On February 23, 1977, the Commission approved a CUP to retain an existing free-standing sign for Dixon Ford, also in Car Country on Paseo del Norte. The Commission found that the sign was appropriate for the property because sufficient distance (300 feet) separated the existing and requested signs, and that signs of similar size and design were approved for that area. CUP-129, Knauf (Car Country), Resolution Nos. 1304, 1305, 1306. On December 22, 1976, the Planning Commission approved a CUP to allow one free-standing sign on the sites of three automobile dealerships in Car Country. In all three cases, the Commission found that the requested free-standing signs were generally in conformance with the intent and conditions of the Extensive Regional Retail designation appliied to the property in Car Country, and that the signs would enhance the commercial viability of the area. The Specific Plan for ~r Country was adopted by January 18, 1972, (Ordinance 9288). -Y Council on The Council adopted an amendment to the Sign Code permitting additional free-standing signs, November 2, 1976 (Ordinance 8070). Environmental Impact Information The project is categorically exempt from the requirements of the Carlsbad Environmental Protection Ordinance as construction of minor appurtenances to existing commercial facilities. General Plan Information The project site is designated in the Land Use Element for Extensive Regional Retail use. Public Facilities Not applicable. Major Planning Consideration Does the sign proposed meet the intent and requirements of the City's Sign Code? DISCUSSION Approval of the subject CUP will allow one additional free standing sign on a six acre site occupied by two automobile dealerships. The applicant feels that each dealership should have its own identification sign. There are two ways this could be accomplished. One is to divide the site into two parcels. Our code would allow one free standing sign on each parcel by right. The other is to apply for a CUP pursuant to Section 21.41.075(b) of our code. The applicant has chosen the latter. The subject section of the code is attached to this report for your convenience. Please note that the code provides eight very specific standards for such signs. The proposed sign does meet these standards. The eighth condition refers to the maximum sign area. Sign area is computed pursuant to Section 21.41.030(11) of the code. Therefore the area of this sign is 32 sq. feet even though it's two sided. The maximum allowed is 55 sq. feet even though it's two sided. The maximum allowed is 55 sq. feet. Staff sees no problems with this application. The proposed sign meets the code requirements and is designed to be compatible with the architecture of the site. STAFF RECOMMENDATION That the Planning Commission approve CUP 159 based on the following findings and subject to the following conditions. Findings, 1. That the requested use is desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located because: a. The use is allowed by code and specific plan no. 19. b. The proposed sign represents no apparent conflict with the general plan. 2. That the site for the intended use is adequate in size and shape to accommodate the usei 3. That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained because it is already required by code and will be further requi~ed by this CUP. 4. That the street system serving the proposed use is adequate to property handle all traffic generated by the proposed use. CONDITIONS 1. This approval is granted for the property described in the application only. 2. The sign shall substantially resemble the sign depicted on Exhibit A dated 11/22/78. 3. The sign shall be placed as shown on the site plan labeled Exhibit B dated 11/22/78. 4. The sign shall conform to all the requirements of the Carlsbad Municipal Code, especially the requirements of Section 21.41.075(b) which are attached hereto. 'f .. 21.41.075 less in area within the limits of the subdivision at each major approach thereto but not within one hundred feet of any dwelling located outside of the subdivision; and in addition may erect a single freestanding sign of an area not in excess of twenty-five square feet at the subdivi- sion sales office located within the subdivision; (5) In C-1 and C-2 zones and at retail commercial use in C-M zones, one freestanding sign may be placed on each street frontage of a lot, provided that the sign area of the freestanding sign is included within the ag- gregate_sign area allowed for the lot according to the provisions of Table 1 above and that the height of the freestanding sign does not exceed the height of the build- ing or thirty-five feet, whichever is less; (6) Under marquee signs shall be permitted provid- ing that no more than one such sign shall be permitted for each separate business; provided the sign area of the· under marquee sign does not exceed six square feet, and further provided that the sign area of the under marquee sign is included within the aggregate sign area as stated in Table 1 above; (7) In addition to all signs otherwise herein allowed, a lot actually used as a theater may maintain a marquee sign for the purpose of announcing current activity taking place on the premises, which said marquee s·ign shall have a maximum area of one hundred sixty square feet and a:. height no higher than the height of the building upon which it is located or thirty-five feet, whichever is less; (8) Except as otherwise specifically allowed herein, no sign shall be supported otherwise than by the building to which it is affixed. (Ord. 9386 §2(part), 1974; Ord. 9348 §1, 1973; Ord. 9224 §l(oart), 1969: Ord. 9060 §2606). 21.41.075 Additional communit identit and freestand- ing signs. a In addition to all other signs permitted by this chapter, property within the boundaries of a planned community, specific plan or planned unit development may have a sign program that provides for entrance, exit, directional and community identity signs; provided, the sign program is approved as part of either the master plan for the planned community, specific plan, planned unit development or any amendments thereto. The aggregate sign area of all signs in a community identity sign program for any one development shall not exceed a total of one hundred square feet, plus three square feet per acre of property within the development. No individual ~dgn in such program shall have an area greater than one hundred fifty square feet, or exceed fifteen feet in height. Amendments to an approved community identity sign pro·- gra.m may be granted by the planning com.'llission if it is detr~r- mined such·amendments are consistent with the overall objec- tives of the plan. ,w 412 (Carlsbad 1/15/77) .. 21.41.080 (b) Subject to the provisions of Chapter 21.50 and this section, additional freestanding signs are permitted in the C-2 zone by conditional use permit. If such signs are approved as a part of a master plan in a planned community, specific plan or planned unit development, a conditional use permit is not required. Additional freestanding signs shall not be ap- proved pursuant to this section unless it is found that the signs are appropriate for the use of the property, co~patible with the design of the development, compatible with the adja- cent properties, will not interfere with tha safety of the traveling public, will not res~lt in a proliferation of signs in the area, will not adversely affect the appearance of the area and will not unduly restrict any views. The specific number, size, height, location, appearance and other aspects of the additional signs, subject to the limitations of this chapter and this section, shall be regulated by the terms of the conditional use permit or other sign approval. ·Any addi- tional freestanding sign shall be subject to the following limitations: (1) The signs are monument signs, not greater than eight feet in height or eight feet in length or pole signs not to exceed twenty feet in height; (2) In order to qualify for-any such sign, any free- standing sign permitted by right for the property must be lo- cated at least fifty feet from any interior property line; (3) The signs shall not be erected within two-' hun- dred feet of another freestanding sign on the same property; (4) The signs must be located at least fifty feet from an interior property line; (5) The signs shall be so oriented that the primary view is from surface streets; Interstate 5 or Highway 78 shall not be considered surface streets; (6) The aggregate sign area for the entire development does not exceed the sign area allowed for the development ac- cording to the provisions of Table l; (7) No portion of such sign shall extend over the public right-of-way, or be within fifteen feet of any drive- way or corner; (8) The maximum sign area for any such sign shall not exceed fifty-five square feet. (Ord. 8070 §1, 1976). _21.~l.080 Time limit for conformance of existing sign. As oftl1e effective date of the ordinance codified in this chapter, any sign which does not conform to all of the re- quirements of this chapter may no longer be structurally or electrically altered, increased in area or relocated unless i.t is made to comply with all of the provisions of this chapter; provided however, that it may be maintained, repaired and painted without permit or fee, for a period based on the fol- l.owing scale: 413 (Carlsbad 1/15/77)
