SUBJECT: CUP 02-32xl -BOB BAKER VEHICLE STORAGE LOT-Request for a five-
year retroactive extension of Conditional Use Permit (CUP) 02-32 to allow the
continued use of a 245-space vehicle storage lot located on the southwest comer
of Cannon Road and Avenida Encinas in the P-M Zone, within the Mello II
Segment of the Local Coastal Program and Local Facilities Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 6457
APPROVING a five-year retroactive extension of CUP 02-32 based on the findings and subject
to the conditions contained therein.
II. INTRODUCTION
The proposed five-year retroactive extension of CUP 02-32 will allow for the continued use of a
245-space vehicle storage lot for new car inventory by the Bob Baker dealerships located in Car
Country Carlsbad from August 6, 2008 through August 5, 2013. The application for the
extension was submitted prior to the expiration of CUP 02-32.
III. PROJECT DESCRIPTION AND BACKGROUND
On August 6, 2003, the Planning Commission approved CUP 02-32 and CDP 02-54 (Resolution
Nos. 5445 and 5446, respectively) to authorize the construction and use of a 245-space vehicle
storage lot for new car inventory by the Bob Baker dealerships located in the Car Country area.
Staff has previously-performed annual reviews of the project in accordance with the conditions
of approval. At each of the annual inspections, the project was determined to be in compliance
with the conditions of approval for the project. As a part of the current Conditional Use Permit
(CUP) extension request, staff conducted a site inspection and determined that the landscaping
needed refurbishment in a few areas, namely along the eastern berm fronting A venida Encinas,
the northern berm fronting Cannon Road as well as the northeast comer of the site, adjacent to
the intersection of Avenida Encinas and Cannon Road. Pursuant to Planning Commission No.
11 of Resolution No. 5445, all landscaping shall be maintained in a healthy and thriving
condition. Consequently, staff requested that the landscaping be refurbished as needed prior to
taking the project forward for consideration by the Planning Commission. Accordingly, the
applicant has addressed staffs concerns and has adequately refurbished the landscaping pursuant
to the originally-approved landscape plan.
Condition No. 10 of Resolution No. 5445 specifies that CUP 02-32 is granted for a period of 5
years but may be extended for a reasonable period of time not to exceed five (5) years upon

written application of the permittee (BOB BAKER). Staff is recommending a five-year
retroactive extension to allow the continued operation of vehicle storage from August 6, 2008 to
August 5, 2013.
IV.
A.
ANALYSIS
The vehicle storage lot located at the southwest comer of A venida Encinas and Cannon
Road continues to be consistent with all applicable plans, policies and regulations
described below:
1. Carlsbad General Plan;
2. Title 21 of the Carlsbad Municipal Code;
3. Mello II Segment of the Local Coastal Program; and
4. Local Facilities Management Zone 3.
B. The adopted project findings for CUP 02-32, which are contained m Planning
Commission Resolution No. 5445 still apply to this project (CUP 02-32xl).
C. The adopted project conditions for CUP 02-32, which are contained in Planning
Commission Resolution No. 5445 still apply to this project (CUP 02-32xl) with the
exception of Condition No. 10 which is replaced by Condition No. 4 in Planning
Commission Resolution No. 6457 to extend CUP 02-32 retroactively from August 6,
2008 to August 5, 2013 and one additional Engineering condition has been included
(identified as Condition No. 5) to address perpetual maintenance of post-construction
stormwater Best Management Practices.
D. No formal written complaints regarding CUP 02-32 have been submitted to the City.
E. A follow-up site inspection confirmed that the site landscaping has been refurbished as
required pursuant to the approved landscape plan for CUP 02-32. Therefore, the project
is currently in compliance with all conditions of approval.
F. The project remains in compliance with the existing Coastal Development Permit (CDP),
CDP 02-54.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines.
