SUBJECT: CT 97-23x2/SDP 97-26x2 -MAGNOLIA SUBDIVISION -PHASE II
EXTENSION -Request for a time extension for a Tentative Tract Map and Site
Development Plan for Phase II of the Magnolia Subdivision on property located
on the northwest comer of the intersection of Magnolia A venue and Adams
Street.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5282
APPROVING a one-year extension of CT 97-23 and SDP 97-26 based upon the findings and
subject to the conditions contained therein.
II. INTRODUCTION
Immediately prior to the scheduled September 18 hearing date for this project, the applicant
submitted a letter requesting that the project be continued to October 2. The project planner was
going to be unavailable for the hearing on September 18. In addition, Planning staff was having
on-going discussions regarding the affordable housing conditions of approval. (See discussion in
the September 18 staff report.)
In the September 18 staff report, staff included a discussion of the affordable housing conditions
on the project. There was also a discussion of some after-the-fact corrections that were to be
made to the resolution of approval for the project. Since September 18 staff has confirmed that
the corrections had actually already been made. Therefore, staff has now revised the resolution
of approval (Resolution No. 5282, attached).
The project as designed remains consistent with all applicable City requirements, including the
subdivision and zoning regulations (Titles 20 and 21 of the Carlsbad Municipal Code). The
project also remains consistent with the requirements of the Local Facilities Management Plan
for Zone 1, as all necessary infrastructure will be provided concurrent with development.
Staff believes another one-year extension of the project would benefit the City. It would allow
the project to be completed as originally designed and would ensure that the two required
inclusionary units were built in a timely manner. (Both of the required inclusionary second
dwelling units are in Phase II of the project.) If the Planning Commission chooses to approve the
extension of CT 97-23 as recommended by staff, that extension will automatically extend the

expiration date of the related SDP 97-26, pursuant to Carlsbad Municipal Code Section
21.58.020(b).

II. INTRODUCTION
The owner of CT 97-2'.3/SDP 97-26 (Magnolia Subdivision) has requested a time extension for
the tentative map for Phase II of this nine-lot residential subdivision located north of Magnolia
A venue and west of Adams Street. The applicant is currently engaged in construction of houses
within Phase 1 of this subdivision (recorded) and is working on grading and improvement plans
for the Phase II. The financial issues associated with development of the site have hampered his
progress toward final map approval of the second phase of this subdivision. This extension
would allow the developer another year to finalize the design of Phase II and to pull a building
permit. Pursuant to Section 21.58.020(b), any extension of the tentative tract map would
automatically extend the expiration of the associated site development plan (SDP 97-26).
III. PROJECT DESCRIPTION AND BACKGROUND
Magnolia Subdivision (CT 97-23/SDP 97-26) is a nine-lot subdivision located on the northwest
corner of the intersection of Magnolia A venue and Adams Street. The developer has completed
four homes in Phase I. Phase I consists of four lots accessed off Magnolia A venue. Phase II
consists of five lots to be accessed off Adams Street. The applicant is requesting a second time
extension for the tentative map/site development plan for Phase II of the project. The applicant
requested a two-year time extension: However, the State Subdivision Map Act limits the life of
tentative maps to a total of five years. The one-year extension that would be approved by the
attached resolution (No. 5282) would extend the project to that five-year limit.

This residential development was originally approved on July 1, 1998. Those approvals included
a negative declaration, a tentative tract map (CT 97-23) and a site development plan (SDP 97-
26). (See Planning Commission Resolutions No. 4283, 4284, and 4285, attached.)
The originally-approved project was scheduled to expire on July 1, 2000. In spring of 2000, the
applicant applied for a two-year time extension for Phase II of the project. That request for
extension was heard by the Planning Commission on May 16, 2001 and again (as a continued
item) on June 20, 2001. (The applicant had made a timely and complete submittal and request
for extension. However, workload issues delayed the item coming to public hearing until well
after the scheduled expiration date.) On June 20, 2001, the Planning Commission granted the
two-year extension for the project. Because of timing issues that two-year extension was
effectively for one year because one year of the extension was a retroactive year. Thus, the
project had a new expiration date of July 1, 2002. (See Planning Commission Resolutions No.
4975, 4934, and 4976, attached.)
At the public hearing held on July 1, 2001 the Planning Commission approved the time extension
subject to the revision of two conditions contained in Planning Commission Resolution No. 4934
for the project. This change in two conditions came about as a result of discussion at the public
hearing and related to the affordable housing conditions applied to the project. Unfortunately,
the resolution did not get revised to reflect the approved new wording before it was signed by the
Planning Commission chairperson. Staff and the applicant understood what the conditions
meant, and the applicant has satisfied the two revised conditions. In order to correct this
previous omission and ensure that the project documents reflect the actions taken by this and the
previous Planning Commission, staff has now added the revised conditions to Planning
Commission Resolution No. 5282 (for this second extension).
The applicant continues to have financial and design issues which have delayed his completing
the project. He has, therefore, applied for a second time extension for Phase II of the project.
Although this item is reaching a Planning Commission hearing after the scheduled expiration
date (July 1, 2002), the applicant did make a timely and complete submittal for extension and
staff has processed the extension in accordance with the Subdivision Map Act.
The project as designed remains consistent with all applicable City requirements, including the
subdivision and zoning regulations (Titles 20 and 21 of the Carlsbad Municipal Code). The
project also remains consistent with the requirements of the Local Facilities Management Plan

IV. ANALYSIS
The applicant has been diligent in pursuing all items requested for the Tentative Map extension.
As stated above, the project remains in compliance with current codes, policies and growth
management requirements.
V. ENVIRONMENTAL REVIEW
This project was originally approved with a Negative Declaration (PC Resolution No. 4283), and
the first extension was evaluated under a second Negative Declaration (PC Resolution No. 4975).
Staff has reviewed the request for extension and has determined that there are no changed
circumstances or conditions affecting the project, and no new information is available which
would result in the identification of new or increased environmental impacts. Therefore, no new
or additional environmental review is required for this extension.
