DATE: TO: FROM: STAFF REPORT March 11, 1981 Planning Commission Planning Department SUBJECT: CUP-196 -CRISMAN -Request for a conditional use permit to allow a Montessori School with extended day care on the east side of Madison Street between Elm Avenue and Oak Avenue in the R- P zone. I. PROJECT DESCRIPTION The applicant is requesting a conditional use permit to develop a Montessori School on two parcels with a combined area of .32 acre, located as previously described. One of the lots is presently occupied by an older duplex, which will be utilized for classroom purposes, while the other is occupied by a small residential type structure which will be utilized as an office for the school. The applicant pro- poses to provide the required playground area behind the office and in front of the classroom building. Children attending this school will range from 2½ to 6 years in age. The applicant has indicated that there will be a maximum enrollment of 64 students attended by 6 employees. The proposed school will be operated between 7:00 A.M. and 6:00 P.M. with staggered shifts to reduce traffic congestion caused by the loading and unloading of students. II. ANALYSIS Planning Issues 1. Can the four findings required for the granting of a Conditional Use Permit be made which are as follows: a) That the requested use is necessary or desir- able for the development of the community, is essentially in harmony with the various ele- ments and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b) That the site for the intended use is ade- quate in size and shape to accommodate the use; 8H c) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. III. DISCUSSION As conditioned, it appears that the proposed Montessori School with extended day care can meet the four findings required for the issuance of a conditional use permit. There is a need for additional pre-schools and day care centers in the city of Carlsbad due to the city's rapidly growing population and the greater number of working women. The applicant claims that they have a waiting list of approxi- mately 200 parents who would like to send their children to the proposed school. Since the proposed school is sur- rounded on three sides by commercial or office uses, it should not have a detrimental effect on the existing uses in the neighborhood. The site appears to be adequate in size and shape to accomo- date the proposed use. As shown on Exhibit A, and condi- tioned in Planning Commission Resolution No. 1781, all of the yards, setbacks, fences, parking spaces and other fea- tures necessary to adjust the requested use to existing and future uses in the neighborhood will be provided and main- tained. One of staff's main concerns was that adequate classroom and playground area be provided. Previously the staff has used the figure of 35 square feet of usable class- room space and 75 square feet of playground area per student for pre-school children. Also, as shown on Exhibit 11 A11 , the applicant will be able to provide three on-site parking spaces for the use of the six employees. The Engineering Department recently made a traffic count on Madison Street near its intersection with Elm Avenue. This count indicated that Madison Street is underutilized at the present time and should have no problem handling the pro- posed school. Traffic congestion generated by dropping off and picking up students is a major concern. However, as shown on Exhibit "C", the school will be operating on a staggered shift which will reduce the potential for traffic congestion caused by parents picking up and discharging students. As shown on Exhibit 11A11 , parents will be able to drop their students off in the alley behind the school or via the driveway in front of the school. -2- IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and there- fore has issued a Negative Declaration dated February 13, 1981. V. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Planning Director and adopt Resolution No. 1781, APPROVING CUP-196 based on the findings and subject to the conditions contained therein.
