I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4920
APPROVING a five year extension of CUP 205(A) (CUP 205(A)x3) based upon the findings
and subject to the conditions contained therein.
II. INTRODUCTION
This proposed five year extension of CUP 205(A) will continue to allow dancing and the sale of
alcoholic beverages at 6996 El Camino Real retroactively from January 1, 2001 through
December 31, 2006.
III. PROJECT DESCRIPTION AND BACKGROUND
On August 26, 1981, the Planning Commission approved CUP 205, allowing the sale of
alcoholic beverages at the restaurant located at 6996 El Camino Real. On October 15, 1986, the
Planning Commission approved CUP 205(A) to allow dancing as well as the sale of alcoholic
beverages at the same restaurant. On January 2, 1991, The Planning Commission approved CUP
205(A)xl, extending the permit for seven years and two and one-half months. On March 5,
1997, the Planning Commission approved CUP 205(A)x2, extending the permit for an additional
five years. Condition No. 2 of the approving CUP Resolution No. 3993 specifies that CUP
205(A)x2 is granted for a period of 5 years but may be extended upon written application of the
permittee (Crazy Burro). The applicant (Crazy Burro) is requesting a 5 year extension of CUP
205(A)x2 to continue to allow dancing and the sale of alcoholic beverages at this site.
Subsequent to the applicant filing a request for the extension, the CUP expired on January 1,
2001. Therefore, staff is recommending that the CUP be retroactively extended from January 1,
2001 for a period of five years.
IV. ANALYSIS
A. The Crazy Burro project continues to be consistent with all applicable plans, policies and
regulations described below:

3. Title 21 of the Carlsbad Municipal Code;
B. The adopted project findings for CUP 205 and CUP 205(A), which are contained in
Planning Commission Resolutions No. 1853 and 2626, still apply to this project (CUP
205(A)x3).
C. The adopted project conditions for CUP 205 and CUP 205(A), which are contained in
Planning Commission Resolutions No. 1853 and 2626, still apply to this project (CUP
205(A)x3) with the exception of Condition No. 8 of Planning Commission Resolution
No. 2626 which is amended by Conditions No. 3 and 4 in Planning Commission
Resolution No. 4920 to extend CUP 205(A)x3 for 5 years retroactively from January 1,
2001 through December 31, 2006.
D. No formal written complaints regarding CUP 205(A) have been submitted to the City.
E. Annual reviews have been conducted for CUP 205(A) and the project is in compliance
with all conditions of approval.
F. The extended CUP should be exempted from environmental review per Section 15301,
Existing Facilities, of CEQA.
V. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the
State CEQA Guidelines and will not have any adverse significant impact on the environment.

I. RECOMMENDATION

II. INTRODUCTION
This proposed CUP extension was continued from the November 6, 1996, and February 5, 1997,
Planning Commission hearings to allow staff and the applicant the opportunity to explore the
potential for limited use of the outdoor patio through a shared parking program. The West Bluff
Plaza is already covered by a shared parking arrangement and staff is unable to recommend the
outdoor patio use. Therefore, this proposed five year extension of CUP 205(A) will only serve to
continue to allow dancing and the sale of alcoholic beverages at 6996 El Camino Real, as
conditioned, through January 1, 2001.
III. PROJECT DESCRIPTION AND BACKGROUND
On October 15, 1986, the Planning Commission approved CUP 205(A) to allow dancing and the
sale of alcoholic beverages at 6996 El Camino Real. On January 2, 1991, the Planning
Commission approved CUP 205(A)xl, extending the permit for five years. Condition No. 3 of
the extending CUP Resolution No. 3179 specifies that CUP 205(A)xl was extended for a period
of 5 years and may be extended upon written application of the permittee (Crazy Burro). While
the five year extension period has elapsed, the applicant, Crazy Burro, did make a timely request
for the extension of CUP 205(A)xl that would continue to allow dancing and the sale of
alcoholic beverages at this site through January 1, 2001.
As mentioned above, staff researched the topic of allowing some use of the outdoor patio through
a shared parking or joint use parking arrangement. While the physical use of the existing parking
spaces does not reach capacity, the center is already covered by a shared parking program and no
additional parking reductions can be accommodated through the Zoning Ordinance. The City is
currently processing an Incidental Outdoor Eating Area Ordinance that may provide a vehicle for
the Crazy Burro to gain some use of the outdoor patio area. Therefore, staff is recommending

that the Crazy Burro CUP be extended with the existing condition prohibiting use of the outdoor
patio until such time as the city-wide issue of outdoor eating areas is resolved.
IV. ANALYSIS
A. The dancing and sale of alcoholic beverages continues to be consistent with all applicable
plans, policies and regulations described below:
1. Carlsbad General Plan;
2. Local Facilities Management Plan 6; and
3. Title 21 of the Carlsbad Municipal Code.
B. The adopted project findings for CUP 205(A) and CUP 205(A)xl, which are contained in

still researching the parking requirements and existing supply, therefore, it is recommended that
the Planning Commission CONTINUE CUP 205(A)x2 to· a date certain, that being March 5,
1997.

extension to a Conditional Use Permit to continue to allow the sale
of alcoholic beverages and dancing at the Crazy Burro Restaurant at
6996 El Camino Real.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3179
APPROVING CUP 205(A)xl based upon the findings and subject to the conditions
contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
On August 26, 1981, the Planning Commission adopted Planning Commission Resolution
No. 1853, approving CUP 205, allowing the sale of alcoholic beverages at the Crazy Burro
Seafood Cantina located in the West Bluff Plaza Shopping Center on the northeast corner
of Alga Road and El Camino Real. It was determined that selling alcoholic beverages
would not adversely impact either parking or traffic.
On October 15, 1986, the Planning Commission adopted Planning Commission Resolution
No. 2626, amending CUP 205 to allow a dance floor within the restaurant. As with the
original conditional use permit, it was determined that the addition of a d~nce floor would
not adversely impact parking or traffic in the area. Seven months later, aq agreement was
reached between the City and the restaurant owner to allow outdoor seating in the patio
area in front of the restaurant. To compensate for the potential increase in parking
demand, the owner agreed to close an equal amount of seating inside the restaurant when
patio seating was made available. Attachment "A" is a copy of this agreement. Based upon
several visits to the site, staff has concluded that all conditions of approval for CUP 205(A)
have been met and maintained.
Over the last few months, the Planning Department has been contacting the owners of
properties subject to Conditional Use Permits in an attempt to update records. In response
to tliis contact, the applicant has requested a five year extension of CUP 205 (A), which
expired on October 14, 1988. The actual extension period therefore, exceeds five years to
cover the time elapsed since expiration.

Can the four required findings for a Conditional Use Permit still be made? Namely:
1. Are the conditional uses necessary or desirable for the development
of the community, essentially in harmony with the various elements
of the General Plan, and not detrimental to existing uses or to uses
specifically permitted in the area?
2. Is the site adequate in size and shape to accommodate the conditional
uses?
3. Can all the yards, setbacks, walls, fences, landscaping and other
features necessary to accommodate the conditional uses to existing or
permitted future uses in the neighborhood be provided and
maintained?
4. Is the street system serving the restaurant adequate to handle all
traffic generated by the conditional uses?
DISCUSSION
1. DESIRABILflY AND HARMONY OF USES
The bar and dancing area within the Crazy Burro Seafood Cantina are used nightly
and have developed a fair degree of popularity, without causing adverse impacts to
the community. The conditional uses are therefore desirable for the community
while not being detrimental to surrounding uses. The General Plan calls for
commercial developments to have sufficient off-street parking and to serve the needs
of the community. As discussed previously, no impacts to the existing shopping
center parking have resulted because of the bar and dance floor and these uses have
provided the community with a desired service. Considering the above, therefore,
this finding can be made.
2. ADEQUACY OF SIZE AND SHAPE
The dance floor has been accommodated within the original restaurant structure and
no additional parking was needed to accommodate the conditional uses. The site
is therefore adequate in size and shape to accommodate the bar and dance floor.

3. YARDS, FENCES, LANDSCAPING AND OTHER FEATURES NECESSARY
Since both conditional uses are located within the structure, no exterior screening
was necessary to adjust the uses to surrounding uses. As mentioned previously, no
changes to the existing parking lot were necessary, therefore this finding can still
be made.
4. ADEQUACY OF STREET SYSfEM
The Crazy Burro Seafood Cantina is located within the West Bluff Plaza Shopping
Center and is served by El Camino Real and Alga Road. Both of these arterials are
adequate to accommodate the traffic generated by the bar and dance floor.
SUMMARY
Considering that all findings required for a Conditional Use Permit can still be made and
that all conditions of CUP 205(A) have been met and maintained, staff recommends
approval of CUP 20S(A)xl. Since the conditional use permit expired on October 14, 1988,
the actual period of extension is seven years, two and one half months, with an expiration
date of January 1, 1996.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that according to Section 15301 of the California
Environmental Quality Act, the continued operation of an existing facility is exempt from
environmental review and, in accordance, has issued a Notice of Exemption, dated
November 26, 1990.

SUBJECT: Letter of Understanding for the addition of a
patio area at the Crazy Burro restaurant.
This letter sets forth the understanding of the Crazy Burro
restaurant regarding its proposed addition of seating area
in the patio section of the restaurant. Seating area in
the patio is administratively approved by the Planning
Department subject to the following conditions:
1. At any time that the patio area is open for use as
an eating area for the general public, an equal
amount of seating area within the interior of the
restaurant shall be closed off. It is understood
that the city may revoke its approval of the patio
eating area if this condition is not met. The
intent of this condition is to ensure that no
additional traffic will be generated by the opening
of the patio area.
2. The Crazy Burro may occasionally have private
parties in the patio area during nonbusiness hours
(eg. wedding reception, etc.). Any music for these
activities that is generated from the patio area
must cease by 5:00 P.M.
3. The Planning Department reserves the right to
monitor the use of the patio area and may require
review by the Planning Commission at any time if any
problems arise resulting from this use.

With a "courtyard" of this design we would be able to off er an
affordable area for wedding receptions or semi-private breakfast,
lunch meetings. Any of these functions, would most likely be
over by 5:00 PM at the latest. This same area would most
assuredly make our Sunday Brunch more enjoyable for our patrons.
To ensure that the use does not become objectionable and that no
further traf fie is generated, I have attached a letter agreeing
to mitigating conditions as we discussed at our meeting.
The Crazy Burro, La Costa, is my sole business concern and as a
six year La Costa resident I can tell you that the people in this
area of Carlsbad would greatly appreciate the opportunity to dine
outside on some of these spectacular days. It is my sincerest
wish that the Crazy Burro can provide this luxury for them~

SUBJECT: CUP-205(A) -CRAZY BURRO -Request for approval of an
amendment to a conditional use permit to allow a dance
floor at an existing restaurant on the east side of El
Camino Real between Alga Road and Dove Lane in the c-1-Q
zone.
I • RECOMMENDATION
That the Planning Commission APPROVE the Notice of Prior
compliance issued by the Planning Director and ADOPT Resolution
No. 2626 APPROVING CUP-205(A), based on the findings and subject
to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting approval of a conditional use permit
amendment to allow dancing at the Crazy Burro Restaurant, located
as described above. This restaurant has a floor area of 5,604
square feet. The restaurant was approved as a portion of SDP 77-
1, a site development plan for the West Bluff Plaza Shopping
center. In 1981, CUP-205 was approved which permitted the sale
of alcoholic beverages in the restaurant. The present request
for an amendment addresses solely the permitting of dancing
inside the restaurant. West Bluff Plaza is an existing shopping
center, all other buildings and approved uses have been fully
developed.
III. ANALYSIS
Planning Issues
1) Can the required findings, for approval of a conditional
use permit, be made? Specifically:
a) That the requested use is necessary or desirable
for the development of the community, is essentially
in harmony with the various elements and objectives
of the General Plan, and is not detrimental to
existing uses or to uses specifically permitted in
the zone in which the proposed use is to be
located;

b) That the site for the intended use is adequate in
size and shape to accommodate the use;
c) That all the yards, setbacks, walls, fences,
landscaping, and other features necessary to adjust
the requested use to existing or permitted future
uses in the neighborhood will be provided and
maintained;
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated by
the proposed use.
Discussion
The requested conditional use permit would permit dancing at the
crazy Burro Restaurant located in the west Bluff Plaza Shopping
center. Through the original site development plan review, the
Planning Commission determined that a shopping center, with a
restaurant, would be compatible with surrounding land uses.
Staff believes that a 104 square foot dancing area at the
restaurant would not have a detrimental effect on uses within the
shopping center or on adjacent land uses.
The restaurant is adequate in size and shape to accommodate the
requested use. Additionally, adequate parking has been allocated
in the shopping center to provide for the restaurant. Staff
believes that a dance floor of this size is an incidental use to
the restaurant and will not contribute significantly to an
increase in parking.
During the project review, it came to staff's attention that the
restaurant has expanded its use by installing tables and chairs
on the outdoor patio and by permitting dancing in this area.
This outdoor patio, approximately 910 square feet, is used
primarily from May through October. This expansion of use has
not been approved by the City, nor has an application been
submitted by the applicant.
Staff cannot support this expansion and as a condition of
approval of the indoor dance floor area has stipulated that the
outdoor dancing be eliminated. The basis for this decision is
the lack of additional parking for the increased square footage.
The original parking plan was based on the old parking ordinance
which allocated parking spaces according to the type of use. The
original requirement for the entire shopping center was 285
spaces, minus a 15% reduction permitted for common usage. This
resulted in a required number of 242 spaces, with 249 provided,
(72 spaces were required for the restaurant itself). Under the
present ordinance at 1 :200, 289 spaces would be required;
however, staff believes it is appropriate to maintain the same
parking regulations under which the original parking ratio was
figured. This means that with the 910 square foot addition, 91

spaces would be required for the restaurant. This leaves the
restaurant short, under the old Ordinance, 19 spaces which staff
believes is unacceptable.
In conclusion, staff recommends approval of the requested
conditional use permit to allow dancing inside the Crazy Burro
Restaurant; however, this approval is conditioned upon the
elimination of dancing and dining on the outside patio.
IV. ENVIRONMENTAL REVIEW
This project will not cause any significant environmental
impacts as the project has undergone previous environmental
review as a portion of a larger project and, therefore, the
Planning Director has issued a Notice of Prior Compliance on
June 28, 1986.
