PLEDGE OF ALLEGIANCE: Vice Chair Michael Zepeda Jr. led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Special Meeting held on July 10, 2023 Motion by Chair Connolly, seconded by Vice Chair Zepeda, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: None. PUBLIC COMMENT: None. CONSENT CALENDAR: None. PUBLIC HEARINGS: None DEPARTMENTAL REPORTS: 1.PRESENTATION OF CARL.SBAD POLICE DEPARTMENT POLICIES: Receive a presentation regarding Carlsbad Police Department policies. The presentation will include: •Breadth of the Policy Manual •Specific policies that are countywide •Explanation of Special Orders and how they amend policy •Overview of where the policies can be found on the City website. (Staff contact: Christie Calderwood, Police Department) Recommended Action: Receive the presentation. Assistant Police Chief Christie Calderwood presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to Commission Member Frazee, Assistant Police Chief Calderwood explained that hot pursuit is a county wide policy and all agencies that go to the San Diego Police Academy are trained annually on the policy per Senate Bill 719. Police Chief Calderwood further explained that the pursuit is relinquished to the agency that they are currently in, and California Highway Patrol (CHP) continues their pursuit unless they do not know the area. Oct. 23, 2023 Community-Police Engagement Commission Page 2 In response to Chair Connolly, Assistant Police Chief Calderwood explained that all cities in the county follow countywide policies. In response to Chair Connolly, Assistant Police Chief Calderwood explained that when officers arrive on scene for domestic violence, multiple officers will respond and the officer on the scene will ask many questions to determine the primary aggressor. The Commission received the presentation. 2. PRESENTATION OF POTENTIAL NEW POLICY COVERING SURVEILLANCE CAMERA USE FOR INVESTIGATIONS: Receive a presentation regarding a potential new policy covering surveillance camera use for investigations and provide feedback to staff. The presentation will include an explanation of the current policy as well as an explanation of a new potential policy. (Staff contact: Mickey Williams, Police Department) Recommended Action: Receive the presentation and provide feedback to staff. Police Chief Mickey Williams presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to Commission Member Cannon, Police Chief Williams explained that during temporary camera set up, the.recordings will be retained by the police department for one year and if investigators determine there is a legitimate purpose, they will place the recordings in department evidence. In response to Commission Member Novak, Police Chief Williams explained that the operational level at which decisions regarding the operational guidelines will be made will be at the Sargeant level. Police Chief Williams further explained that there are sections of the policy that require every member of the department to report if a violation has occurred. In response to Commission Member Frazee, Police Chief Williams explained that there is no audio on cameras that are deployed on a temp·orary basis due to eaves dropping laws. In response to Vice Chair Zepeda, Police Chief Williams explained that the placement of the cameras at Rosevelt and Chestnut was based on the increase of frequency of gang related graffiti and violence. In response to Chair Connolly, Police Chief Williams explained that there is not a duty from police to notify the public that they are being recorded since there is not a reasonable way to provide notice. In response to Chair Connolly, Police Chief Williams explained that investigatory files are not subject to the California Public Records Requests, but residents can file a records request which will go under analysis by the City's Attorneys. PRESENTATION OF POLICE DEPARTMENT 3-YEAR STRATEGIC PLAN: Receive a presentation regarding the Police Department 3-Year Strategic Plan. (Staff contact: Mickey Williams, Police Department) Recommended Action: Receive the presentation. Police Chief Mickey Williams presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The Commission received the presentation. Item No. 4 was heard before Item No. 3. 4. COMMUNITY-POLICE ENGAGEMENT COMMISSION WORK PLAN: Participate in a facilitated discussion regarding the creation of the Community-Police Engagement Commission Annual Work Plan. (Staff contact: Sheila Cobian, City Manager Department and David Graham, Administrative Services Department) Recommended Action: Participate in a discussion. Chief Innovation Officer David Graham presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The Commission received the presentation. COMMISSION COMMENTARY AND REQUESTS FQ.R CONSIDERATION OF MATTERS: This portion of the agenda is for the Commission to make brief announcements, brief reports of their activities and requests for future agenda items. Chair Connolly suggested and the Commission concurred to add a standing agenda item that would be a Police Chief review of recent events, similar to what the Traffic and Mobility Commission have on their agenda. Motion by Commissioner Frazee, seconded by Commissioner Novak, to direct staff to bring an item forward with an overview of the current complaint system between the Community and the Police Department. Motion carried unanimously, 5/0. Motion by Commissioner Frazee, seconded by Commissioner Cannon, to direct staff to bring an item forward regarding the handling of mental health issues and CARE Court update. Motion carried unanimously, 5/0. Motion carried unanimously, 5/0. Motion by Commissioner Frazee, seconded by Commissioner Novak, to direct staff to bring an item forward that catalogs impediments to transparency. Motion carried, 4/1 (Zepeda -Abstain). ANNOUNCEMENTS: This section of the Agenda is designated for announcements to advise the community regarding events that Members of the City Council have been invited to, and may participate in.
