APPLICANT: CITY OF CARLSBAD
Request: Approval of a Conditional Use Permit for a public
building, as authorized by Section 21.42.010 (21) of the
Munricipal Code. The building will be used for meetings and assembly purposes.
RECOMMENDATION
Staff recommends that CUP-118 be APPROVED because of the following findings and subject to the following conditions:

.. BACKGROUND REPORT
Location and Description of Property: The 2.1-acre site is located north of Beech Avenue between Garfield Street and Carlsbad Blvd. The site is flat, with a handful of old trees scattered over the site. The Magee House and three out- buildings are located on the site.

Past History and Related Cases:
The Magee House and its grounds were offered to the City in the Last Will and Testrllnent of Mrs. Florence Magee. City
Council accepted the bequest May 21, 1974 (Res. 3423), for use
as a meeting place ana a park. Council retained the architec-
tural firm of Environment Design and Graphics to prepare renovation plans for the building. These plans have been completed and approved by Council. Exh’bits B and C are part of those plans.
Environmental Impact Information: A negative Declaration of
Environmental Impact was prepared by the County in connection with its administration of the Community Development Block Grant Program. Restoration of Magee House will be funded through that Program. The Negative Declaration was granted for the following reasons:
1) This project proposes no grading or alteration of the existing topography; therefore, no adverse impacts on the physical environment are foreseen.
2) No new construction is proposed; therefore, there

The Parks and Recreation Element designates the Project Site for a Neighborhood Park (Table 11, page 14). However, there are no guidelines in any of the Elements for the location or development of public buildings.

Water and sewer service are the responsibility of the City of Carl s bad.

Incidental Information:
The uro.iect is located within the Coastal Permit Zone. and has been given approval by the San Diego Coast Regional Commission.
A 20-foot publicly dedicated alley extends south from .Cypress

Major Planning Consideration:
Is the project site a desirable location for a public meeting and assembly building?
DISCUSSION
Use of Magee House for assembly purposes is an excellent oppor- tunity for recycling an existing structure into a new use desired by the Community. While it does not have a central location in the Community, it does have good access for both auto and transit.
While the Zoning Ordinance requires a CUP for public buildings, it does not require one for public parks. As a practical matter Magee House and Magee Park are interrelated. Staff has therefore structured the recommended conditions of approval to reflect both House and Park. Fur?ds for the improvement of Magee Park are tentatively included in the City's 1976-77 fiscal year budget.
