SUBJECT: CUP 139(Al -Sf. ELIZABETH SETON CATIIOLIC CHURCH -Request for an
amendment to Conditional Use Permit No. 139 for a church to expand the
total square footage by approximately 5,000 square feet and to change the
locations of the proposed structures on property located on the southwest
corner of Alga Road and El Fuerte Street in Local Facilities Management
Zone 6.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3636,
APPROVING the Negative Declaration issued by the Planning Director, and ADOPT
Planning Commission Resolution No. 3637, -~PROVING CUP 139(A), based on the
findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The purpose of this application is to allow changes to an approved Conditional Use Permit
(CUP 139) for St. Elizabeth,s Church. The CUP was originally approved in August, 1977.
That approval provided for the same structures as are currently proposed to be constructed
in four phases. The educational center (shown as Phase I on the originally approved site
plan) is the only structure built to date. It currently serves as a church and administrative
center.
The applicant's proposed amendment would expand the total square footage of the entire
project by approximately 5,000 square feet, add a columbarium and change the locations
of the proposed structures. The additional square footage results from several things:
1) the sizes of the proposed education center, sanctuary, and social center have been
increased slightly; 2) The size of the proposed rector/ has been decreased slightly; and
3) the administrative building was not shown on the originally approved plan.

The proposed changes to locations and orientations of some of the structures are shown
on the site plan. The two larger structures (the sanctuary and the future social hall) will
be located on the northern part of the site adjacent to Alga Road. The proposed rectory
and new parking area will be on the southern side near Santa Isabel Street. The sanctuary,
social hall, and administrative building will be oriented toward a main courtyard. The
proposed changes will allow for better pedestrian circulation by providing a central
courtyard with easy access to both parking areas, and will allow all access to be from Santa
Isabel (a local street). The original plan included a curb cut on El Fuerte Street near Alga
Road, which staff would prefer to eliminate. Required parking will be provided in two
parking areas. The applicant is providing 191 spaces, 16 more than the required 175
spaces. (The various buildings will have joint use of the two proposed parking areas.)
The sanctuary is the only building which will be built immediately. The architectural style
of the sanctuary is contemporary with elements of other styles. It will be built of off-white
stucco with a clay S-tile roof in a muted variegated (generally reddish) color. The painted
window trim will be off-white or putty colored. The sanctuary includes a tower (on the
interior portion of the site) with a cross on top of the tower. (See the "C-1 Zone" section
of this report for a discussion of the height restriction.)
The proposed phasing of the project will not change. As currently proposed, Phase II will
include the proposed sanctuary and a temporary Administration Building of 1,500 square
feet. However, the need for the temporary administrative building is currently in question.
Should the temporary building be needed, approval of Planning Commission for the
building appearance will be required. Phase III will include the construction of the Rectory
and a permanent Administration Building (and removal of the temporary facility). Phase
IV will consist of the Social Center. No time table has been provided for the anticipated
full development of the site.
Ill. ANALYSIS
The proposed project is subject to the following plans, standards, regulations, and
or<linances:
1. C-1 (Neighborhood Commercial) Zone Regulations (Chapter 21.26 of the Carlsbad
Municipal Code)
2. Conditional Uses Regulations (Chapter 21.42 of the C2rJsbad Municipal Code)
3. California Environmental Quality Act (CEQA)
Planning Issues
1. Is the use still consistent with the C-1 Zone regulations?

2. Can the findings required for a Conditional Use Permit still be made?
a. Is the use necessary and desirable for the development of the community,
essentially in harmony with the various elements and objectives of the
General Plan, and not detrimental to existing uses specifically permitted in
the area?
b. Is the site adequate in size and shape to accommodate the use?
c. Can all yards, fences, landscaping, and other features necessary to adjust the
requested use to existing or permitted future uses in the neighborhood be
provided and maintained?
d. Is the street system serving the proposed use adequate to properly handle all
traffic generated by the proposed use?
Discussion
1. C-1 ZONE
Both the church and the columbarium are allowed in the C-1 Zone with a CUP, and the
proposed amendment is consistent with the original CUP. There is no requirement for
front or side yards in the C-1 Zone. However, the applicant is proposing setbacks of 10
feet (Alga Road) approximately 17 feet (Santa Isabel Street), and 20 feet (El Fuerte
Street).
Section 21.42.060 (Conditional Uses) directs that, for conditional uses, the maximum
allowed height shall be the maximum height allowed in the underlying zone unless specific
exemptions are made, based on the findings in Resolution No. 3637 and discussed below.
The maximum building height allowed in the C-1 Zone is 35 feet/3 levels. Additionally,
purely architectural features may be permitted as high as 45 feet when certain findings can
be made. However, architectural features are allowed to exceed (by an unspecified
amount) the 35 foot height limit in the surrounding underlying zoning. Therefore,
allowing the proposed 53 foot height is consistent and compatible with surrounding zoning.
The proposed development is in compliance with C-1 Zone regulations.
3. CONDITIONAL USES
Staff has reviewed the requested CUP Amendment and has concluded that the findings
required for a Conditional Use Permit for a church campus and columbarium can still be
made as discussed below.

The use is still necessary and desirable for the development of the
community, is still essentially in harmony with the various elements and
objectives of the General Plan, and is not detrimental to existing uses
specifically permitted in the area. The General Plan and the Municipal Code
recognize the need for the proposed type of use. The proposed use is
consistent with General Plan direction regarding the location of uses for
public assembly. The proposed design will not be detrimental to surrounding
uses. The site is a self-contained parcel separated from neighboring uses by
public streets. In addition, landscaped setbacks and adequate on-site parking
will be provided.
The site is still adequate in size and shape to accommodate the use. The
5.04 acre site is large enough to accommodate all of the proposed structures
and adequate parking. It is also a self-contained parcel separated from the
surrounding multi-family residential uses by public streets.
All yards, fences, landscaping, and other features necessary to adjust the
requested use to existing or permitted future uses in the neighborhood can
be provided and maintained. No walls or fences are necessary because the
site is a self-contained parcel separated from surrounding uses by public
streets. Although yards are not required in the C-1 Zone, the proposed use
will provide 10-foot or larger yards. Adequate landscaping will also be
provided as shown on the proposed site plan.
The street system serving the proposed use is adequate to properly handle all
traffic generated by the proposed use. The site is surrounded by dedicated
public streets. Alga Road is a major arterial, and El Fuerte Street is a
secondary arterial. Access is provided from Santa Isabel Street. All required
parking can be provided on site.
ENVIRONMENTAL RRVIEW
The Planning Director has determined that no significant environmental impacts will result
from this project, and has therefore issued a Negative Declaration on Febntary 10, 1994.
SUMMARY
Staff supports the proposed project and therefore, recommends approval subject to the
:findings and conditions contained in the attached resolution.
