Absent: Luna. PLEDGE OF ALLEGIANCE: Mayor Pro Tem Bhat-Patel led the Pledge of Allegiance. ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Blackburn announced that the City Council is serving as the City Council and the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item Nos. 3 and 6. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Aug. 22, 2023 Minutes of the Regular Meeting held Aug. 29, 2023 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve the minutes as presented. Motion carried, 4/0/1 (Luna – Absent). PRESENTATIONS: Proclamation in recognition of Indigenous People’s Day Mayor Pro Tem Bhat-Patel read the proclamation. Library Technician Erik Garcia accepted the proclamation and said a few words. Proclamation in recognition of Code Enforcement Appreciation Week Council Member Acosta read the proclamation. Senior Code Enforcement Officer Jamie Zeller accepted the proclamation and said a few words. PUBLIC COMMENT: Lori Robins requested the City Council to direct staff to reconsider the adopted design standards for the Village and Barrio. Mary Lucid urged the City Manager to address some concerns with city staff and their tasks. Glen Bernard expressed his desire for design standards in Carlsbad neighborhoods. Raul Villamor expressed his concerns with current projects and safety concerns taking place in his neighborhood. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 and 6. Motion carried, 4/0/1 (Luna – Absent). Oct. 10, 2023, 5 p.m. CITY COUNCIL Minutes Oct. 10, 2023 Carlsbad City Council Regular Meeting Page 2 Council Member Acosta pulled Item #1 for discussion. 1. CITY MANAGER AND CITY ATTORNEY EMPLOYMENT AGREEMENTS – 1) Adoption of Resolution No. 2023-255 approving the amended and restated City Manager Employment Agreement with Scott Chadwick; and 2) Adoption of Resolution No. 2023-256 approving the amended and restated City Attorney Employment Agreement with Cindie K. McMahon and corresponding amendments to the Appointed Officials Salary Range Schedule. (Staff contact: Judy Von Kalinowski, Administrative Services Department) Mary Lucid requested that the City Council postpone this item until all five Council Members are present. Glen Bernard expressed his concerns with the employment contracts contained in this item. Council Member Acosta requested clarification on the process of negotiations for the City Manager’s and City Attorney’s employment agreement. Mayor Blackburn explained the process for the City Manager’s and City Attorney’s annual review and employment agreement negotiations. 2. ADVERTISE FOR BIDS FOR THE EMERGENCY OPERATIONS CENTER RECONFIGURATION PROJECT (CIP PROJECT NO. 4715) – Adoption of Resolution No. 2023-257 approving the plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for the Emergency Operations Center Reconfiguration Project, authorizing and directing the Deputy City Manager, Administrative Services to transfer funds from Capital Improvement Program Project No. 4719 to Project No. 4715, approving an increase to the construction contingency for Contract No. PWS22-1552FAC to $1,910,219, and approving an increase to the City Manager’s change order authority. (Staff contact: Steven Stewart, Public Works Department) 3. AWARD OF CONTRACT TO SYLVESTER ROOFING COMPANY, INC. FOR THE CARLSBAD WATER RECYCLING FACILITY ROOF REPLACEMENT PROJECT (CIP PROJECT NO. 4749) – Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1718 accepting the bids and awarding a contract to Sylvester Roofing Company, Inc. for the Carlsbad Water Recycling Facility Roof Replacement Project in an amount not to exceed $387,931 and appropriating $168,024 from the Recycled Water Replacement Fund to Capital Improvement Program Project No. 4749. ADVERTISE FOR BIDS FOR THE CALAVERA HILLS COMMUNITY CENTER REFURBISHMENT PROJECT (CIP PROJECT NO. 4746) – Adoption of Resolution No. 2023-258 approving the plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for the Calavera Hills Community Center Refurbishment Project. PURCHASE OF DATA STORAGE HARDWARE FROM CDW•G, LLC – Adoption of a Resolution No. 2023-259 authorizing the City Manager to execute documents necessary to purchase a replacement NetApp data storage device for information technology infrastructure needs from CDW•G, LLC for an amount not to exceed $213,839 and directing the Deputy City Manager, Administrative Services to appropriate $213,839 from the available fund balance of the Information Technology Replacement Fund in fiscal year 2023-24. AUTHORIZATION TO APPROPRIATE FISCAL YEAR 2022-23 BUDGET CARRYFORWARD REQUESTS TO FISCAL YEAR 2023-24 – Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1719 approving the fiscal year 2022-23 budget carryforward requests and appropriation of funds to fiscal year 2023-24 and authorizing capital outlay purchases. APPROVAL OF THE 2024 REGULAR CITY COUNCIL MEETING CALENDAR – Adoption of a resolution approving the 2024 Regular City Council Meeting Calendar. (Staff contact: Sheila Cobian, City Manager Department) City Manager’s Recommendation: Adopt the resolution. Mayor Blackburn announced that this item is being continued to Oct. 17, 2023, when all five City Council Members are present. 8. CITY COUNCIL POLICY STATEMENT – CITY COUNCIL PROCLAMATIONS, CERTIFICATES OF RECOGNITION AND CONGRATULATORY LETTERS – Adoption of a resolution approving City Council Policy Statement- City Council Proclamations, Certificates of Recognition and Congratulatory Letters. (Staff contact: Faviola Medina, City Clerk Department and Sheila Cobian, City Manager Department) City Manager’s Recommendation: Adopt the resolution. Mayor Blackburn announced that this item is being continued to Oct. 17, 2023, when all five City Council Members are present. COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members.
