SUBJECT: CUP~205, MOLA-DEVELOPMENT -Request for approval of a
Conditional Use Permit to allow the sale of alcoholic
beverages at a restaurant on the east side of El Camino
Real between Alga Road and Dove Lane in the C-1-Q zone.
I. PROJECT·DESCRIPTION-AND·BACKGROUND
The applicant is requesting approval of a Conditional Use Permit
to allow the sale of alcoholic beverages at a restaurant,
located, as described above. The project site is a 5600 sq.ft.
Mexican-style restaurant, named the Crazy Burro.
The restaurant was approved as a portion of SDP 77-1, a Site
Development Plan for the West Bluff Plaza Shopping Center. This
request for a Conditional Use Permit addresses solely the sale
of alcohol in the restaurant. West Bluff Plaza is an existing
shopping center, all other buildings and approved uses having
been fully developed.
II. ANALYSIS
Planning·Issues
1. Can the required findings, for approval of a
Conditional Use Permit, be made? Specifically:
a) That the requested use is necessary or desirable
for the development of the community, is
essentially in harmony with the various elements
and objectives of the general plan, and is not
detrimental to existing uses or to uses
specifically permitted in the zone in which the
proposed use is to be located;
b) That the site for the intended use is adequate in
size and shape to accommodate the use;
c) That all of the yards, setbacks, walls, fences,
landscaping, and other features necessary to adjust
the requested use to existing or permitted future
uses in the neighborhood will be provided and
maintained;

d} That the street system serving the proposed use is
adequate to properly handle all traffic generated
by the proposed use.
III. DISCUSSION
The requested Conditional Use Permit would allow the sale of
alcoholic beverages at a restaurant in an existing shopping
center. The shopping center, West Bluff Plaza, was approved by
the Planning Commission to include a restaurant site. Staff
believes that the inclusion of a lounge and sale of alcohol
would be an appropriate use for a restaurant.
Through Site Development Plan review, the Planning Commission
determined that a shopping center, with a restaurant, would be
compatible with surrounding land uses. Staff believes that the
sale of alcohol, at the restaurant, would not have a detrimental
affect on uses within the shopping center or other adjoining
land uses.
The restaurant would be adequate in size and shape to
accommodate the requested use. Additionally, adequate parking
has been allocated in the shopping center to provide for the
restaurant. Staff does not believe that the sale of alcohol, in
the restaurant, would have a significant impact on the
availability of parking.
Through the Site Development Plan review process, all necessary
buffers, landscaping and setbacks were incorporated into the
shopping center design. Staff does not believe that any
additional features would be necessary to adjust the requested
use to existing or permitted future uses in the neighborhood.
An analysis of potential traffic impacts of the shopping center
was performed at the time of original approval. It was revealed
that the street system serving the shopping center would be
adequate to handle the traffic generated. Staff believes that
the requested use will not generate a significant increase in
traffic and, therefore, that the street system would not be
impacted.
Overall, staff believes that the requested use would be
consistent with a restaurant use and surrounding uses and not
have a detrimental impact on the street system or surrounding
properties.
IV. ENVIRONMENTAL·REVIEW
The Planning Director has determined that this request underwent
previous environmental review as a portion of a larger project
and, therefore, issued a Notice of Prior Environmental
Compliance on July 30, 1981. A copy of the previous
environmental documents is on file in the Planning Department .

v. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Notice of Prior Environmental Compliance filed by the Planning
Director and adopt Resolution No. 1853, APPROVING CUP-205, based
on the findings and subject to the conditions contained therein.
