I. RECOMMENDATION It is recomwended that the Planning Commission APPROVE the Neqative Declaration issued by the Land (Jse Planninq Manager an~ APOPT Pesolution ~o. 2416, APPROVING CDP-196(~) base~ on the findinqs and subiect to the conditions contained therein. II. PROJECT DESCRIPTION The applicant is requesting an amendment to an existing conditional use permit which approved the development of a Montessori School at the above location. One of the conditions of this permit stirulated that approval was aranted to CarlRhad Schools, Inc. and was not assiqnable to others. The lease on this propety recently expired and the new lesse~ would like to continue the use as a Montessori School. In 1981, CUP-196 was approved to permit development of a Montessori School on two parcels with a combined area of .32 acre at the above location. One of the lots is occupied by an older duplex, utilize~ for classroom purposes. The other parcPl is occupied by a small single-farrily dwellino utilized as an office for the school. The reouired playaround area is located behind the office and in front of the classroom building. Four employee parking spaces have been proviaea off the alley at the rear portion of the lot. The school will continue to have a maximum enrollment of 64 students attended by 2-4 employees. The school will also continue to operate between 7:00 a.~. and 6:00 p.m. with staggered shifts to reduce traffic conqestion caused by the loading and unloading of students. cJ( III. ANALYSIS Planning Issues 1) Can the four findings required for the granting of CUP-196 still be maae? These findings are as follows: a) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b) That the site for the intended use is adequate in size and shape to accommodate the use; c) That all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighorhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. III. DISCUSSION As previously stated, the original conditional use permit stipulated the permit was not transferable to others. This is the sole reason for the requested amendment. This condition was placed on the original application because the Planning Commission and staff felt it was important to review any change in the operation of a preschool. There has been no expansion of the use, and the basic operation of the facility has remained the same. As conditioned, it appears the continued use of the Montessori School with extended day care still roeets the four findings required for the issuance of a conditional use permit. The need for a preschool still exists with Carlsbad's growing population. The school has not had a detrimental effect on other uses in the neighborhood in the last four years and no adverse impacts are expected in the future. The site still appears to be adequate in size and shape to accommodate the use and no traffic problems have been generated by the preschool. Madison Street is still under-utilized and should have no problem handling the staggered traffic produced by the school. Staff believes all the rquirements for a conditional use permit are still being met and, therefore, recommends approval of this amendment. -2- IV. ENVIRONMENTAL REVIEW The Land TTse Planning Manager has determined that this project is categorically exempt from environmental review pursuant to Section 15301 and issued a Notice of Exemption on February 11, 1985.
