CUP 174 -LA COSTA LAND CO./COMMUNITY ANTENNA
SYSTEM, INC.
Installation of an Earth Station for Cable
Television located in the undeveloped area
north of Alga Road, east of El Camino Real and
west of Unicornio Road in the P-C zone.
The applicant is requesting approval to install an Earth
Station satellite receiver and a 64 square foot accessory
building at the above described location. The station
would transfer satellite transmissions via an underground
cable to an existing antenna located on Unicornio Street
approximately 1400 feet to the east (Exhibit 'A'). The
receiving apparatus is approximately ten (10) feet in
height and contains a circular receiver approximately 12
feet in diameter as shown on Exhibit 'B'.
The subject parcel is approximately 154.4 acres in size
upon which the proposed location of the station is near
the center. The parcel is essentially undeveloped except
for two single family residences and five small storage
buildings. The proposed location of the earth station
is not visible from the residences.
The present zone of the parcel is P-C and the General Plan
Land Use designation is RLM (Medium-Low Density Residential,
0-4 units/AC). Surrounding land uses include the Mola
commercial and residential development to the southwest
and the La Costa Meadows subdivision located approximately
1400 feet to the east. As a quasi-government project, this
application is exempt from the Public Facilities Fee
established by City Council Policy No. 17.I.
Two cable television franchises exist in the city;
Carlsbad Cablevision and La Costa Cable System. Under
the agreements of the franchise, certain criteria
must be met to ensure future interconnection of the two
companies. Because the Conditional Use Permit is a land
use issue and not a franchising issue, no discussion is
germane to this report. For the Planning Commission's
information, however, attached to this report is a memo
from Roger Greer, Director of Utilities and Maintenance,
indicating the terms of the franchise agreement. Approval
of this Conditional .Use Permit will not adversely affect
this agreement.
ENVIRONMENTAL REVIEW
Staff has reviewed the Environmental Impact Assessment form
submitted by the applicant which indicates no adverse environ-
mental impacts resulting from this project. Staff has field
investigated the site and has found no discrepancies with
the Environmental Impact Assessment. The Planning Director,
therefore, has issued a Negative Declaration, Log No. 635,
on January 10, 1980.
ANALYSIS
Two planning issues are associated with this project:
A) The compatibility of the proposed use with existing
and future surrounding uses, and B) the visual impact
of the earth station on the La Costa Meadows subdivision
to the east.
A. Com atibilit ro osed use with existin and
uture surroun ing uses. s mentione , t e 154.4 acre
site is vacant except for two single family residences
and five small storage buildings owned by the applicant.
Staff has field investigated the site and found that
the location of the earth station is not visible from
the residences and no substantial impacts would result.
The General Plan designation of Medium Low Density allows
for future residential development of the area. The
applicant proposes to use this station as a temporary
facility for a three year period at which time he would
move it to a permanent location in the Carillo Tract of
La Costa. This station, thus, would have no impacts
on future residential development. The removal of this
station within a three year period has been incorporated
into the conditions of approval. At the time of reloca-
tion, the applicant will be required to obtain all
necessary approvals from the City.
B. Visual lnipact on the La Costa Meadows Subdivision.
Exhibit 'A' shows the relationship of the earth station
site to the La Costa Meadows Subdivision. The subdivision
is located on a hill 1500 feet to the east and over-
looks the subject site. From a vantage point at the
end of Zodiac Street, staff has found that the dis-
tance from the subject site and the small size of the
station (10' x 12') will minimize any adverse impacts
on the residents of the subdivision.
RECOMMENDATION
Staff recommends APPROVAL of CUP-174 based on the following
findings and subject to the following conditions:
FINDINGS
1. This project is consistent with all elements of the
General Plan.
2. This project will not result in any significant adverse
environmental impacts and a Negative Declaration, Log
No. 635, was issued on January 10, 1980.
3. That the proposed use is desireable for the development
of the community and is not detrimental to existing or
proposed uses.
4. That the site is adequate in size and shape to accommodate
the proposed use.
CONDITIONS
1. Approval is granted for CUP 174 as shown in Planning
Commission Exhibits 'A', 'B' and 'C' dated January 10,
1980, incorporated by reference and on file in the
Planning Department. Development shall occur sub-
stantially as shown unless otherwise noted in these
conditions.
2. This Conditional Use Permit shall expire and all uses
pursuant to it shall cease three years after the date
of issuance. If an extension is requested, such exten-
sion shall be considered as a new application for a
Conditional Use Permit.
3. This Conditional Use Permit will be reviewed by the
Planning Department in ninety days to ensure compliance
with the conditions. If any of the conditions have not
been met, or are violated, the Planning Department
shall present a report to the Planning Commission.

The La Costa Cable System is applying for the temporary location for a satellite
receiving station to serve their cable TV customer base. It is my understanding
that a permanent head-end and antenna location is planned for the future in the
Rancheros area. I have no comments relating to the land use considerations in
the matter.
The fol1owing is provided as background information relating to the La Costa Cable
franchise in anticipation of the information requirements of the Planning Commission.
l. The La Costa franchise was granted by Ordinance 6058 of October 4, 1977 and
included the following service areas:
a. The original La Costa annexation of 1972.
b. Ponderosa.
c. Northeast annexation.
d. Weigand annexation.
e. La Costa North.
f. Ponderosa North.
This is portrayed in the diagram attached.
2. The Code requires the La Costa system be interconnnected to the Carlsbad
Cablevision system when the customer base exceeds 3500 customers. Satellite
signal could be taken through this interconnection by agreement between La
Costa and Carlsbad Cablevision. The customer base of Carlsbad Cablevision
should reach the 3500 customer threshold in about six months, thus interconnec-
tion will be required.
3. The City presently is the rate regulatory agency for both systems, although
AB699 provides for rate deregulation if all conditions are met at some future
time and the franchisee makes application for deregulation. The City, as rate
regulator, might have some concerns if the receiving station were not the most
economical approach to providing satellite signals and it caused a rate increase
to the basic service. Since satellite receivers are most used to provide pay-TV
signals (for which the City does not regulate rates) there should be no concern
from a rate regulation standpoint.
I have attached pertinent code section relating to Cable TV service. If I can
provide any additional infonnation, please advise.

5.28.030. Cable television service. {a) The cable tele-
vision system permitted to be installed and operated hereunder
shall:
(1) Be operationally capable of relaying to subscrib-
er terminals those television and radio broadcast signals for
the carriage of which the grantee is now or hereafter autho-
rized by the Federal Communications Commission;
(2) Be constructed with the capacity for two-way non-
voice return communication. Any applicant to operate a system
may include a provision for immediate implementation of the
two-way capability. Such applicant shall include a demonstra-
tion of a plan to implement this capability in the future.
The grantee shall provide nonvoice return communication when
the city council so directs and the same is economically feas-
ible;
(3) Distribute color television aignals.which it re-
ceives in color;
(4) Have a minimum capacity of twenty channels;
(5) Provide at least one channel without charge for
local government access;
(6) Provide at least one channel without charge for
educational access;
(7) Provide at least one channel without charge for
use as a public access channel to be scheduled by the grantee
within existing or future Federal Communications Commission
regulations pertaining to the operation of public-access
channels;
(8) When the cable system has reached three thou$and
five hundred subscribers, the grantee shall maintain a studio
and a headend that will be capable of producing live or re-
corded programming to be cablecast in color and/or black and
white for distribution by cable throughout the city. The
grantee shall make available equipment and assistance for the
production of programming at its.studio at lease rates for ,
use by access channel users. Additional equipment shall also
be made available which will permit access users and grantee
to produce programming at locations other than the headend
studio. For public access channel users described in subsec-
tion (7) above, grantee shall provide free use of the produc-
tion facilities and production assistance for the first five
minutes of air time for a period of five year~ after service
is commenced. Any applicant to operate a system under the
provisions of this chapter shall demonstrate in its applica-
tion how it plans to provide and make avaiiable the above
facilities and services.
In the event there are two or more systems in the city
and either or both have reached three thousand five hundred
subscribers, the grantee may petition the city council and
request a modification of this requirement. The intent and
purpose of such request would be to preclude unnecessarily
duplicating studio facilities in the city. Grantee shall

present tbe city with a plan for a suitable equivalent to the
studio requir~ment. Suitable equivalents to the studio require-
ment will be determined by the city council which shall be a
condition of approval of any modification pursuant to this
subsection.
(b} The cable television system permitted to be in-
stalled and operated hereunder may also engage in the busi-
ness of:
(1) Transmitting original cablecast programming not
received through television broadcast signals;
(2) Transmitting television pictures, film and video-
tape programs not received through broadcast television signals,
whether or not encoded or processed to permit reception by only
selected receivers or subscribers;
(3) Transmitting and receiving all other signals,
digital, voice and audiovisual.
(c} The grantee shall provide one co_nnecti9n without
cost, and as designated by the council, when the system passes
within five hundred feet of the lot line or boundary of any of
the following facilities:
(1) Public schools and community colleges within the
city;
(2) Buildings owned and controlled by the city, used
for public purposes and not for residential use, fire and
police stations excepted.
(d) The grantee shall interconnect the system with any or
all other cable systems in San Diego County, or elsewhere, as
follows:
. (1) When the system has reached a level of three
thousand five hundred subscribers, grantee shall interconnect
said system with all other systems within the city. Said
interconnection shall provide one channel, one direction,
headend-to-headend communication, applying the technical stan-
dards contained in Parts 76 or 78 of the Federal Communica-
tions Commission Cable Television Regulations. Nothing in ...
this section shall serve to prohibit grantee from implementi~g
the interconnection of the systems above described prior to
reaching a level of three thousand five hundred subscribers.
(2) Interconnection with other systems shall occur
when the council directs and may be done by direct cable con-
nection, microwave link, satellite, or other appropriate
method. Interconnection may be required for origination and
access channels that are determined by grantee and city to be
technically and economically feasible.
(3) Upon receiving the directive of city to inter-
connect, the grantee shall immediately initiate negotiations
with the other affected system or systems in order that costs
may be shared equally for both construction and operation of
the interconnection link.
(4) City may grant reasonable extensions of time to
interconnect or rescind its request to interconnect upon peti-
tion by the grantee to the council. The council shall grant
said request if it finds that the grantee has renegotiated in

good faith and has failed to obtain approval from the system
or systems of the proposed interconnection, or that the cost
of the interconnection would cause an unreasonable or unac-
ceptable increase in subscriber Fates.
(5) The grantee shall cooperate with an interconnec-
tion corporation, regional interconnection authority or coun-
ty, state or federal regulatory agency which may be hereafter
established for the purpose of regulating, facilitating, fi-
nancing or otherwise providing for the interconnection of
cable systems beyond the boundaries of the city.
(6) Initial technical requirements to assure future
interconnection capability will be:
( i) All cable systems receiving franchises to
operate within the city shall use the standard frequency al-
locations for television signals.
( ii) All cable systems are required to use signal
processors at the headend for each television signal. .
(iii) All local origination equipment is required
to be compatible in order that videocassettes, or videotapes,
can be shared by various systems.
