SUBJECT: CUP 204(E) -SAINT PA TRICK PARISH SCHOOL -Request for approval
of a Conditional Use Permit Amendment to include the operation of "Saint
Patrick's Ye Olde Garage Sale" as an additional use and to retroactively extend
the approval of the Saint Patrick Parish and School uses, which include nine
mobile classroom buildings, on property generally located north of Tamarack

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 6382
APPROVING Conditional Use Permit Amendment CUP 204(E) to be effective retroactively
from April 2, 2007 through April 1, 2012, based upon the findings and subject to the conditions
contained therein.
II. INTRODUCTION
The application is for an amendment to an existing Conditional Use Permit (CUP 204(D)) to
allow for the operation of "Saint Patrick's Ye O Ide Garage Sale" in addition to the continuation
of the previously approved church (Saint Patrick Parish) and Saint Patrick School which includes
nine mobile classrooms. Saint Patrick's Ye Olde Garage Sale, a thrift store operation, is located
within a converted residential garage and is located at the northeastern most portion of the
church campus property along Adams Street.
The project is in conformance with all applicable plans, standards, ordinances, and policies and
all required findings for the Conditional Use Permit Amendment can be made for the proposed
use. Staff is recommending approval of CUP 204(E), effective retroactively from April 2, 2007
through April 1, 2012.
III. PROJECT DESCRIPTION AND BACKGROUND
The Saint Patrick's site is generally located north of Tamarack Avenue, south of Magnolia
A venue, east of Pio Pico Drive and west of Adams Street. The site consists of three separate
parcels totaling 6.44 acres in size. The existing development on the site includes a 13,700 square
foot church, a 19,366 square foot parish center, a 948 square foot house, a private school (K Thru
8), playground areas, and several surface parking areas. The private school includes a main
administration/library/classroom building complex and nine mobile classrooms. •

The Saint Patrick's site has undergone discretionary review on numerous occasions over the past
several years. The original church development was approved through CUP 99 on August 27,
1974, allowing the initial construction of the church, and parish center. On August 12, 1981, the
Planning Commission approved CUP 204, allowing the construction of a new sanctuary
(church). CUP 204(B) was approved by the Planning Commission on May 15, 1991 and allowed
a 12,400 square foot parking lot expansion. On March 6, 1996, the Planning Commission
approved CUP 204(C), which allowed for the installation of eight mobile classrooms and
approval of joint use parking between the church and the private school. Most recently, the
Planning Commission approved CUP 204(D) on April 3, 2002, which allowed the placement of
an additional mobile classroom (nine total) and redesign of the existing shared parking area and
school playground. '
The current proposal (CUP 204(E)) would grant a 5 year extension of the church and private
school which includes the· use of nine mobile classrooms and the approval to operate "Saint
Patrick's Ye Olde Garage Sale" on the church property as a new and additional use.
Saint Patrick's Ye O Ide Garage Sale operates as a thrift store within an existing converted garage
located on a .48 acre parcel located at the northeastern most portion of the church campus
property along Adams Street. The church has operated the thrift store for approximately 13
years at this location and sells mostly clothing that has been donated to the Parish. It is open
three times a week for approximately five hours each day, and is a benefit and service to the
residents of the community and members of the Parish since it provides clothing for the needy
and serves to support the purpose and mission of the church operation.
On January 4, 2007 the applicant submitted a timely application to extend CUP 204(D). During
the review and extension process of CUP 204(D), a complaint was submitted to the City via
email regarding the thrift store operation. The complainant outlined issues including the
legitimacy and operations of the use, personal safety, and concerns with debris (see attachment
number four). Staff notified the applicant that the project would require an amendment to the
CUP to add the thrift store use as a new use incidental to the operation of the church. Saint
Patrick's Ye Olde Garage Sale has operated at this location for the past 13 years without any
prior formal written complaints. Staff has made several unsuccessful attempts to contact the
complainant to discuss the issues raised in their complaint and was notified via email of the
upcoming Planning Commission hearing.
As previously mentioned, the CUP is also for the private school, which includes the continued
use of nine mobile classrooms. Pursuant to CMC Section 21.42.140, mobile buildings are
limited to a five year term and their continued use requires Planning Commission approval. The
applicant is requesting approval to continue using the mobile classrooms until a new school is
constructed. Saint Patrick School is planning to build an entire new school campus at the
current location. A development committee working for the Parish has established an
anticipated completion date of July 2011 and is in the process of choosing a company for the
fundraising to build the campus. With the completion of the future school campus, the mobile
classrooms would be eliminated.
In summary, the applicant is requesting that in addition to the continued use of the church and
school campus including the mobile classrooms, that the CUP be amended to allow for the
incidental use of thrift sales to occur on the church property.

The proposed project is subject to the following regulations:

Municipal Code);
C. C-T-Q -Commercial Tourist Zoning Designation -Qualified Development Overlay Zone
(Chapters 21.29 & Chapter 21.06 of the Carlsbad Municipal Code);
D. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code);
and •
E. Growth Management Ordinance (Chapter 21.95 of the Carlsbad Municipal Code).
IV. ANALYSIS
The recommendation for approval of this Conditional Use Permit Amendment was developed by
analyzing the project's consistency with the applicable City regulations and policies. The
project's compliance with each of the above regulations is discussed in detail in the .sections
below.
A. Residential Low-Medium Density (RLM) and Private School (P) General Plan Land
Use Designations
The site has a General Plan Land Use designation of Residential Low-Medium Density (RLM)
and Private School (P). The Saint Patrick's Parish proposal is consistent with the applicable
policies and programs of the General Plan as seen in Table 1 below:

B. R-1 One-Family Residential Zone Regulations

Section 21. 10.020 of the Carlsbad Municipal Code allows for churches and private schools in
residential areas subject to the approval of a Conditional Use Permit. The northeastern most
portion of the Saint Patrick's site is zoned One Family Residential (R-1) and is, therefore, subject
to the development standards contained in Chapter 21.10 of the Zoning Ordinance. The
proposed thrift store use, Ye Olde Garage Sales, is located on the residentially zoned portion of
the site and will operate within an existing structure that meets all development standards
contained within Chapter 21.10. The proposed garage sale operation is considered appropriate at
this location as an incidental use to the church operations and the garage is consistent with the
One Family Residential Zone development standards.
C. Commercial-Tourist Zone & Qualified Development Overlay Zone
The C-T Zone allows for churches and private school uses subject to the approval of a
Conditional Use Permit. There are no proposed changes in use within the portion of the site
zoned Commercial-Tourist; therefore, the project remains consistent with the zone. The site is
also located within the Qualified Development Overlay Zone (Q) which states that no building
permit or other entitlement shall be issued for any use in the Q zone unless there is a valid Site
Development Plan approved for the property. The project site has an approved Site
Development Plan, SDP 96-02. Pursuant to Section 21.06.040 of the CMC, the project is
exempt from the Site Development Plan process as no enlargements to the existing structures are
proposed.
D. Conditional Use Permit Regulations
Uses subject to a Conditional Use Permit (CUP) possess characteristics of such unique and
special form as to make impracticable their being included automatically in any land use class.
In granting a CUP, certain safeguards to protect the health, safety and general welfare of the
public may be required as conditions of approval. In addition, CUPs may only be granted when
the appropriate findings of fact can be made. Findings were made for the church and private

school including the use of nine mobile classroom buildings associated with CUP 204(D). Since
that time, Chapter 21.42 of the Carlsbad Municipal Code has been updated with new findings
which can be supported for the proposed CUP Amendment and are described in Table 2 below:

PROJECT CONSISTENCY
The existing church/school campus including
the continued use of nine mobile classroom
buildings and the additional proposed thrift
store use is compatible with the existing and
future uses in the neighborhood. No additional
yards, setbacks, walls, fences, parking,
landscaping, or other features are required to
accommodate the existing and proposed thrift
store uses. The existing parking lot has
adequate parking to accommodate the thrift
store use and the parking lot has attractive
landscaping that is being maintained in good
condition. A six foot high block wall runs
along the northern property line separating the
proposed thrift store use from the adjacent
residence. The wall is adequate in size to
reduce any negative visual impacts from the
thrift store operation. In addition, there is
mature landscaping along the property line
further reducing any visual impacts from the
proposed use.
The existing road ways (Adams Street, Pio
Pico Drive, and Tamarack A venue)
surrounding the property can accommodate the
existing volumes of traffic during off peak and
peak hours. The thrift store use is included in
the existing traffic volumes generated by the
church/school campus since it has been in
operation, although without City approval, for
the past 13 years. The thrift store use ":ill
continue to operate during off peak hours (10
a.m. -3:00 p.m.) and since no changes to the
operation are proposed, no additional traffic
impacts are anticipated. The existing street
system is adequate to properly handle any
traffic generated by the uses.
The adopted project conditions for CUP 204(D), which are contained in Planning Commission
Resolution No. 5149 (CUP 204(D)) still apply to this project with the exception of Conditions
No. 6, and 11 which have been satisfied, and Condition No. 1 Ob which is replaced by Condition
No. 9, and new Conditions No. 10, 11, 12 and 13 which have been added to Planning
Commission Resolution No. 6382 for CUP 204(E). The amended conditions are summarized
below:

1. Condition No. 9 is a standard condition requiring an annual review of CUP 204(E).
Condition No. 9, will also approve CUP 204(E), retroactively from April 2, 2007
through April 1, 2012.
2.-Condition No. 10 is a standard condition requiring the Developer to submit a Notice of
Restriction to be filed in the office of the County Recorder, subject to the satisfaction of
the Planning Director, notifying all interested parties and successors in interest that the
City of Carlsbad has issued a Conditional Use Permit Amendment by Resolution No.
6382 on the property.
3. Condition No. 11 is a standard condition requiring the property owner to process, execute
and submit an executed copy to the City Engineer for recordation a City standard
Permanent Stormwater Quality Best Management Practice Maintenance Agreement for
the perpetual maintenance of all treatment control, applicable site design and source
control, post-construction permanent Best Management Practices within 6 months of
approval of this CUP.
4. Condition 12 is a standard condition requiring that any signs proposed for this
development shall at a minimum be designed in conformance with the City's Sign
Ordinance and shall require review and approval of the Planning Director prior to
installation of such signs. •
5. Condition 13 would limit the hours of operation of the thrift store to 5 hours a day (10
a.m. -3:00 p.m.), 3 days a week.
E. Growth Management Ordinance
The proposed project is located within Local Facilities Management Zone 1. There are no
special development conditions in the zone plan that apply to this non-residential project. All
public facilities needed to serve the development are already in place. The continuation of the
church/school campus including the use of nine mobile classroom buildings and the approval to
operate "Ye Olde Garage Sale" at the site will not result in increased public facilities demands
and, therefore, the project will not exceed performance standards for public facilities.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15301 -Existing Facilities -of the State CEQA Guidelines. In
making this determination, the Planning Director has found that the exceptions listed in Section
15300.2 of the State CEQA Guidelines do not apply to this project.

Below, please find the information that was submitted:
For years I have watched as St. Patrick's Church in Carlsbad (Adams Street) has
illegally operated a Garage Sale out on the church property generally three times a
week for the past 12-13 years (I thought businesses like this where not allowed;
and that we could only have 3 garage/yard sales a year). In the past, Ye Olds
Garage Sale has closed for the summer vacation but this year, they do not plan on
closing except for some renovations.
I have been in the Garage Sale and have heard the women talking about keeping
quiet about the store as it is not legal. So, not only do they accept donations and
resell the items that they personally don'1' want, the profit goes to benefit the
Catholic church, they do not pay taxes on -the profits they do make. Isn't this
illegal? If not, let me know and I to will set up shop.
They claim to be a non-profit but according to the IRS -this status does not apply
to illegal operations on Church property .. Moroever, the Garage Sale does not have
their own non-profit identification number. It is time this stopped!!!!
Also, as you may or may not be aware thait small 2 bedroom house next to the "Ye
Olde Garage Sale" houses numerous peopl·e (some members released from long
term jail stints) that can been seen working as gardeners and perform expensive

tree trimming services daily yet, they report the income or pay taxes on the money
earned in the USA. Even the church has them do extensive services and hides it

Moreover, I am tired of having the illegals dump their waste and other nasty items
on my property while standing around waiting for work. Oven the years, I have had
my life theatened, been stolen from, and robbed more that once by the crowds of
illegals the church draws to the Garage Sale. I appreciate you help and hope the
