REQUESTED ACTION: • Add into the Carlsbad Municipal Code (CMC) the street segments
that are currently posted with signs that indicate a parking
restriction between the hours of three a.m. and five a.m.
BACKGROUND:
Various street locations in downtown Carlsbad have signs posted to prohibit parking
between the hours of three a.m. and five a.m. and this parking prohibition is in effect
seven days a week. These locations must be specified in the Carlsbad Municipal Code to
be used as a reference on the citation written by a police officer when a parking violation
occurs.
DATA:
Chapter 10.40.130 of the Carlsbad Municipal Code (attached), specifies locations where
parking between the hours of three a.m. and five a.m. is prohibited. Over the years,
additional street segments with the three a.m. to five a.m. parking restriction have been
implemented by the installation of signs. These additional locations are indicated on
Exhibit 1.
Currently, there are five street segments designated in CMC 10.40.130 that have a
parking restriction between the hours of three a.m. and five a.m. These locations that are
specified in the municipal code require modifications due to changes that have occurred
to the designated street segment parking restriction or for additional clarification.
Exhibit "A" indicates the existing wording in CMC Chapter 10.40.130 and the proposed
revisions/additions.
Carlsbad Municipal Code Chapter 10.40.130 also makes reference to the "traffic safety
engineer" and the "maintenance director." Neither of these references are formal titles of
current staff positions. Chapter 10.08.060 of the Carlsbad Municipal Code references the
"city traffic engineer" and lists the powers and duties of this position. The city engineer is
a currently designated staff position and serves as the official city traffic engineer.
CMC Chapter 10.40.130 should reference the city traffic engineer in lieu of the traffic
safety engineer and maintenance director.
A redline/strikeout version of CMC Chapter 10.40.130 is attached as Exhibit "B" that
highlights the proposed additions and revisions.

The Traffic Safety Coordinating Committee recommends approval of the additions and
revisions to CMC Chapter 10.40.130 as shown on the redline/strikeout version of Chapter
10.40.130 of the Carlsbad Municipal Code.
NECESSARY CITY COUNCIL ACTION:
An ordinance will be required to be adopted by the City Council to implement additions
and revisions to Chapter 10.40.130 of the Carlsbad Municipal Code.
