SUBJECT: CUP 103{B) -LAS FLORES CHURCH OF THE NAZARENE -Request for
a Conditional Use Permit Amendment to allow a 1,952 square foot addition to an
existing church on a 1.83-acre site located north of Las Flores Drive and west of
Highland Drive, in Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5582,
APPROVING Conditional Use Permit Amendment CUP 103(B) for a period of five (5) years,
based upon the findings and subject to the conditions contained therein.
II. INTRODUCTION
The project consists of a 1,952 square foot addition to the Las Flores Church of the Nazarene for
the purpose of expanding the child center and remodeling and expand portions of the existing
sanctuary. The upper parking lot near Highland Drive would also be expanded as part of the
proposal. The request requires an amendment to the Conditional Use Permit (CUP 103(B)) for
the church. The project meets all applicable regulations and standards and staff has no issues
with the proposal.
III. PROJECT DESCRIPTION AND BACKGROUND
The Las Flores Church of the Nazarene is requesting a Conditional Use Permit amendment to
allow an expansion of the child center, to remodel and expand portions of the existing sanctuary,
and to expand an existing parking area. The 1.83-acre site is located north of Las Flores Drive
and west of Highland Drive. The property is designated Residential Low-Medium density
(RLM) in the City's General Plan and is zoned R-1 (One-Family Residential). Single-family
residential uses surround the site, with the exception of the southwest portion of the site which
borders Buena Vista Elementary School (located south of Las Flores Drive). The existing
church development includes a 4,908 square foot office/administration/classroom building
located on the east end of the site (near Highland Drive) and a 4,813 square foot sanctuary
located east of the central area of the site. The sanctuary currently contains a children's nursery,
classrooms, kitchen and rest area. The proposed 1,952 square foot addition would be located on
the west end of the sanctuary. The addition includes an area which will be used to care for
children during services and a new narthex (lobby). The existing narthex will be removed to
allow for an expansion of the sanctuary area.
The site contains two parking areas connected by a driveway. The primary parking lot (lower
lot) located on the west side of the site contains 55 spaces and is accessed via Las Flores Drive.

The secondary lot (upper lot), located on the east side of the site and accessed from Highland
Drive, will be reconfigured to provide seven (7) additional parking spaces for a total of 10
spaces. Several site improvements will also be made including a new walkway from the lower
parking lot to the sanctuary, a new handicap ramp from the upper parking lot to the sanctuary
and new landscaping throughout the site.
The church has a variety of classrooms, offices, and conference rooms in addition to the
sanctuary. The applicant has indicated that the church holds two worship services and two
Sunday school sessions at 9:00 a.m. and 10:40 a.m. on Sundays, and occasional Sunday night
worship services from 5:00 p.m. to 8:00 p.m. The sanctuary is also used weekdays from 6:00
p.m. to 9:00 p.m. for worship practice (Monday and Thursday) and for Junior and Senior High
Youth Services (Tuesday and Wednesday, respectively). Occasionally, meetings are held on
Saturdays.
The administrative offices are used Monday through Friday during the normal business hours of
8:00 a.m. to 5:00 p.m. The classrooms are used Monday through Thursday for daytime classes
(8:30 a.m. to 11 :00 a.m.) and for evening classes (6:00 p.m. to 9:00 p.m.) The classrooms are
generally used for different ministries of the church, such as bible study. Two classrooms are
used Monday through Thursday evenings by Mira Costa College for English as a Second
Language (ESL) classes.
The original church development was approved by CUP 103 on January 14, 1975 which allowed
the initial construction of the church, use of the office/administration/classroom building, and a
54-space parking lot. The approval also included plans for a phased expansion of the sanctuary
and classrooms for a total of 13,705 square feet (not including the existing 4,908 square feet of
office/administration/classroom building). No additional parking beyond the 54 spaces was
required for the phased expansion plan.
In July 2001, the applicant submitted an application (CUP 103(A)) for a new 12,960 square foot
sanctuary/classrooms and a remodel of the existing sanctuary into 4,710 square feet of classroom
uses. No changes were proposed for the 4,908 square foot office/administration/classroom
building. The applicant solicited input from the neighbors and held neighborhood meetings
regarding the development proposal. Based on the neighborhood objections to the major church
expansion proposal, the project was withdrawn. The project was subsequently scaled down
considerably and resubmitted as CUP 103(B).
The Las Flores Church of the Nazarene project is subject to the following regulations:

IV. ANALYSIS
The recommendation for approval of this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of these regulations/policies utilizing both text and
tables.
A. General Plan
The Las Flores Church of the Nazarene proposal is consistent with the applicable policies and
programs of the General Plan. Particularly relevant to the church addition are the Land Use,
Circulation, and Public Safety Elements. Table 1 below indicates how the project complies with
these particular elements of the General Plan.

B. One-Family Residential Zone (Chapter 21.10 Carlsbad Municipal Code)
As mentioned above, the Las Flores Church of the Nazarene site is zoned R-1 (One-Family
Residential) and is, therefore, subject to the development standards contained in Chapter 21.10 of
the Zoning Ordinance. Section 21.42.010(2)(B) of the Zoning Ordinance allows for churches in
residential zones with the approval of a Conditional Use Permit. The existing buildings, as well
as the proposed addition, are consistent with the R-1 Zone front setback (Highland Drive) of 20',
street side setback (Las Flores Drive) of 1 O', interior side setback of 1 O' and rear setback of 20'.
The one-story addition has a height of just over 14' which is well under the 30' building height
limit. The addition increases the total lot coverage to 11.57%, which is within the allowable
40% lot coverage area. The expansion area will be designed to complement the existing
sanctuary with a stucco exterior, composition asphalt roof shingles, and covered arcade on the
south elevation.

C. Parking Ordinance (Chapter 21.44 Carlsbad Municipal Code)
The project is subject to three separate parking standards for the sanctuary, classroom, and
administrative space. The first standard is categorized as public assembly which applies to the
worship uses within the sanctuary. Public assembly uses require one space for each five seats in
the assembly area or one space for each one hundred square feet of assembly area, whichever is
greater. Since fixed seating is not proposed, the calculation of spaces based on square footage is
appropriate. The narthex will not be occupied during services and is not included in these
calculations. Similarly, the platform area will not be used for seating. Parking for the Sunday
school sessions held in the classrooms, together with the uses within the child center, nursery,
and rest area, have also been calculated using the assembly rate of 1 space per 100 square feet.
This corresponds with the assembly rate of one parking space per five people given that the
occupant load for classrooms is 20 square feet. Parking requirements for the office uses are
based on one space per 250 square feet. Given these ratios, the parking requirements on Sundays
include 20.44 spaces for the sanctuary assembly area, 31.66 spaces for the Sunday school
sessions and children's area, and 8.1 spaces for the office uses, for a grand total of 61 spaces.
The applicant has indicated that the all of offices may not be in use on Sunday. However, staff
included all of the offices in these calculations to show that all of the uses could be
accommodated concurrently, without any occupancy restrictions.
Staff also calculated the parking requirements for uses occurring Monday through Friday using
the above rates with one exception. The parking requirements for the classrooms were increased
to the most restrictive standard for college/vocational schools of one space per teacher plus one
space for each three students. This standard was used because weekday classroom uses are not
associated with a public assembly use (such as Sunday school sessions and worship services).
Based on the proposed uses Monday through Friday, staff determined that the maximum parking
required would include 18.33 spaces for the classrooms, 8.1 spaces for the offices, and 20.44
spaces for the sanctuary assembly area for a total requirement of 47 spaces.
Since the project will provide 65 parking spaces, it has been determined that adequate parking
can be provided for the worst case on Sunday, without restricting uses and during the weekdays
as shown in the attached Parking Summary (Attachment 6). No regular services or classes are
held on Saturdays, however meetings do occur occasionally.
It should be noted that currently the child center rooms are not proposed for use except on
Sundays. It is possible that these rooms could be used other days of the week so long as the
overall parking requirement does not exceed a need for 65 spaces. Condition # 22 would allow
modifications to the proposed scheduled of uses, subject to approval of the Planning Director.
D. Conditional Use Ordinance (Chapter 21.42 Carlsbad Municipal Code)
According to Section 21.42.010(2)(B) of the Zoning Ordinance, churches are allowed in the R-1
zone with the approval of a Conditional Use Permit. Therefore, the proposed expansion is
subject to the required findings listed in Section 21.42.020 of the Conditional Use Ordinance.
Table 2 below details the project's consistency with those required findings.

Neighborhood issues regarding the proposal have focused on displeasure with the ESL students
parking on the public street, noise from outdoor services and events, and the desire to screen
views between the residences and the new addition, as discussed in the attached letters
(Attachment 7). In order to address these concerns, the church scaled back its original proposal
for a new sanctuary and full-scale expansion. The church has expressed a desire to have a larger
facility and is actively searching for a new location. In the interim, the proposed expansion is
necessary to accommodate the current congregation. The church will be adding new landscaping
to enhance the grounds and the fencing will be replaced along the north property line. View
obscuring translucent glass will be used on the north-facing windows of the addition to ensure
privacy for the adjacent residents. In order to address parking issues on Sundays, seven
additional parking spaces will be added to the upper lot. The church has contacted Mira Costa
College to encourage its ESL students to park in the parking lot rather than on the public street.
The church has also voluntarily limited its outdoor worship and special event programs to
address noise concerns from the neighbors.
The current CUP does not include any restrictions for hours of operation or classroom usage.
The parking analysis for the CUP amendment shows that adequate parking can be provided on
Sundays, therefore, no use restrictions apply. The parking summary also shows that adequate
parking will be provided for the proposed weekday uses. Flexibility is built in to the CUP to
allow minor modification of the uses/times, subject to approval of the Planning Director, so long

as it can be demonstrated that adequate parking will be provided. No restrictions are proposed
for hours of operation or to restrict occasional outdoor uses.
Additionally, the existing CUP does not have an expiration date. The proposed amendment
would require renewal of the CUP in 5 years, as well as require an annual review of the CUP for
compliance with the conditions of approval.
E. Growth Management
The proposed project is located within Local Facilities Management Zone 1 in the Northwest
quadrant of the City. Since the proposal is a non-residential project, many of the facilities
regulated by the Growth Management program are not affected. The impacts on public facilities
created by the project, and its compliance with the adopted performance standards, are
summarized in Table 3 below.

V. ENVIRONMENTAL REVIEW
The proposal involves a new addition totaling 1,952 square feet to an existing 4,813 square foot
sanctuary/classroom building. Since the project involves an addition that will not exceed 50% of
the floor area of the structure before the addition and the addition is less than 2,500 square feet,
the proposal is exempt from further environmental review pursuant to Section 15301 (Existing
Facilities) of the State CEQA Guidelines. A Notice of Exemption will be issued upon final
project determination.

I own my home, located on the north side of the Las Flores Church of the
Nazarene. Being a property owner, I have reviewed the plans and my concerns
and objections are as follows:
1. The parking lot is full and overflows to the neighborhood at the present
capacity. This is a problem because Highland Drive on the east side of the
church not only has narrow streets, but also no sidewalks. Parking along
Highland is dangerous and creates traffic hazards to both motorists and
pedestrians.
2. There is no sound barrier on the north side of the church, next to my
property. Under existing conditions, the noise travels up into my house with
drums, guitars, and various amplified speakers. During the summer months
this is very disturbing due to the music practice and youth gatherings,
typically taking place later in the evening. Some suggestions to eliminate the
disturbances:
a. Eliminate doors and windows opening to the north side
b. Close these doors and windows and air condition the facilities
3. More supervision should be provided to youth gatherings to eliminate noise in
the evenings.
4. Eliminate bright lights shinning into our homes at night.
5. Eliminating amplified services starting between the hours of 5am-9am and
5pm to 9pm
6. No provisions have been made to screen area north of administration
building, which is used as a DUMP after church functions including picnics and
BBQs. Metal buildings, stage materials, tents, etc all find their way to this
place.
7. My greatest concern is that this is the beginning of a preschool, day care
center, or private elementary school. The number of meeting rooms appears
to be excessive for merely a Sunday school program.
8. I would be against expanding the number of Mira Costa College classes
beyond the present quantity.
9. Recently in the past, there have been illegal activities taking place after hours
in the church parking lot. Blocking the entrance to the parking lot after hours
should eliminate this.

Some of our neighbors have spoken to you recently. They informed us that we have until this Friday,
February 27th to give you our requests for conditions related to the remodeling/new consturction at the
Las Flores Church of the Nazarene.
These are some of the conditions we would like to see placed on the project:
1. A solid sound wall installed on the entire north side of the property
2. No windows or doors facing north
3. No exposed,unsightly outdoor storage
4. Landscaping added to the north of the property and all landscaping be properly maintained
5. No outdoor speakers or amplification
6. A noise curfew be imposed between the hours of 10:00 a.m. and 9:00 p.m.-(eg. youth groups'
screaming, singing, playing outdoor games)
7. Minimal lighting on the north side of the buildings ( no bright lights shining in neighbors' houses)
8. That no school, preschool or on-going daycare be part of this project
9. No street parking on Highland Drive
We have some questions also.
1. How many classrooms are allowed with the current CUP in the current "house"/offices building?
2. What changes are needed to bring the "house"/offices up to code?
3. If the current CUP was to be ammended, would the neighbors be informed?
4. Does the church have a permit to do other work in the interior of the "house'?
5. Does the church have a permit to do the grading that took place on the west side of the sanctuary?
6. Why are there so many "offices" in the current "house"? Can only 3 classes be held in this building
under the current CUP? Could this be ammended?
7. Is there a restriction on the kinds of temporary signs that can be placed on church property advertising
upcoming events?

Amendment to CUP 103
Dear Ms. Kennedy:
It was a pleasure talking to you last week and I appreciated your information regarding
the new plans for the La Flores Church of the Nazarene.
Since talking to you, a neighbor informed me that they had a copy of the new plans that
were submitted to the Planning Department. We were able to review the plans this
weekend and we do have a few questions that we would like to address to you for
clarification.
1) Are there any restrictions regarding the use of the house on Highland Drive, that is
being "brought up to code," or is it entirely up to the church as to how it is to be
used? The plans we saw show the house as ''Existing Administration Building" (page
Al.2), however, it is obvious to the neighborhood that this building is presently being
used and set up for classrooms. On page AO.I the building is identified as ''Existing
Admin. Classrooms (To Remain)." The question is this: What is the declared use of
the building and can the church change the usage of the building once the building
inspector has signed off the project?
2) Can classrooms be rented out to any organization or school by the church?
3) Is there any limit to the number of students that can be accommodated each week?
4) Are there any requirements that must be met in order to run a public school on the
premises?
5) What classroom locations can be rented out to Mira Costa College for E.S.L. classes,
etc?
6) Can the proposed children's area at the West End of the church also be used as
classrooms?
7) How many offices does a church of this size normally require? The plan identifies
approximately nine (9).
8) According to city codes and the CUP amendment presently being processed by the
Planning Department and the city, are there any limitations that will be included or
will the church be able to conduct itself any way they may choose to, now or in the
future?

The neighborhood does not object to the church or to normal activities. We are only
concerned with how the church may use its CUP once it is approved and granted. We
would like to be able to approach the pastor of the church for his input but he has
demonstrated to most of the neighborhood that he is not truthful and in fact he has a
history of being very deceptive regarding his future plans. Therefore, we are relying on
you and the city to inform us of the conditions and restrictions that may be part of the
amended CUP 103.
Once again, we thank you for your openness and honesty in this matter. We also want to
thank you for taking the time to answer our questions and helping us to become properly
informed.
