SUBJECT: FIRST EXTENSION FOR SDP 2019-0015/CDP 2019-0033 (DEV2019-0019) -JEFFERSON STREET
APARTMENTS
Dear Mr. Marashi,
The Planning Division has completed its review of your application for the first extension of Site
Development Plan, SDP 2019-0015, and Coastal Development Permit, CDP 2019-0033, submitted on
December 13, 2023. The Site Development Plan, SDP 2019-0015, and Coastal Development Permit, CDP
2019-0033, which allows for the removal of an existing commercial use, and the construction of a 35,855
square foot, four-story, mixed-use building consisting of 17 residential apartment units, 2,185 square
feet of commercial and an enclosed parking garage on a 0.32-acre site located at 3039 Jefferson Street
in the Village Center (VC) District of the Village and Barrio Master Plan, was approved on December 14,
2021, and was due to expire on December 14, 2023.
After careful consideration of the circumstances surrounding this reque~t, it has been determined that (1)
the first extension of Site Development Plan, SDP 2019-0015, and Coastal Development Permit, CDP
2019-0033, was submitted in a timely manner prior to the expiration date, and (2) that the findings
required for granting this first extension, can be made; therefore, the City Planner APPROVES the first
extension of Site Development Plan, SDP 2019-0015, and Coastal Development Permit, CDP 2019-0033,
for two (2) years from December 14, 2023, to December 14, 2025, based on the following findings and
conditions.
Findings:
1. All the findings contained in City Council Resolution No. 2021-287 dated December 14, 2023 for SDP
2019-0015 and CDP 2019-0033, and referenced in Planning Commission Resolution No. 7425 dated
September 15, 2021, apply to this extension, and are incorporated herein by reference and remain in
effect.
2. That the first two-year extension of SOP 2019-0015 and CDP 2019-0033 remains consistent with the
General Plan, the Village and Barrio Master Plan, and all titles of the Carlsbad Municipal Code and
growth management program policies and standards in place at this time.
3. That the City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is

therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Infill Development Projects -Section 15332 of the state CEQA Guidelines. In
making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of
the state CEQA Guidelines do not apply to this project.
Conditions:
1. This first extension of Site Development Plan, SOP 2019-0015, and Coastal Development Permit,
CDP 2019-0033, is granted from December 14, 2023, to December 14, 2025. If building permits for
this project are not obtained within this time period, the Site Development Plan and Coastal
Development Permit will expire on December 14, 2025, unless extended per Sections 21.58.040 of
the Carlsbad Municipal Code.
2. All the conditions contained in Planning Commission Resolution No. 7425 dated September 15, 2021,
for SOP 2019-0015 and CDP 2019-0033, apply to this extension and are incorporated herein by
reference and remain in effect except Condition No. 9, which is replaced by Condition No. 1 above.
