SUBJECT: CUP-203,·BLANKENSHIP -Request for a Conditional Use
Permit to allow a church with weekly and holiday
assemblages at 3138 Roosevelt Street in an existing
office/retail development in the C-2 zone.
This Conditional Use Permit was requested by Mr. Blankenship to
allow Unity of Carlsbad to hold church related assemblages at his
recently constructed office/retail development. A representative
of Unity of Carlsbad attended the DCC meeting of July14, 1981.
After the applicant reviewed the report and proposed conditions
she felt it was not in their best interests to pursue the project
at this time. The applicant, therefore, decided to withdraw the
request for a Conditional Use Permit.

and holiday assemblages at 3138 Roosevelt Street in an
existing office/retail development in the C-2 zone.
I. PROJECT DESCRIPTION
The applicant is applying for a conditional use permit to allow
Unity of Carlsbad to hold assemblages at a recently constructed
office/retail complex located as described above. Unity of
Carlsbad intends to hold its primary religious assemblages once
a week, Sundays from 10-11 A.M., and on Thanksgiving, Christmas
and New Years Eve. The applicant has indicated that
approximately 10-50 people will attend a typical meeting. The
applicant has also indicated that unscheduled night-time class
meetings will be held 2-3 times a week.
These evening classes will start at 7:30, last approximately two
hours and be attended by approximately 12 people.
A representative of Unity of Carlsbad recently informed staff
that they also plan to hold prayer meetings from 10-11 A.M. on
Wednesdays. Also, weekday class meetings will be held from 10-
11 A.M. on one other day. Staff was informed that approximately
6-8 people will be attending these weekday meetings, but that
Unity of Carlsbad hopes to have a better attendance in the
future.
As shown on Exhibit A the assemblages will be held in rooms C
and D of Roosevelt Plaza which have combined area of 1010 square
feet. Room E will be used for office purposes by Unity of
Carlsbad. The properties to the south and east of the subject
property are occupied by single family dwellings. The property
to the north is occupied by a convenience store while the
property to the west is occupied by the Carlsbad Boy's Club.
II. ANALYSIS
Planning Issues
1) Can the four findings, required for approval of a
Conditional Use Permit, be made?
a. That the requested use is necessary or desirable
for the development of the community; is
essentially in harmony with the various elements
and objectives of the general plan, and is not
detrimental to existing uses or to uses
specifically permitted in the zone in which the
proposed use is to be located;
b. That the site for the intended use is adequate in
size and shape to accommodate the use;
c. That all of the yards, setbacks, walls, fences,
landscaping, and other features necessary to adjust
the requested use to existing or permitted future
uses in the neighborhood will be provided and
maintained;
d. That the street system serving the proposed use is
adequate to properly handle all traffic generated
by the proposed use.
Discussion
As proposed the use is in conformance with the goals of the
general plan; however, staff has concerns that there will not be
enough on-site parking available to handle the demand generated
by the requested daytime meetings as well as the parking
generated by other uses in the building. Therefore, the use as
presently proposed could have a detrimental effect on existing
uses or other specifically permitted uses in the area. This
conflict could be eliminated if a condition of approval limited
the assemblages and classes to evenings and Sundays.
As shown on Exhibit °C 0 , the room is adequate in size to handle
the proposed use. If all of the assemblages and classes are
held while the other suites are vacant, there should be
sufficient on-site parking available. Approval of the
Conditional Use Permit has been conditioned to limit the number
of people that may assemble at one time to 50 so that sufficient
on-site parking will be available.
All of the yards, setbacks, fences, landscaping and other
features necessary to adjust the requested use to existing or
permitted future uses in the neighborhood will be provided and
maintained. The proposed use will have no effect on the
physical aspects of the site since all activity will take place
within an existing building.
It' appears that the existing street system serving the proposed
use is adequate to handle all traffic generated by the proposed
use.
If the conditions recommended by staff are applied, staff feels
that the proposed use will be compatible with the existing uses
in the vicinity and that all the required findings for approval
of a Conditional Use Permit can be made for this project.
V. ENVIRONMENTAL-REVIEW
The Planning Director has determined that this project will not
have a significant impact on the environment and therefore
issued a Negative Declaration dated July 1, 1981.
V. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Planning Director, and ADOPT
Resolution No. 1836, APPROVING CUP-203, based on the findings
and subject to the conditions contained therein.
