ON COMPLETE DATE: FEBRUARY 5, 1992 STAFF REPORT DATE: APRIL 1, 1992 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CUP 184(8) -DANIELS CABLEVISION BUUDING EXPANSION -Request to amend a Conditional Use Permit to add an additional 160 square feet of floor area to an equipment building and add three additional ground-mounted satellite dishes to an existing communications facility located east of Squires Dam in Local Facilities Management Zone 15. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3376 APPROVING the Negative Declaration and ADOPT Planning Commission Resolution No. 3377 APPROVING CUP-184(B), based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The applicant, Daniels Cablevision, is proposing to expand their existing communications facility located directly east of the Squires Dam Reservoir and west of the Carlsbad/Vista city border. The facility was originally approved through CUP 184 (Planning Commission Resolution No. 1731) on December 10, 1980. This approval permitted the construction of two 16 foot diameter satellite dishes at ground level, a 320 square foot masonry block equipment building, a 160 foot high relay tower supporting 14 dishes ranging from 4 to 10 feet in diameter, and a 40 foot high tower supporting one 8 foot diameter dish. On August 15, 1990, an amendment to CUP 184 was approved for two additional IO and 15 foot diameter ground-mounted dishes and a 20 foot high fence for interference screening. The entire facility is confined by an 8 foot high chain link fence. The applicant is now requesting approval for a 160 square foot addition on the west side of the equipment building and installation of three ground-mounted satellite dishes, each 15 feet in diameter and a maximum height of 18 feet. The three additional reception dishes will provide Daniels Cablevision customers with 62 channels rather than the current 35 channels. (1) CUP 184(8) -DANIELS Cu ..oLEVISION BUILDING EXPANSION APRIL 1, 1992 PAGE 2 - If this amendment is approved, the facility will consist of a total of 7 ground-mounted satellite dishes ranging from 10 to 16 feet in diameter, one 480 square foot equipment building, a 160 foot high relay tower supporting 14 smaller dishes, a 40 foot high tower supporting one 8 foot dish, and a 20 foot high fence for interference screening. Undeveloped land designated as Open Space on the Land Use Map is located north and south of the site. To the west is Squires Dam which is also designated as Open Space. Located east of the site is the Carlsbad/Vista City border and single family homes. Similar communication facilities are located north and west of the site, including KKOS radio's relay tower and the Pac Tel Cellular relay station. The Squires Dam area is a desirable location for these facilities because the high topography and remote location provide optimum signal transmission. Staff notified the City of Vista Planning Department of the proposed amendment and they had no comment or issues. ill. ANALYSIS Can the four findings required for a Conditional Use Permit Amendment be made? 1. Is the expansion of the facility necessary or desirable for the development of the community, essentially in harmony with the various elements and objectives of the general plan, and not detrimental to existing uses or to uses specifically permitted in the zone in which the antennas and building expansion is to be located? 2. Is the site adequate in size and shape to accommodate the additional antennas and building expansion? 3. Will all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood be provided and maintained? 4. Is the street system serving the facility adequate to properly handle all traffic generated by the additional antennas and building expansion? DISCUSSION Desirable To Community and Harmony With General Plan The proposed amendment is desirable for the community because the additional receiving dishes will improve customer service by relaying additional signals to Daniel's Cablevision customers in Carlsbad and other cities of North County. These additional signals will provide customers with 27 new channels in addition to the existing 35 channels. The facility expansion and upgrade is consistent with the General Plan in that it "assures that CUP 184(B) -DANIELS L "°LEVISION BUILDING EXPANSIO~ APRIL 1, 1992 PAGE3 adequate public services and facilities are available to meet the needs of the existing and future population of the City." The general plan designates the site and surrounding areas as open space. Staff feels that the project is more compatible with the existing and future land uses of this site than less desirable sites. The small scale of the facility and its expansion will not disrupt public or private scenic views, and the goals of the General Plan to "preserve open space areas in as natural a state as possible" and "protect and preserve visually attractive and/ or significant natural areas" are still implemented. A concern of staff is the possible effects that the facility's transmission and reception of signals may have on human health. The applicant has indicated that the power transmitted by the facility is several orders of magnitude lower than the U.S. safety standard and that the facility will not have any detrimental effects on the nearby residences. In fact, there will be no increase in microwave transmission because the proposed dishes will only receive, rather than transmit • signals. These standards are regulated by several organizations, including the Federal Communications Commission and the National Institute for Occupational Safety and Health. Adequate in Size and Shape The proposed amendment is confined within the facility's existing perimeter fence as indicated on Exhibit "A", dated April 1, 1992, and therefore the site is adequate in size and shape to accommodate the building expansion and additional antennas. Features Necessary To Adjust The Requested Use To Existing Or Future Permitted Uses A berm separating the facility from single family homes to the east provides adequate screening to the ground-mounted antennas and building. The proposed satellite dishes will stand no higher than the existing dishes and the existing building will shield the proposed addition from the residences' view. The towers, which are very visible, are too tall to screen and any attempt to screen them would interfere with residences' views. Because all structures are well within the setbacks and all screening is already provided, no additional landscaping, walls, fences or other features are needed. Adequate Street System Because the facility is unmanned and the additional antennas and building expansion will not produce any additional traffic, the street system can adequately accommodate the proposed amended facility. Access to the site is provided by an unpaved, gated road extending from the end of a cul-de-sac on Applewood Lane in Vista. SUMMARY The proposed amendment will improve service to Cablevision customers by expanding the number of available channels without impacting surrounding land uses. The proposed satellite dishes and building will be screened by a berm and no additional adjustments are CUP 184(8) -DANIELS <:.ndLEVISION BUILDING EXPANSION APRIL 1, 1992 PAGE4 needed to accommodate the proposed expansion. In addition, no significant environmental impacts will occur as indicated by the attached Negative Declaration. IV. ENVIRONMENTAL REVIEW Based upon several site visits and completion of the Environmental Impact Assessment, staff has determined that the proposed amendment will not significantly impact the environment. The proposed expansion is confined to an existing predisturbed site and no visual impacts are anticipated. Therefore, the Planning Director has issued a Negative Declaration on February 13, 1992.
