PLEDGE OF ALLEGIANCE: Council Member Luna led the Pledge of Allegiance. ANNOUNCEMENT OF CONCURRENT MEETINGS: None. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Sept. 12, 2023 Minutes of the Regular Meeting held Sept. 26, 2023 Minutes of the Regular Meeting held Oct. 10, 2023 Minutes of the Special Meeting held Oct. 17, 2023 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve the minutes with the amendment to the Minutes of the Regular Meeting held Sept. 12, 2023, correcting that Council Member Luna presented the National Preparedness Month presentation, rather than Council Member Acosta. Motion carried unanimously, 5/0. PRESENTATIONS: Proclamation in recognition of Native American Heritage Month Council Member Acosta presented the proclamation to Library Technician Nick Houts. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced there was no reportable action. PUBLIC COMMENT: Mary Lucid expressed concerns with city expenditures. Mike Borrello expressed concerns with recent COVID-19 data. Isaac Danon shared perspective on freedom of speech. David Miller expressed concern with safety at the grass area in front of Offshore Surf Shop. Vanessa Forsythe expressed opposition to the use of leaded fuel at the Carlsbad airport. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 3. Motion carried unanimously, 5/0. AUTHORIZING NEGOTIATIONS FOR THE ACQUISITION OF CHESTNUT APARTMENTS REAL PROPERTY AT 945 CHESTNUT AVE., AN AFFORDABLE HOUSING PROPERTY COMMONLY KNOWN AS CHESTNUT APARTMENTS – Adoption of Resolution No. 2023-271 authorizing a city team to negotiate with representatives of Solutions for Change, Inc. on acquisition of real property at 945 Chestnut Ave. (APN 204-191-2200), an affordable housing property known as Chestnut Apartments. (Staff contact: Mandy Mills, Community Services Department) Mike Borrello expressed concerns relating to funding affordable housing units in the City of Carlsbad. 2. TWO-YEAR EXTENSION OF A $1.5 MILLION LOAN COMMITMENT FROM THE HOUSING TRUST FUND FOR THE WEST OAKS AFFORDABLE HOUSING PROJECT AND AUTHORIZATION TO NEGOTIATE ACQUISITION OF THE BUENA OUTFALL – 1) Adoption of Resolution No. 2023-272 approving a two-year extension of the loan commitment period for a $1.5 million loan from the Housing Trust Fund to Chelsea Investment Corporation for the West Oaks Affordable Housing Project (DEV 2013-018); and 2) Adoption of Resolution No. 2023-273 authorizing city staff to negotiate with the City of Vista’s subsidiary Buena Sanitation District for acquisition of the Buena Outfall by the City of Carlsbad. FISCAL YEAR 2023 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT – Adoption of Resolution No. 2023-274 authorizing the City Manager to accept the fiscal year 2023 Edward Byrne Memorial Justice Assistance Grant funds and authorize the Deputy City Manager, Administrative Services, or designee to appropriate $19,795 to the Public Safety Grants Special Revenue Fund. (Staff contact: Amanda Baker, Police Department) BOARD AND COMMISSION MEMBER APPOINTMENTS: None. ORDINANCES FOR INTRODUCTION: 4. ORDINANCE AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 10.28 ADDING SECTION 10.28.997 ESTABLISHING AN ALL-WAY STOP AT MADISON STREET AND OAK AVENUE – Introduction of Ordinance No. CS-461 amending Title 10, Chapter 10.28 of the Carlsbad Municipal Code to add Section 10.28.997 to establish an all-way stop control at Madison Street and Oak Avenue. (Staff contact: John Kim, Public Works Department) City Manager’s Recommendation: Introduce the ordinance. City Traffic Engineer John Kim presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Socorro Anderson expressed support and shared recommendations for the all-stop control at Madison Street and Oak Avenue. Nov. 7, 2023 Carlsbad City Council Regular Meeting Page 3 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta to introduce Ordinance No. CS-461. Motion passed unanimously, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC HEARING: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 5. POTENTIAL MEASURES TO REDUCE GREENHOUSE GAS EMISSIONS FOR THE CLIMATE ACTION PLAN UPDATE – Receive a report on potential measures to reduce greenhouse gas emissions for the draft Climate Action Plan update and provide feedback to staff as desired. (Staff contact: Katie Hentrich, Public Works Department) City Manager’s Recommendation: Receive the report. Senior Program Manager Katie Hentrich presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mike Borrello expressed concerns with the funding associated with implementing the Climate Action Plan. Vaness Forsythe expressed support for updating the Climate Action Plan. Paige DeCino expressed support and provided feedback on the Climate Action Plan. Michael McMahon expressed support and provided feedback on the Climate Action Plan. Lynda Daniels expressed support for updating the Climate Action Plan. Mary Hassing expressed support for updating the Climate Action Plan. Aly Williams expressed support and provided feedback on the Climate Action Plan. Jay Klopfenstein expressed support and provided feedback on the Climate Action Plan. Nov. 7, 2023 Carlsbad City Council Regular Meeting Page 4 In response to an inquiry from Council Member Luna, Senior Program Manager Hentrich explained that grid reliability did not seem to be of concern through the data collected by the city consultants working on these studies. In response to an inquiry from Council Member Luna, Senior Program Manager Hentrich explained that the final draft can include more benchmark dates to measure success on the path to 2035 and 2045. In response to an inquiry from Council Member Burkholder, Senior Program Manager Hentrich explained that direct outreach to small businesses to ask about their ability to operate under all electric measures has not been done but can be with City Council direction. In response to an inquiry from Council Member Burkholder, Senior Program Manager Hentrich explained that the city does not have a formal definition for climate equity. Ms. Hentrich added that staff is currently looking for grant funding to support analyzing how to establish and measure climate equity within the City of Carlsbad. In response to an inquiry from Council Member Burkholder, Senior Program Manager Hentrich explained that the city does not have a formal definition of climate grief. Council Member Burkholder commented that it would be helpful to develop a definition when looking for grant funding. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that prohibiting synthetic turf has been analyzed by the city and could be revisited if desired. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that the city currently does not have benchmark dashboard that tracks the success of Climate Action Plan action items, but staff have been considering creating one. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that success tracking of the action items would be included in annual reports, website publication and potential dashboard trackers. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that taking a position on leaded fuel might be more appropriate in a different manner rather than in the Climate Action Plan. City Attorney McMahon added that the Legislative Subcommittee would be the appropriate body to take a position on this matter. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that the Climate Action Plan will be a CEQA qualified plan which leads to legal Nov. 7, 2023 Carlsbad City Council Regular Meeting Page 5 consequences if not followed, which will assist in accountability of reaching these goals. In response to an inquiry from Council Member Acosta, Senior Program Manager Hentrich explained that there are various methods of public education currently ongoing, and education is on the forefront on important measures. Mayor Blackburn declared a recess at 6:48 p.m. Mayor Blackburn reconvened the meeting at 7 p.m. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Senior Program Manager Hentrich explained that a potential data dashboard could also track the progress on the 2035 and 2045 state mandated deadlines. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Senior Program Manager Hentrich explained that the transportation data within the Climate Action Plan comes from the SANDAG Transportation model and is conducted every four years. She explained that the COVID-19 pandemic impacted the 2020 data, so the data from 2016 is the latest and most robust data at this time. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Deputy City Manager Public Works Paz Gomez explained that there are currently electric vehicle charging stations being installed at the State Street parking lot and as soon as design ideas are finalized, they will be brought to the City Council for approval. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Environmental Sustainability Director Jamie Wood explained that grid level energy storage is not a topic in the Climate Action Plan but could be looked at on a larger scale throughout the city. In response to an inquiry from Mayor Pro Tem Bhat-Patel, Senior Program Manager Hentrich explained that one of the ways that the city is incentivizing businesses to operate with solar is through the Green Business Program, and additional information on rebates and incentives can be found on the city’s website. The City Council received the report. 6. CITY COUNCIL POLICY – CITY COUNCIL CONFERENCE, TRAINING AND PROFESSIONAL DEVELOPMENT TRAVEL POLICY – Adoption of a resolution approving City Council Policy Statement – City Council Conference, Training and Professional Development Travel Policy. (Staff contact: Sheila Cobian, City Manager Department) City Manager’s Recommendation: Adopt the resolution. Mayor Blackburn announced that this item was being continued to the Regular City Council Carlsbad City Council Regular Meeting Page 6 Meeting scheduled for Nov. 14, 2023. PUBLIC COMMENT (cont.): Suzanne Hume expressed concerns relating to the use of pesticides. Aly Williams urged the City Council to ban leaded aviation fuels. John Bottorff urged the City Council to consider banning tobacco use. COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members.
