenant with San Diego Gas & Electric for the El
Camino Real Widening Project from Poinsettia Lane to Camino Vida Roble. (Staff contact:
Brandon Miles and Hossein Ajideh, Public Works Department)
Mayor Blackburn recused himself from Consent Calendar Item No. 3 due to a property
ownership conflict.
4. ANNEXATION OF THREE PROPERTIES INTO COMMUNITY FACILITIES DISTRICT NO. 1
(ANNEXATION NO. 22/23-01, FPC RESIDENTIAL) – Adoption of Resolution No. 2023-210
certifying the results of an election and adding property to Community Facilities District No.

5. PAYMENT TO PUBLIC PROVIDER GROUND EMERGENCY MEDICAL TRANSPORTATION
INTERGOVERNMENTAL TRANSFER PROGRAM – Adoption of Resolution No. 2023-211
authorizing the city’s participation in the Public Provider Ground Emergency Medical
Transportation Intergovernmental Transfer Program with the Department of Health Care
Services, the City Manager or designee to execute certification forms and related program
documents and make intergovernmental transfers in support of the program and the Deputy
City Manager, Administrative Services or designee to appropriate $468,000 in program
revenue and expenses annually to the General Fund. (Staff contact: Jennifer Marinov, Fire

6. UPDATE TO THE SAN DIEGO COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN –
Adoption of Resolution No. 2023-212 approving an update to the San Diego County Multi-
Jurisdictional Hazard Mitigation Plan. (Staff contact: Kim Young, Fire Department)

7. ORDINANCE NO. CS-450 – AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 7.08 RABIES,
ANIMAL CONTROL AND REGULATION – Adoption of Ordinance No. CS-450 amending Carlsbad
Municipal Code Chapter 7.08 Rabies, Animal Control and Regulation. (Staff contact: Kaylin

Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt
Ordinance No. CS-450. Motion carried unanimously, 5/0.
PUBLIC HEARINGS:
8. 2023 HAZARD REDUCTION COST REPORT – Adoption of Resolution No. 2023-213 approving
the 2023 Hazard Reduction Cost Report and directing the City Clerk to file a certified copy of
the resolution and report with the San Diego County Auditor before Aug. 10, 2023. (Staff
contact: Randy Metz, Fire Department)
City Manager’s Recommendation: Take public input, close the public hearing, and adopt
the resolution.
Fire Division Chief Randy Metz presented the report.
Mayor Blackburn opened the duly noticed public hearing at 5:12 p.m.

Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-213. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS:
9. MAYORAL APPOINTMENTS OF THREE MEMBERS TO THE HOUSING COMMISSION – 1)
Adoption of Resolution No. 2023-214 appointing one member to the Housing Commission –
At-Large Member; and
2) Adoption of Resolution No. 2023-215 appointing one member to the Housing Commission
– At-Large Member; and
3) Adoption of Resolution No. 2023-216 appointing one member to the Housing Commission
– Rental Assistance - Senior Member. (Staff contact: Tammy McMinn, City Clerk Department)
City Manager’s Recommendation: Adopt the resolutions.
Tyler Collins spoke regarding his qualifications to be considered for the Housing Commission.
Motion by Mayor Blackburn to adopt Resolution No. 2023-214 appointing Barbara Berger to
the Housing Commission At-Large Member, Resolution No. 2023-215 appointing Tyler
Lawrence Collins to the Housing Commission At-Large Member and Resolution No. 2023-216
appointing Michael Ydigoras to the Housing Commission – Rental Assistance - Senior
Member. Motion carried unanimously, 5/0.

10. WHAT WORKS CITIES CERTIFICATION FOR PERFORMANCE MANAGEMENT AND
OPERATIONAL EXCELLENCE – Receive a report on the City of Carlsbad’s performance
management and operational excellence efforts that have been recognized with a silver
certification by What Works Cities, an international standard of excellence for data-driven,
well-managed local government. (Staff contact: David Graham and Rachel Maltz,
Administrative Services Department)
City Manager’s Recommendation: Receive the report.
Chief Innovation Officer David Graham and Senior Program Manager Rachel Maltz presented
the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to an inquiry from Council Member Acosta, Chief Innovation Officer Graham
explained that the City will have access to more open data platforms and will work with
community partners to improve deficient areas.
In response to an inquiry from Council Member Acosta, Chief Innovation Officer Graham
explained that the dashboard will go live after the council meeting and there will be a direct
point of contact to address any questions constituents have regarding the website.
City Council received the report.
11. SEMIANNUAL TRANSPORTATION REPORT – Receive the semiannual Transportation Report.
(Staff contact: Tom Frank, Public Works Department)
City Manager’s Recommendation: Receive the report.
Transportation Director Tom Frank and Senior Engineer Nestor Mangohig presented the
report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
Scott Engel requested that the Cannon Road and College Boulevard lane narrowing be
revisited.
In response to an inquiry from Council Member Bhat-Patel, Transportation Director Tom
Frank explained that in response to feedback regarding narrowing of the vehicular travel
lanes, 10.5 feet of vehicular travel lane widths will be provided wherever feasible.
City Council received the report.
12. TRAFFIC AND MOBILITY COMMISSION WORK PLAN FOR FISCAL YEAR 2023-24 AND REQUEST
TO CHANGE COMMISSION’S NAME – Adoption of Resolution No. 2023-217 approving the
Traffic and Mobility Commission Work Plan for fiscal year 2023-24 and directing staff to
return at a future meeting with an ordinance to change the Commission’s name to the Traffic
Safety and Mobility Commission. (Staff contact: Nathan Schmidt, Public Works Department)

City Manager’s Recommendation: Adopt the resolution.
Transportation Planning and Mobility Manager Nathan Schmidt presented the report and
reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
Traffic and Mobility Commissioner Peter Cole spoke in favor of the work plan.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-217. Motion carried unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported
on activities and meetings of some committees and subcommittees of which they are members.
ANNOUNCEMENTS: This section of the Agenda is designated for announcements to advise the
