ANNOUNCEMENT OF CONCURRENT MEETINGS: None.
PLEDGE OF ALLEGIANCE: Deputy City Manager Public Works Paz Gomez led the Pledge of
Allegiance.
APPROVAL OF MINUTES: None.
PRESENTATIONS:
Proclamation in recognition of National Disability Employment Awareness Month
Council Member Luna read the proclamation. Librarian Emily Hardy accepted the proclamation
and said a few words.
Proclamation in recognition of National Arts & Humanities Month
Council Member Burkholder read the proclamation. Deputy Library Director Sheila Crosby
accepted the proclamation and said a few words.
PUBLIC COMMENT:
Mary Lucid spoke regarding City of Carlsbad staff accountability.
Treen Priest with San Dieguito Alliance spoke regarding drug prevention awareness during Red
Ribbon Week.
Dom Betro spoke regarding concerns relating to Palomar Airport.
Becky Rapp of San Dieguito Alliance spoke regarding Red Ribbon Week.
Liz Glater spoke regarding budget cuts related to fewer TGIF Concerts and library closures on
Sundays.
CONSENT CALENDAR:

2. AGREEMENTS FOR INFORMATION TECHNOLOGY SERVICES WITH AVERO ADVISORS,
CLIENTFIRST TECHNOLOGY CONSULTING, AND PUBLIC CONSULTING GROUP – 1) Adoption of
Resolution No. 2023-260 authorizing the City Manager to execute a professional services
master agreement for information technology project management and change
management services with Avero Advisors, LLC for an amount not to exceed $1,500,000 for
a five-year period; and
2) Adoption of Resolution No. 2023-261 authorizing the City Manager to execute a
professional services master agreement for information technology project management and
change management services with ClientFirst Technology Consulting, LLC for an amount not
to exceed $1,500,000 for a five-year period; and
3) Adoption of Resolution No. 2023-262 authorizing the City Manager to execute a
professional services master agreement for information technology project management and
change management services with Public Consulting Group, LLC for an amount not to exceed

3. ADVERTISE FOR BIDS FOR THE TRAFFIC CALMING PLANS FOR VICTORIA AVENUE, HIGHLAND
DRIVE, NUEVA CASTILLA WAY, CIRCULO SEQUOIA AND CELINDA DRIVE (CIP PROJECT NO.
6070) – Adoption of Resolution No. 2023-263 approving the plans, specifications and contract
documents and authorizing the City Clerk to advertise for bids for implementing the traffic
calming plans for Victoria Avenue, Highland Drive, Nueva Castilla Way, Circulo Sequoia and
Celinda Drive. (Staff contact: John Kim, Public Works Department)
CONSENT ITEMS PULLED FOR DISCUSSION:
1. REPORT ON CITY INVESTMENTS AS OF AUG. 31, 2023 – Accept and file Report on City

Mary Lucid expressed concerns regarding budgeting.
In response to Council Member Luna’s inquiry, Finance Director Zach Korach explained that
the primary reason for the difference in cash is due to fiscal year reset therefore the first 10
month are shown compared to the first two months of the fiscal year in 2023.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve
Consent Calendar Item No. 1. Motion carried unanimously, 5/0.
3. ADVERTISE FOR BIDS FOR THE TRAFFIC CALMING PLANS FOR VICTORIA AVENUE, HIGHLAND

Mayor Blackburn and Council Member Acosta left the dais at 5:35 p.m. due to a conflict of
interest.
City Attorney Cindie McMahon announced that for the item to pass, an affirmative vote of all
three Council Members present at the dais is necessary.
Moe Blais voiced his concerns regarding traffic calming plans in his neighborhood.
Christine Marshall voiced her concerns regarding the traffic calming survey results.
Wolf Marshall requested that survey rules be followed.
Peter Konopak spoke against the traffic calming measures on Celinda Dr.
City Traffic Engineer John Kim reviewed a PowerPoint presentation (on file in the Office of
the City Clerk).
In response to an inquiry from Council Member Burkholder, Mr. Kim explained that there
were 165 surveys mailed to residents on Celinda Drive and 96 were returned.
In response to an inquiry from Mayor Pro Tem Bhat-Patel, Transportation Director Tom Frank
explained that the survey responses received were the total number including the ones
received after the expiration of the initial survey date.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Burkholder to adopt
Resolution No. 2023-263, with the exception of Celinda Drive. Motion passed, 3/0/2
(Blackburn, Acosta – Abstain).
Motion by Council Member Burkholder, seconded by Mayo Pro Tem Bhat-Patel directing
staff to resurvey the residents on Celinda Drive and bring the item back to the City Council
if 67% of the affirmative threshold is met. Motion passed, 3/0/2 (Blackburn, Acosta –
Abstain).
Mayor Blackburn and Council Member Acosta returned to the dais at 5:58 p.m.

ORDINANCES FOR INTRODUCTION:
4. ALLOWANCES FOR NON-STOREFRONT RETAIL MEDICINAL CANNABIS DELIVERY SERVICE
BUSINESSES CONSISTENT WITH THE MEDICINAL CANNABIS PATIENTS’ RIGHTS TO ACCESS ACT
Introduction of Ordinance No. CS-460 amending Chapter 8.90, adding Chapter 8.95, and
repealing Section 5.04.160 of the Carlsbad Municipal Code to allow non-storefront retail
medicinal cannabis delivery service businesses consistent with the Medicinal Cannabis
Patients’ Right to Access Act, also referred to as Senate Bill 1186. (Staff contact: Jeff Murphy,

City Manager’s Recommendation: Introduce the ordinances.
Community Development Director Jeff Murphy presented the report and reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).
John Byrom with Vista Community Clinic, Prevention Alcohol and Drug Programs and North
Coastal Prevention Coalition spoke regarding the impacts of medicinal cannabis delivery
services.
City Attorney Cindie McMahon titled the ordinance.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to introduce
Ordinance No. CS-460. Motion passed unanimously, 5/0.
ORDINANCES FOR ADOPTION: None.
PUBLIC HEARING:
5. AMENDMENTS TO THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CITIZEN
PARTICIPATION PLAN AND REVIEW OF THE COMMUNITY DEVELOPMENT BLOCK GRANT
PROGRAM FISCAL YEAR 2024-25 – 1) Adoption of Resolution No. 2023-264 approving
amendments to the Community Development Block Grant Program Citizen Participation Plan;
and
2) Adoption of Resolution No. 2023-265 approving the Community Development Block Grant
Program Fiscal Year 2024-25 Funding Plan and authorizing the distribution of the Notice of
Funding Availability. (Staff contact: Nicole Piano-Jones, Community Services Department)
City Manager’s Recommendation: Take public input, close the public hearing, and adopt the
resolutions.
Senior Program Manager Nicole Piano-Jones presented the report and reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).

Mayor Blackburn opened the duly noticed public hearing at 6:15 p.m.
Seeing no one wishing to speak on this item, Mayor Blackburn closed the duly noticed public
hearing at 6:15 p.m.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to adopt
Resolution No. 2023-264 and Resolution No. 2023-265. Motion passed unanimously, 5/0.
DEPARTMENTAL AND CITY MANAGER REPORTS:
This item was continued from the Regular City Council Meeting of Oct. 10, 2023.
6. APPROVAL OF THE 2024 REGULAR CITY COUNCIL MEETING CALENDAR – Adoption of a
Resolution No. 2023-266 approving the 2024 Regular City Council Meeting Calendar. (Staff
contact: Sheila Cobian, City Manager Department)
City Manager’s Recommendation: Adopt the resolution.
Director of Legislative & Constituent Services Sheila Cobian gave a brief overview of the item.
Council Member Luna spoke in favor of having regularly scheduled Council meetings begin at
4 p.m. for calendar year 2024.
Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt
Resolution No. 2023-266, adopting the 2024 Regular City Council Meeting Calendar and the
regular meetings will be scheduled to take place at 5 p.m. . Motion carried, 4/1 (Luna – No).

7. CITY COUNCIL POLICY STATEMENT – CITY COUNCIL PROCLAMATIONS, CERTIFICATES OF
RECOGNITION AND CONGRATULATORY LETTERS – Adoption of Resolution No. 2023-267
approving City Council Policy Statement- City Council Proclamations, Certificates of
Recognition and Congratulatory Letters. (Staff contact: Faviola Medina, City Clerk
Department and Sheila Cobian, City Manager Department)
City Manager’s Recommendation: Adopt the resolution.
Director of Legislative & Constituent Services Sheila Cobian presented the report and
reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to an inquiry from Council Member Luna, City Manager Scott Chadwick explained
that employees are recognized through the Human Resources Department and at the
department level. He further explained that there is an also an internal email or video where
employees are recognized, and congratulatory notes are sent based off significant
achievements.

In response to Mayor Blackburn, Director of Legislative & Constituent Services Cobian
explained that there is no time limit in the policy for the recipient to speak, but the guideline
is two minutes.
Mayor Blackburn requested a motion to add that there be a time limit of two minutes for the
recipient of the proclamation to speak.
Council Member Luna requested that the proclamation policy be revised to include a bullet
point that says the proclamation policy does not apply to city employees or departments.
Motion by Mayor Pro Tern Bhat-Patel, seconded by Council Member Acosta, to adopt
Resolution No. 2023-267 as amended to add language to City Council Policy Statement No.
99 - City Council Proclamations, Certificates of Recognition and Congratulatory Letters that
proclamations will not be issued for city departmental celebration days, weeks or months.
Rather those recognitions shall be facilitated through the City Manager's staff updates and a
time limit of two minutes for the recipient of the proclamation to speak. Motion passed
unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS:· Mayor Blackburn and the City Council Members reported
on activities and meetings of some committees and subcommittees of which they are members.
ANNOUNCEMENTS: This section of the Agenda is designated for announcements to advise the
community regarding events that Members of the City Council have been invited to, and may
participate in.
